MINUTES
PLANNING AND ZONING COMMISSION
October 4, 1983
This meeting of the Planning and Zoning Commission was called to order
at 7:30 p.m. on October 4, 1983 in the City Council Chambers by Chair-
man Jack Sargent.
ROLL CALL. Present: Adelbert Evans, Jack Sargent, Debbie Gaines,
Nick Jones and Bob Thompson. Excused: Pat Parker, Albert Fogle and
Henry Czech. Also present were City Manager George Forbes and Planning
and Zoning Technician Marilyn George.
MINUTES of the meeting held September 6,1983 were approved as presented.
CONDITIONAL USE PERMIT. Mr. and Mrs. Ray Mecanick's request to estab-
lish a professional office in an R-3 Residential/Professional zone was
presented by the City Manager. He explained that a similar request
had been granted about two years ago for a contractor's office at the
same location. The present request is to allow a sign contractor's
office and a professional art office in the building at 980 West Desoto
Street.
A brief discussion followed, in which it was determined that there is
adequate space for parking at the site.
A motion was made by Adelbert Evans, seconded by Bob Thompson and
unanimously carried THAT THE CONDITIONAL USE PERMIT TO ALLOW THE ESTAB-
LISHMENT OF A PROFESSIONAL OFFICE IN AN R-3 RESIDENTIAL/PROFESSIONAL
ZONE AT 980 WEST DESOTO STREET BE GRANTED, PENDING COUNCIL APPROVAL,
SUBJECT TO THE FOLLOWING CONDITIONS:
1. The property must be developed in substantial accordance with the
approved site plan.
2. If, at a future date, parking at this site proves inadequate,
the applicant understands and agrees that the City may require
more parking or rescind this Conditional Use Permit.
3. No further expansion of the use or additions to this facility
shall be permitted except as approved by another Conditional Use
Permit.
4. All applicable rules and regulations shall be met, including
final site plan approval, landscaping, parking and sign regulations.
5. This property may be used only as offices for Sign and Designs
Construction and for professional art offices. No other business
operation may be conducted from this facility. This Conditional
Use Permit is not transferable to any other business use, person,
or corporation.
6. The final Certificate of Occupancy cannot be issued until each
of the stated conditions has been met.
7. This permit shall expire if construction has not begun within
one year of the date of this Conditional Use Permit.
8. If any of the stated conditions is violated, the applicant un
stands and agrees that the City Council may revoke this Condi
Use Permit by resolution.
9. The applicant understands and agrees that the building can no
longer be used as a nonconforming warehouse, and any storage
required by the office must be completely within the building
and in accordance with the regulations of the R-3 zone.

CONDITIONAL USE PERMIT. Mr. Forbes presented a request by Todd
Dittrich to engage in light fabrication and construction of custom
cabinets and interior refurbishing materials for vans and recrea-
tional vehicles in the building at 770 West Montrose Street. He
explained that manufacturing is a Conditional Use in the C-2/CBD
zone, provided that the manufacturing is in conjunction with retail
sales and/or service. The City staff's concern that buses and recre-
ational vehicles might be parked on City streets and parking lots
was expressed.
A letter from Hanks Electric was read in opposition to the request.
Joe G. Washuta spoke, stating that a clean operation would be welcome,
but that monitoring of the situation would be desirable. Laura Cook
compared the proposed operation with others already established in
the area.
A discussion followed, during which Todd stated that he would be
amenable to observing a limit in the number of buses, or submitting
to a review of the project in a stated period of time. A motion was
made by Nick Jones, seconded by Debbie Gaines and unanimously car-
ried THAT IT BE RECOMMENDED TO CITY COUNCIL THAT THE CONDITIONAL USE
PERMIT TO ALLOW LIGHT MANUFACTURING IN THE C-2/CBD ZONE AT 770 WEST
MONTROSE STREET BE GRANTED, SUBJECT TO THE FOLLOWING CONDITIONS:
1. The property must be developed in substantial accordance with the

