MINUTES
PLANNING AND ZONING COMMISSION
April 3, 1984
This meeting of the Planning and Zoning Commission was called to order
at 7:30 p.m. on Tuesday, April 3, 1984 in the City Council Chambers.
Commission members in attendance were: Henry Czech, Adelbert Evans,
Jack Sargent, James Shepherd and Nick Jones. Debbie Gaines arrived at
8:30. Absent: Marie McKinney, Pat Parker and Bob Thompson.
MINUTES of the meeting held March 6, 1984 were approved as presented.
• CONDITIONAL USE PERMIT. Mr. Sargent explained that Mr. Andrew Morris
had requested a Conditional Use Permit (CUP) to enclose a screened
porch recently added to his nonconforming duplex residence in the R-1-A
Single Family Residential zone at 610 West Lakeshore Drive.
The City Manager reported that Mr. Morris had been granted a CUP in
April of 1983 for the addition of a screened porch, a storage room
and a carport. At this time he is asking to enclose the screened
porch granted by that CUP. A letter from Merle Bright, a neighboring
property owner, was read in suuport of the request.
Mr. Trent Lane, the tenant in Mr. Morris' house, spoke on behalf of
Mr. Morris stating that wind off the lake blows rain into the porch
and that installing windows would improve the situation.
Discussion concerned the fact that the other CUP had been obtained
after work was begun and that expansion of nonconforming uses should
not be encouraged. Mr. Morris has also stated that he intends to convert
the dwelling to single-family use in the future.
A motion was made by Mr. Shepherd, seconded by Mr. Jones, and defeated
by a three to two vote to recommend approval of this request. The vote
was as follows: Aye; Czech and Shepherd, and Nay; Evans, Jones and
Sargent.
Mr. Evans asked if another motion was in order to deny the request,
and the consensus was that such a motion was unnecessary.
CONDITIONAL USE PERMIT. Mr. Sargent explained that Mr. William Favuzza
of Extra-Tech Properties had returned with a new site plan showing 34
townhouse units to be built on Blocks 19 and 20 at the eastern end of
Crystal Lake.
The City Manager read the list of items the Planning and Zoning Com-
mission had recommended at the October meeting for the developer to
consider in revising the site plan. (See minutes of meeting held
October 4, 1983.) A letter from the City Engineer was read. In this
letter it was stated that the topography of this site should be care-
fully considered in establishing roadway and drainage patterns.
Mr. Favuzza and Mr. Zahradnik (his architect) urged the Commission to
• make a decision in the matter. Mr. Zahradnik stated that all engineer-
ing requirements of all governmental entities would be met. He also
indicated that the project may be built in phases. He was told that
the infrastructure for the entire project would probably be required
initially. Mr. Zahradnik then protested the City's recommendation for
the entrance location.
A discussion followed, prompted by questions from concerned citizens,
regarding landscaping, price of the proposed units, lot coverage and
the use of motorized boats on the lake. Citizens who spoke were:

Case and Claude Smoak.
Further discussion among Commission members concerned environmental
considerations, the recommendation by the City Engineer that roadways
follow contour lines wherever possible, and onsite retention of storm
water, as well as ingress and egress routes.
A motion was made by Mr. Jones, seconded by Mr. Shepherd and approved
by a roll call vote of four to two THAT IT BE RECOMMENDED TO CITY COUNCIL
• TO APPROVE THE REQUEST FOR A CONDITIONAL USE PERMIT FOR EXTRA-TECH
PROPERTIES SUBJECT TO THE CONDITIONS WHICH FOLLOW. Voting was as
follows: Aye; Gaines, Shepherd, Jones and Czech. Nay; Evans and
Sargent.
Conditions:
1. The property must be developed in substantial accordance with an
approved site plan.
2. If, at a future date, parking at this site proves inadequate,
the applicant understands and agrees that the City may require
more parking or rescind this CUP.
3. No further expansion of the use or additions to this facility
shall be permitted except as approved by another CUP.
4. All applicable rules and regulations shall be met, including
final site plan approval, landscaping, drainage, parking, and
sign regulations. All required landscape buffers must be served
with an underground sprinkling system and be properly maintained.
Fire hydrants must be installed as recommended by the Fire Chief
and a buffer strip of fifty (50) feet must be maintained between
the northernmost unit and the north property line.
5. This property may be used only for thirty (30) residential
townhouse units.
6. The applicant is responsible for installing, at his expense, a
six (6) inch water line from Broome Street to Desoto Street to
serve this development. The applicant is also responsible for
connecting to the City's sewer system in a manner approved by
the City Engineer, at the owner's expense.
7. Broome Street must be constructed at the owner's expense. Ingress
and egress will be allowed from Broome Street only, or Second
Street south of Broome Street. A "No Left Turn" sign must be
placed at the exit from the project.
8. The lowest floor elevation of all buildings must be at 101.5 feet
to comply with the City's flood regulations, and required rear
• yards must begin twenty-five (25) feet from the ordinary high
water mark of 97.5 feet.

10. A fifteen (15) foot easement must be given to the City for the
existing storm sewer line near the north property line.
11. The buildings and drives should be situated to avoid headlight
glare or any other nuisance to abutting property owners.
12. The City Engineer must approve all drainage and retention areas,
which must also meet the requirements of the Lake County Pollution
Control Board and FAC 17-25.

13. Principal driveways will be required to run parallel to the con-
tours of the land.
14. The northerly units on the beach side shall be brought parallel
to the contour lines as much as possible.
15. The dock shall be restricted to a total length of thirty-five (35)
feet, and a width of six (6) feet.
1.6. No Certificates of Occupancy can be issued until each of the
stated conditions has been met, including completion of all
driveway, parking and drainage requirements.
17. This permit shall expire if construction has not begun within
one year of the date of this Conditional Use Permit.
18. If any of the stated conditions is violated, the applicant under-
stands and agrees that the City Council may revoke this CUP by
resolution.
