MINUTES
August 2, 1983
This regular meeting of the Planning and Zoning Commission of
the City of Clermont was opened at 7:30 p.m. on August 2, 1983
with the offering of an invocation by Chairman Jack Sargent.
ROLL CALL. Present; Henry Czech, Adelbert Evans, Pat Parker,
Jack Sargent, and Albert Fogle. Absent; Aurelia Cole, Debbie
Gaines, Nick Jones, and Bob Thompson.
MINUTES of the meeting held July 5, 1983 were approved as pre-
sented.
CONDITIONAL USE PERMIT. The First Baptist Church request to use
the grassy areas of the property at 450 West Montrose for park
ing and the house on the property for classrooms, tabled at the
July meeting, was reviewed by the Chairman. Mr. Ken Martin,
representing the church, explained that the house was to be
used to house part of their youth department, and that it would
be brought up to code before it was used. He also explained
that a shed on the property will be demolished. In the future
the house may be moved to another location, perhaps in a year
or two.
Discussion concerned the upgrading of the house to meet all codes,
and location of the driveway. Mr. Martin stated that much of
the labor for the project will be donated.
A motion was made by Mr. Evans, seconded by Mrs. Parlcer, and
approved by unanimous vote THAT IT BE RECOMMENDED TO CITY COUNCIL
THAT THE CONDITIONAL USE PERMIT BE GRANTED FOR LOTS 12 AND THE
WEST i OF 10, BLOCK 49 TO ALLOW GRASS PARKING AND THE USE OF THE
HOUSE FOR CLASSROOMS ON THE CONDITION THAT THE HOUSE BE BROUGHT
UP TO MEET CODES, AND SUBJECT TO THE FOLLOWING CONDITIONS:
1. The property must be developed in accordance with the
approved site plan.
2. Grass parking is acceptable as long as parking spaces
are delineated and a driveway paved with asphalt or
concrete is provided.
3. No further expansion of the use or additions to this
facility shall be permitted except as approved by
another Conditional Use Permit.
4. All applicable rules and regulations shall be met, in-
cluding final site plan approval, landscaping, parking,
and sign regulations.
5. This property may be used only for parking and class-
rooms. No other business operation may be conducted
from this facility. This Conditional Use Permit is not
transferable to any other business use, person, or
corporation.
6. The final Certificate of Occupancy cannot be issued
until each of the stated conditions has been met.
7. This permit shall expire if construction has not begun
within one year of the date of this Conditional Use
Permit.
8. If any of the stated conditions is violated, the appli-
cant understands and agrees that the City Council may
revoke this Conditional Use Permit by resolution.
CONDITIONAL USE PERMIT. Beth and Richard Barton had requested
a Conditional Use Permit to allow operation of a custom cabinet-
making/woodworking shop at 770 West Montrose Street. The Zoning
Ordinance states that manufacturing is a conditional use in the
CBD/C-2 zone.

Mr. Vincent Fechtel, former owner of the building, spoke in favor
of the proposed operation at this location.
Richard Barton described alterations he plans to make to the build-
ing, and the method and hours of operation of the business. In
answer to questions, he stated that machinery would be used only
between 8:00 a.m. and 6:00 p.m. and then only intermittently. He
described how noise will be buffered, and said that deliveries
would be made in the rear, but that little material will be kept
in inventory.
After further discussion, during which the Conditional Use Permit
issued to a pillow factory for the same site in the past was men-
tioned, a motion was made by Mr. Fogle, seconded by Mr. Czech
and carried by unanimous vote TO RECOMMEND TO CITY COUNCIL THAT
THE CONDITIONAL USE PERMIT TO ALLOW THE OPERATION OF A CUSTOM
CABINETMAKING/WOODWORKING SHOP AT 770 WEST MONTROSE STREET BE
GRANTED, SUBJECT TO THE FOLLOWING CONDITIONS:
1. No future expansion of the use or additions to this
facility shall be permitted except as approved by
another Conditional Use Permit.
2. All applicable rules and regulations shall be met, includ-
ing sign regulations.
3. This property may be used only for retail sales and the
manufacture of custom woodworking products. No other
business operation may be conducted from this facility.
This Conditional Use Permit is not transferable to any
other business use, person, or corporation.
4. The final Certificate of Occupancy cannot be issued
until each of the stated conditions has been met.
5. This permit shall expire if construction has not begun
within one year of the date of this Conditional Use
Permit.
6. If any of the stated conditions is violated, the appli-
cant understands and agrees that the City Council may
revoke this Conditional Use Permit by resolution.
7. No undesirable odors or loud noise shall be detectable
outside the building. Any such odors or noise creating
a nuisance to property owners in the area shall consti-
tute prima facie evidence that this condition has been
violated.
8. The loading and unloading of manufacturing materials
shall be confined to the rear of the building.
9. All storage and manufacturing operations shall be held
within a completely enclosed building.
Mr. Evans stated that he will delay his report on drainage.
Mr. Joseph Washuta suggested that the Commission keep abreast of
action regarding mobile homes in residential areas taking place
in Orange County because it may have an impact locally.
