11-01-1982 Regular MeetingCLTY OF CLERMONT PLANNING AND ZONING .COMMISSION MINUTES November 1, 1982 This regular meeting of the Planning and Zoning Commission was called to order by Chairman Jack Sargent at 7:30 p.m. on Monday, November 1, 1982 in the City Council Chambers. The Invocation was presented by Mr. Sargent. ROLL CALL: Present; Henry Czech, Adelbert Evans, Nick Jones, Jack Sargent, Bob Thompson, Russell Wagner, and Joe Washuta. Absent; Albert Fogle. MINUTES of the meeting on October 5, 1982 were approved as presented. Chairman Sargent announced that the order of the agenda would be changed to allow New Business to be heard first. NEW BUSINESS: Planning and Zoning Technician Marilyn George described a request for a Conditional Use Permit by John Blanchard. He wishes to operate a professional office in an R-3 Residential Professional Zone at 931 West Montrose Street. Mr. Blanchard stated that because his business is conducted by appointment only, ten parking spaces should be more than adequate at this location. There were several questions concerning the type of business conducted by the firm of Blanchard and Abraham and the term "pro- fessional office". Mr. Blanchard said his business now is account- ing, tax service, and consulting. He further stated that he may obtain a real estate broker's license at some future time. A motion was made by Mr. Jones and seconded by Mr. Wagner that in Condition number 4, following the word Abraham, "for the pur- poses of accounting and real estate" be.inserted. Mr. Jones' motion received a unanimous vote. Mr. Evans moved that the recommendation of this CUP be approved as modified, with the following conditions: 1. If, at a future date, parking at this location proves in- adequate, the applicant understands and agrees that the City may require more parking or rescind this CUP. 2. No further expansion of the use or additions to this build- ing shall be permitted except as approved by another CUP. 3. All applicable rules and regulations shall be met, includ- ing final site plan approval, landscaping, parking, and sign regulations. 4. This property may be used only as a professional office for the firm of Blanchard and Abraham for the purposes of accounting and real estate. No other uses may be conducted from this building. This CUP is not transferable to any other business, person, or corporation. 5. No parking from this use shall be allowed on Montrose Street. The driveway shall be of asphalt or concrete with a width of at least ten feet. The parking areas may be of pervious material (i.e. lime rock or chips) but must be properly maintained and bordered to prevent erosion of the material. Ten off-street parking spaces shall be provided, and shall be located behind the front building setback line. 6. The final Certificate of Occupancy cannot be issued until all of the above conditions have been met. • • PLANNING AND ZONING MINUTES November 1, 1982 Page two 7. This permit shall expire if construction has not begun within one year of the date of this CUP. 8. If any of the above conditions is violated, the applicant understands and agrees that the City may revoke this Con- ditional Use Permit by resolution. The motion was seconded by Mr. Washuta and passed by unanimous vote. OLD BUSINESS: A discussion of certain provisions of the Sign Ordinance, tabled at a previous meeting, was concerned with the requirement for signs to be set no closer to the right-of-way than one-half the required front yard setback, and also the fact that signs may be as large as 32 square feet. Both of these regulations apply to R-3 Residential/Professional Zones. Mr. Sargent pointed out that there had been one situation in which parking had been allowed in the front yard, creating a prob- lem for the placement of the sign, and that he felt this to be an individual situation, n,.ot a uniform hardship in staying within the Sign Ordinance. After a long discussion, Councilman Turville, who attended the meeting, stated that the variance privilege is not denied anyone and that the variance process is the way to solve individual sign problems. If the variance requests become a burden to the City Council, the Council will consider changing the Sign Ordinance. Further discussion resulted in the consensus that the Condi- tional Use Permit application show sign placement as one of the requirements. A brief discussion of the County's Comprehensive Plan was held. It was decided to request a statement from the County as to whether the Plan had been reviewed according to the schedule set forth in the Plan. Mr. Evans referred to an Upper Palatlakaha Water Study Docu- ment made available to the Commission members. as useless. He sug- gested that members skim through it. He volunteered to give a synopsis of the complete report at the next meeting of the Planning and Zoning Commission. Mr. Jones reported that the East Central Florida Regional Planning Commission has some Developments of Regional Impact on its agenda, and that P & Z members might wish to attend the meet- ings.
