MINUTES
PLANNING AND ZONING COMMISSION
April 6, 1982
This meeting of the Planning and Zoning Commission was called
to order at 7:30 p.m. on Tuesday, April 6, 1982 in the City Council
Chambers by Chairman Jack Sargent, who also presented the invocation.
ROLL CALL. Present: Henry Czech, Adelbert Evans, Albert Fogle,
Louise Relyea, Jack Sargent, Bob Thompson, Russell Wagner, and Joe
Washuta. Nick Jones arrived late. Absent: None.
MINUTES of the meeting of March 2, 1982 were approved as pre-
sented.
REZONING. Mr. Tom K. Dougherty had requested the rezoning of
Lot 127, Clermont Heights from R-2 Two Family to C-1 Light Commer-
cial. The City Manager spoke for the City, explaining that rezoning
may sometimes be necessary, but stressed the importance of maintain-
ing buffers bE~tween zoning classifications. Lot 127 serves a~ the
buffer between areas presently zoned C-2 and residential uses. The
conformity of the zoning change to the Comprehensive Plan was also
discussed. A letter from Robert W. Thompson, a property owner with-
in 150 feet of Lot 127, opposing the zoning change was read.
Mr. Dougherty stated that he believes the City's stand to be
unreasonable because it is based on facts not pertinent to this
case, and that C-1 zoning would be more appropriate to the character
of the area. He stated that area residents have been given written
guarantees that nothing objectionable will be allowed on Lot 127.
After lengthy discussion, a motion was made by Mr. Evans that
rezoning from R-2 to C-1 be denied for the following reasons:
1. C-1 use would not be adequately buffered from present
residential uses.
2. Access to property either by Almond Street or Disston
Avenue is not compatible with uses permitted by C-l.
3. Uses permitted by C-1 zoning are not in consonance with
the present character of the neighborhood.
4. Use of the present structure as an office would not be
objectionable, provided adequate off-street parking is
provided, but should ownership of the property be trans-
ferred - and in time it inevitably will be - the new
owner would not be bound by other than the permitted uses
of C-1 zoning, which in the worst cases (which we are
bound to consider) would destroy the livability of the
neighborhood, encroach on the life styles of surrounding
residents, increase traffic flow beyond the capacity of
the narrow streets serving the property, and by a domino
effect, eventually adversely affect large areas to the
south and west.
The motion died for lack of a second.
After further discussion of alternatives to the rezoning re-
quest, Mr. Evans restated his motion as follows:
That the Rezoning of Lot 127 be denied for the following
reasons:
1. Access to the property either by Almond Street or Disston
Avenue is not compatible with uses permitted by C-1 zoning.
2. Uses permitted by C-1 zoning are not in consonance with
the present character of the neighborhood.
3. Use of the present structure as an office would not be
objectionable, provided adequate off-street parking is
provided, but, should ownership of the property be trans-

The motion was seconded by Mr. Washuta. During the discussion
which ensued, Mr. Thompson stated that he would abstain from voting
due to a conflict of interest, since he owns property in the area.
A roll call vote was taken with the following results: Czech;
aye, Evans; aye, Fogle; aye, Jones; aye, Relyea; aye, Sargent; aye,
Wagner; aye, Washuta; aye, Thompson; abstain.
At this point in the meeting the Chairman asked the members of
the audience to introduce themselves.
TRUCK AND TRAILER PARKING. It was recommended that Ordinance
223-C be introduced to City Council by unanimous vote.
Adjournment was at 8:50 p.m.
