At risk counseling centers would be considered a conditional use within the R -3 zoning district or the CBD zoning district. The applicant is proposing to renovate an existing single family residence of approximately 2,000 square feet. The counseling services that will be offered are geared toward "at risk youth ". The counseling staff will provide group counseling workshops on high risk activities such as drug use, pregnancy, STD's, gang activity, and domestic violence. The applicant will also provide tutoring for GED certificates. The hours of operation are expected to be from 9:00 a.m. to 9:00 p.m. seven days a week. Location Map 2 of Max's House STAFF RECOMMENDATIONS: Staff believes this area could support this type of use. Staff does not have any objections for this type of use for a CUP to allow an "at risk" counseling center in either the R -3 or CBD zoned parcel. CUP CONDITIONS: Section 1 - General Conditions The conditions as set forth in this Conditional Use Permit shall be legally binding upon any heirs, assigns and successors in title or interest. 2. No further expansion of the use or additions to the facility shall be permitted except as approved by another Conditional Use Permit. 3. The property shall be developed in substantial accordance with the conceptual site plan prepared by Weaver Boos Consultants. Formal construction plans, incorporating all conditions stated in this permit, shall be submitted for review and approved by the Site Review Committee prior to the issuance of a zoning clearance or other development permits. The conceptual site plans submitted with the CUP application are not the approved construction plans. 4. No person, firm, corporation or entity shall erect, construct, enlarge, alter, repair, remove, improve, move, convert, or demolish any building or structure, or alter the land in any manner within the boundary of the project without first submitting necessary plans, obtaining necessary approvals, and obtaining necessary permits in accordance with the City of Clermont Land Development Regulations and those of other appropriate jurisdictional entities. 5. The final Certificate of Occupancy shall not be issued until each of the stated conditions has been met. 6. If any of the stated conditions are violated, the applicant understands and agrees that the City Council may revoke this Conditional Use Permit by resolution. 7. The Conditional Use Permit must be executed and processed through the office of the City Manager within 90 days of its date of grant by the City Council or the permit shall become null and void. 8. No business can occupy any portion of the building(s) after construction and final Certificate of Occupancy, unless the proposed business has applied for and obtained a Local Business Tax Receipt from the Planning and Zoning Department. 3 of Max's House 9. This permit shall become null and void if substantial construction work has not begun within two (2) years of the date of this Conditional Use Permit is executed and signed by the permittee. "Substantial construction work" means the commencement and continuous prosecution of construction of required improvements ultimately finalized at completion. 10. If the "At Risk" Counseling center develops any adverse activities as documented by the City Police department, the CUP may be either revisited by the City Council for further restrictions or revoked by the City Council. Section 2 — Land Use 1. The property is approved for use as an At Risk Counseling center as well as uses permitted with the zoning district. Section 3 - Transportation Improvements: 1. Sidewalks shall be required along all public road frontages in accordance with City codes. Section 4 — Architectural Design Standards All structures shall be designed and constructed in accordance with the Architectural Standards of the City of Clermont. In addition, the following shall be allowed: 1. All fencing within public view shall be ornamental metal or brick. 2. All materials stored outside must be within an opaque enclosure, as part of the site plan and approved by the City's Site Review Committee. Because the ad that ran on Sept. 22 contained the wrong information, staff plans to postpone the Planning Zoning and Council hearings set for Oct. 7 and Oct. 14 and 28. On Sept. 30 staff drafts its initial memo to the commission and council, asking to postpone the Barber item (Ord. 603 -M), now with just lots 4 and 5, and to add a new amendment (606 -M) for Hulk Heavy Transport's lot 6. This memo is not sent out when staff realizes that the sale has created a non - conforming lot (Lot 6, owned by Hulk Heavy Transport). Staff drafts a new memo dated October 1, and it is included in the Planning & Zoning packets and the Oct. 14 Council packet. It requests a withdrawal of the Barber /Hulk Heavy Transport amendment request until the non - conformance issues arising out of the sale of Lot 6 are resolved. On Oct. 10, 2009, Loretta Lacek's company, Hulk Heavy Transport, buys lots 4 and 5 from Pamela Barber. With the non - conforming issue eliminated, public hearings can now move forward again. The next opportunity for public hearings is now in December. Staff schedules new ads for hearings on Dec. 2 for Planning & Zoning and Dec. 9 and Jan. 13 for City Council. (December only has one Council meeting.) Ads run on Nov. 17 and Jan. 5. In December, attorney Nikki VanHook, counsel for Hulk Heavy Transport, asks staff if it will be a problem to change the ownership of the three lots. This is being requested for tax reasons. Staff verifies with the City attorney, and since the new company, P.A.L. Holdings LLC has Loretta Lacek as its manager and sole member, and she is president and sole shareholder of Hulk Heavy Transport, Inc., the public hearings are allowed to move forward. An Affidavit of Transfer of Ownership is secured to add to the City's files and the name is changed on all subsequent staff reports and memos. The hearings stay on schedule. The Planning & Zoning Commission heard the item on Dec. 2 and voted 4 -2 to recommend for approval. Staff had received two letters is opposition to the change. Ordinance 606 -M was introduced on Dec. 9. At the final hearing on Jan. 13, after much discussion, the requests were tabled to allow the applicant to provide more information to the Council to assist it in making an informed decision. The request was tabled to a date certain, Feb. 24. On Feb. 24, after much discussion, the City Council unanimously approved the small -scale comp plan amendment, the rezoning from R -3 to CBD and the conditional use permit for the counseling center.