2. Parking of not more than two vehicles to be customized may be
visible on the applicant's property, and those not in the City
street or parking lot. If, at a future date, parking at this site
proves inadequate, the applicant understands and agrees that the
City may require more parking or rescind this Conditional Use
Permit.
3. No further expansion of the use or additions to this facility
shall be permitted except as approved by another Conditional Use
Permit.
4. All applicable rules and regulations shall be met, including
final site plan approval, landscaping, drainage, parking and
sign regulations.
5. This property may be used only for retail sales and the manufac-
turing and installation of custom cabinets and interior refurbish-
ing materials. No other business operation may be conducted from
this facility. This Conditional Use Permit is not transferable to
any other business use, person, or corporation. The business must
not employ more than five persons, and must be complementary to
and in conjunction with an on-site retail business or service.

9. A time limit of one year is to be placed on the Conditional Use
Permit, within which time the applicant must apply for renewal.
CONDITIONAL USE PERMIT. Jack Sargent described the request by William
Favuzza for Extra-Tech Properties, Inc. to allow construction of 42
townhouses on 4.37 acres at the eastern end of Crystal Lake on Blocks
19 and 20. It was explained that there had been a similar project
proposed in 1974, but it was never built. Later the area was consid-
ered for rezoning, but the owner protested so the R-3 Residential/
Professional classification remained.
Bob Farner, engineer for the project, explained that a proposed system
of swales and baffles would handle drainage on the site. Mr. Favuzza
described plans for driveways and a centrally located recreation complex.
A letter from Mr. and Mrs Richard Harris in opposition to the project
was read, and Sallie Benson, representing Sadie Tillis, also spoke in
opposition to the proposal. Claude Smoak, the owner of the property
north of the site in question, spoke at length of the high water he
has observed in the years he has lived there, and the fact that one
of the directions of slope is toward his property. He urged that
developers respect the integrity of the land.
Others who spoke in opposition to the proposed project were Lucille
Gross, Sherry Giachetti, Becky Pike, Dorothy Case and Louise Feuchter.
Their concerns were with traffic problems and drainage.
There was intensive discussion in regard to flooding, density, traffic
problems and drainage requirements. Mr. Favuzza expressed a desire
to correct the problems under discussion and to be a good neighbor to
the residents of the area. Adelbert Evans listed four items to be
treated by the developer:
1. The holding ponds should be above the 100 foot level, with
the 25 foot setback to begin there.
2. The slope on this site is from 11.59% to 16$. The Comprehen-
sive plan discourages intensive development in flood prone
areas and areas of extreme slope. High density development
in lake areas is environmentally hazardous.
3. The plans should be revised to remove the buildings from the
flood prone areas. The density and the impact on the environ-
ment may have to be lessened.
4. The entrance from Second Street should be deleted, and the
Broome Street entrance should be used for both ingress and
egress.
He suggested that the applicant submit a revised plan based on the
above recommendations.
Jack Sargent recommended that the developers furnish drawings detailing
appearance of the project, water retention plans (including handling of
run-off during construction), and a better traffic pattern. He stated
that the Commisssion had three options in acting on this request: to
table the request, to modify the staff suggestions and recommend approval,
to deny the request.

A motion was made by Adelbert Evans, seconded by Bob Thompson and
unanimously approved THAT THE REQUEST FOR A CONDITIONAL USE PERMIT
FOR 42 TOWNHOUSES ON BLOCKS 19 AND 20 BE TABLED TO THE NEXT REGULAR
MEETING OF THE PLANNING AND ZONING COMMISSION OR UNTIL THE APPLICANT
IS READY TO PRESENT UPDATED PLANS.
Claude Smoak stated, for the record, that he had made no contact with
Commission members before the meeting, and that he had made an offer
to Mr. Favuzza to work with him. He is acting only as an interested
property owner.
There being no further business, the meeting was adjourned at 9:25 p.m.
