A meeting of the Planning and Zoning Commission was held in the Council Chambers
on Wednesday, December 6, 1978. The meeting was called to order at 7:30 P.M.
by Chairwoman Ray with the following members present: Mrs. L. Cook, and Messrs.
Sargent, Meginley, Czech, Thompson, Jones, Sullivan, and Ogden. City officials
present were: City Manager Tiffany and Planning and Zoning Technician Caplan.
Others present were: Miss Meredith Nagel, Mrs. J. Smith, Mr. & Mrs. Ben Black-
burn, and Messrs. Searles, Grose and Wolfe.
The invocation was given by Chairwoman Ray.
The Minutes of the meeting held November 8, 1978 were approved as written.
PLANNING & ZONING SUBCOMMITTEE - REZONING PROPOSALS
City Manager Tiffany advised of a joint meeting of the Planning and Zoning
Subcommittees to discuss areas of the City that should be considered for
rezoning, and submitted the Sub-committee's report and map detailing
these areas with reasons that rezoning should be considered. He briefly
reviewed the map of 29 proposed areas for rezoning and reasons for their
rezoning. He further advised that these recommendations are the result of
considerable study related to the City's long range planning effort; That
this is the first effort at an overall comprehensive examination of the
zoning district in over ten years, and; That the recommendations made
were not based on current regulations, but are based instead on the
October 26, 1978 proposed draft of regulations for commercial and industrial
districts. A copy of this rezoning proposal report is attached hereto.
Several comments and recommendations on the proposed zoning were made by
both Commission members and audience. Following this .discussion, motion
was made by Mrs. Ray, seconded by Mr. Meginley, and carried that the
City Manager informally submit the report and map to the Council to advise
them of the work being done by the Commission. It was the consensus of
the Commission that Chairwoman Ray be present at the next regular Council
meeting to further advise of the intent of the Commission.
PLANNING COMMITTEE DRAFT REPORT - PROPOSED ZONING ORDINANCE CHANGES
Mr. Sargent presented an October 26, 1978 Planning Committee Draft Report on
proposed zoning ordinance changes in commercial and industrial district
regulations. He advised that this draft would establish a new commercial
highway classification, would redefine permitted and conditional uses in
these districts, and would clarify regulations such as lot coverage in
the Central Business District. He further advised that this report was
the basis for the several rezoning proposals which were discussed earlier
in the meeting.
Following considerable discussion on the draft report in which several
comments, recommendations, and amendments were made, motion was made by
Mr. Meginley, seconded by Mr. Jones and unanimously carried that the
October 26, 1978 Planning Committee Report of Proposed Zoning Ordinance
Changes, as amended, be submitted to the City Council for their consideration
It was the suggestion of Mr. Czech that a preface be incorporated into
the report showing the intent of the Commission.
NUISANCE COMPLAINT
Mr. Roy Grose, 777 E. Minnehaha, appeared before the Commission to advise
of conditions existing in his neighborhood (which is located behind the
Winn Dixie Shopping Center) wherein loading and unloading of trucks is
being done late at night, and profanity is being used by persons doing
the same. It was the feeling of the Commission that this was a nuisance
situation and therefore not under the responsibilities of the Commission.
Following Mr. Grose's appearance there was considerable discussion on
the possibility of alleviating these type situations by the enforcement
of CUP's which were granted to these establishments. It was the
unanimous feeling of the Commission, and so moved by Chairwoman Ray,
seconded by Mr. Jones, that a Conditional Use Permit not be granted
unless it is the intent of the Council to enforce them, and that a
condition be added to all future CUP's that a certificate of occupancy
not be issued until all conditions have been met.
PREVIOUS REPORTS AND RECOMMENDATIONS
Mr. Meginley advised of two reports which were approved by the Commission
and submitted to the City Council for their approval, which were never
formally adopted, the two being: (1) the November, 1977 Safety Committee -
SIDEWALK MASTER PLAN, and (2) the September, 1978 GREENSCAPE PLAN.

City Manager Tiffany advised that several of the recommendations recommended
in both reports had been carried out, i.e. construction of sidewalks in
various sections of the City and City entrance landscaping (which is to
appear on the 12-12-78 City Council Agenda), but that the plans had not
been formally adopted, in whole, by the City Council.
Following discussion, motion was made by Mr. Meginley, seconded by Mr.
Jones and unanimously carried that the Commission recommend to the City
Council to adopt, fund, and implement the November, 1977 SIDEWALK MASTER
PLAN. Motion was then made by Mr. Meginley, seconded by Mr. Jones and
unanimously carried that the Commission recommend to the City Council to
adopt, fund, and implement the September, 1978 GREENSCAPE PLAN.
OTHER COMMENTS
Motion was made by Mr. Czech, seconded by Mr. Sargent, and unanimously
carried that the Planning and Zoning Commission express their sincere
thanks and appreciation and extend special recognition to City Manager
Tiffany and Planning and Zoning Technician Caplan, who will soon be
leaving the City, for their time and efforts extended to the Planning and
Zoning Commission during their tenure with the City.
Motion was then made by Mrs. Ray, seconded by Mr. Jones and unanimously
carried to express sincere thanks and appreciation to Mr. Ben Blackburn,
vacating Commission member, for all his time and efforts while service
on the commission and various specialized committees.
