05-04-1982 Regular MeetingCITY OF CLERMONT MINUTES PLANNING AND ZONING COMMISSION May 4, 1982 This meeting of the Planning and Zoning Commission was called to order at 7:30 p.m. on Tuesday, May 4, 1982 in the City Council Chambers by Chairman Jack Sargent. ROLL CALL. Present: Henry Czech, Adelbert Evans, Nick Jones, Chairman Jack Sargent, Russell Wagner and Joe Washuta. Absent: Albert Fogle, Louise Relyea, and Bob Thompson. REZONING REQUEST. Mr. Tom Dougherty has requested that lot 127, Clermont Heights be rezoned from R-2 Two Family to R-3 Residential/ Professional so that he might establish a professional office in an existing building. Planning and Zoning Clerk Marilyn George present- ed the facts about the request and the compatibility with present and proposed zoning, as well as with the Comprehensive Plan. Mr. Dough- erty had no statement to make. After a brief discussion, Mr. Czech moved that the recommendation be made to City Council that Lot 127, Clermont Heights be rezoned from R-2 to R-3. The motion was seconded by Mr. Evans and unanimously approved. REQUEST FOR CONDITIONAL USE PERMIT. Mr. Tom Dougherty had also requested that he be allowed to establish his law office at 501 Almond Street, Lot 127, Clermont Heights. The information relating to Conditional Use Permits in general and this application in partic~ ular was presented by the Planning and Zoning Clerk. There was some discussion in regard to parking, following which a motion was made by Mr. Jones to recommend to Council that the Conditional Use Permit be granted, subject to the following conditions: 1. One parking space shall be provided for each 200 square feet of office space. 2. If, at a future date, the parking at this location proves inadequate, the applicant understands and agrees that the City may require additional parking, impermeable parking, or rescind this Conditional Use Permit. 3. No further expansion of the use or additions to the building shall be permitted except as approved by an additional Conditional Use Permit. 4. All applicable rules and regulations shall be met, including final site plan approval and landscaping. 5. This property may be used only as an attorney's office. No • other business operation can be conducted from the building. This Conditional Use Permit is not transferable to any other business use, person, or corporation. 6. A final Certificate of Occupancy cannot be issued until all of the above conditions are met. 7. This permit shall expire if construction has not begun within one year of this permit. 8. If any of the above conditions is violated, the applicant understands and agrees that the City may revoke this Condi- tional Use Permit by resolution. Mr. Wagner seconded the motion and it passed by unanimous vote. CITY OF CLERMONT MINUTES PLANNING AND ZONING COMMISSION May 4, 1982 Page 2 REQUEST FOR CONDITIONAL USE PERMIT. Mr. Ken Norquist had re- quested a Conditional Use Permit for 980 West Desoto Street for the purpose of establishing a professional office in a building formerly used as a nonconforming warehouse. The Planning and Zoning Clerk re- viewed the Conditional Use guidelines and read. the list of conditions suggested by the City. Mr. Norquist explained that he would make the building an asset to the neighborhood, and the Commission members • agreed that any improvement in the appearance of the building would be welcome. It was moved by Mr. Czech and seconded by Mr. Washuta that the granting of this Conditional Use Permit be recommended to Council, with the following conditions: 1. One parking space is to be provided for every 200 square feet devoted to office use. 2. If, at a future date, parking at this location proves inadequate, the applicant understands and agrees that the City may require additional parking or rescind this Condi- tional Use Permit. 3. No further expansion of the use or additions to the build- ing shall be permitted except as approved by another Conditional Use Permit. 4. All applicable rules and regulations shall be met, includ- ing final site plan approval and landscaping. 5. This property may be used only as a contractor's office. No other business operation can be conducted from this build- ing. This Conditional Use Permit is not transferable to any other business use, person, or corporation. 6. A final Certificate of Occupancy cannot be issued until all of the above conditions have been met. 7. This permit shall expire if construction has not begun within one year of the date of this Conditional Use Permit. 8. The applicant understands and agrees that this building can no longer be used as a nonconforming warehouse, and any storage required by this office must be completely within the building and in accordance with the regulations of the R-3 zone. 9. If any of the above conditions is violated, the applicant understands and agrees that the City may revoke this Condi- tional Use Permit by resolution. • The motion passed by unanimous vote. REQUEST FOR CONDITIONAL USE PERMIT. Mr. Marcellus Buchanan and Mr. Ed Augustine requested permission to build a small office and storage facility at the northeast corner of Chestnut and Tenth Streets in Block 100. There would be some outdoor storage of recreational vehicles and boats. The Planning and Zoning Clerk read the Condition- al Use guidelines and the recommendations suggested by the City. Mr. Augustine answered questions from Commission members concerning light- ing and fences. After some discussion about the fence material and location, a motion was made by Mr. Jones that the fence be shown as being two feet inside the property lines on both street frontages, and be con- structed at an angle across the southwest corner of the lot, ten feet from the intersection of the lot lines. Mr. Evans seconded the motion and it was approved by unanimous vote. After further discussion concerning parking surfaces, Mr. Jones moved that the granting of the Conditional Use Permit be recommended to Council with the following conditions: 1. All storage must be within a completely enclosed storage building, with the exception of recreational vehicles and . boats, which may be parked in designated outdoor parking areas. No commercial machines may be stored on this site. 2. The property shall be developed in accordance with the site plan. All fencing must be properly maintained and kept in a good state of repair. 3. This permit shall expire if construction has not begun within one year of the date of this Conditional Use Permit. 4. A copy of the lease agreement for storage units must be on file with the City. Such agreement must include each con- dition marked here with an asterisk. A list of the re- mainder of these conditions shall be given to each lessee. 5. *No auctions shall be conducted on this site. 6. *The servicing or repair of motor vehicles,, boats, trailers, lawn mowers and other similar equipment shall not be con- ducted on the premises except by owner. ~, 7. *The area shall be properly policed by the owner or operator for removal of trash and debris. ~, 8. *The storage of explosive or hazardous ma'erials, as stipu- lated by the Clermont Fire Chief, is prohibited. A-sign stating "NO STORAGE OF HAZARDOUS MATERIALS: BY ORDER OF CLERMONT FIRE CHIEF" will be required. 9. *Al1 storage uses shall be operated in such a manner as to prevent emission of odors, noises, or other nuisances to abutting property owners. 10. All applicable rules and regulations must be met, including final site plan approval and landscaping. 11. No further expansion of the use or additions to the build- ing shall be permitted except as approved by another Con- ditional Use Permit. • 12. If, at a future date, permeable parking, as denoted on the plans, proves inadequate, the applicant understands and agrees that the City may require additional paved parking. 13. The fence shall be shown as being two feet inside the prop- erty lines on both street frontages, and shall be constructed at an angle across the southwest corner of the lot, ten feet from the intersection of the lot lines. The fence facing residential uses shall be of treated wood, and the remain- ing sides shall be of chain link construction. 14. If any of the above conditions is violated, the applicant understands and agrees that the City Council may revoke the Conditional Use Permit by resolution. The motion passed by unanimous vote. It was suggested by Mr. Evans that the minutes of the April 6 meeting be approved as published with the provision that the question of vested interest or ownership be cleared with Mr. Thompson.
