MINUTES
January 4, 1983
This meeting of the Planning and Zoning Commission was called
to order by Chairman John Sargent at 7:30 p.m., January 4, 1983 in
the City Council Chambers. Bob Thompson offered the Invocation.
ROLL CALL: Present; Henry Czech, Adelbert Evans, Nick Jones,
Jack Sargent, Bob Thompson, Russell TnTagner, and Joe Washuta.
Absent; Albert Fogle.
MINUTES of the meeting held December 7, 1982 were approved as
presented.
NEW BUSINESS: City PZanager Forbes presented Bob Wade's re-
quest for rezoning of property at
Highway and Highway 50 from R-1-A the northeast corner
Single Family to C-2 of Grand
General
• Commercial. The annexation of the parcel in question is to be
determined by City Council. Newly annexed property is always
zoned R-1-A, and since this parcel may be occupied by Ouincy's
Restaurant, rezoning to C-2 is nec essary.
Attorney Dennis Horton, representing Bob Wade and Spartan
Foods (Quincy's) introduced Mr. Wade, Surveyor Ben Blackburn, and
Engineer Jim Adams.
Mrs. Wilma. Nystrom and Michael Rodriguez, whose property is
across Grand Highway from the proposed Quincy's, expressed con-
cern that there may be problems with traffic because of the drive-
way from the restaurant parking lots and for aesthetic reasons.
A discussion followed, in which it was pointed out that the
drawings on view are merely preliminary drawings, and that there
will be many meetings between City staff and the developers, as
well as the hearing before City Council, where every effort will
be made to satisfy all parties affected and make the situation
as safe as possible.
A further discussion ensued, regarding the frontage road
shown on the plans. It was explained that this road, on private
property, will be extended to the east as the area is developed.
The State Department of Transportation has been petitioned by
P~4r. Wade to make another cut in the median of Highway 50, but he
felt that approval would not be forthcoming.
D4r. Jones suggested that the frontage road also be extended,
to be shown by dotted lines on the drawing, to Grand Highway on
the west. Mr. Adams stated that such a road, opening onto Grand
Highway so close to the intersection, would be a safety hazard.
Mr. Sargent suggested that, in addition to the eleven con-
ditions recommended by the City staff (see below), these changes
and additions be made:
1. In item 10 strike the phrase following the words "Ordin-
ance 148-I~1. "
2. Ask the City Engineer to look into the traffic situation
on Grand Highway and determine the necessity of reserving 'land for
the expansion of Grand Highway to the east, to allow for a decel-
leration lane.
3. Recommend to City Council that sign placement and con-
figuration be shown on the plans.
After further discussion about the possibility of having
another cut through the median on Highway 50, DZr. Jones made the
following motion, seconded by P~~.r. Washuta:
IF THE PROPERTY IN QUESTION IS ANNEXED TO THE CITY, THE RECOP2-
MENDATION BE MADE TO CITY COUNCIL THAT THE ZONING BE CHANGED TO
C-2 GENERAL COMMERCIAL SUBJECT TO THE FOLLOWING CONDITIONS:
1. The property is to be used only in conformance with the
plans submitted by the owner.
2. The owner agrees that no additional parcels of land he
owns in this area will be annexed to the City until an

overall development plan is prepared and the :Clermont
waste treatment plant is upgraded to accept the impact of
any additional development. This annexation shall not be
construed as a precedent for annexing the remainder of
the property owned by Mr. Wade.
3. The owner agrees that no additional parcels will be annexed
unless the entire parcel to be annexed (including the prop-
erty annexed by Ordinance 148-M) is subdivided.
4. The owner agrees to install, at his expense, a frontage
road running parallel to Highway 50 from Grand Highway
to the east end of the property annexed by Ordinance 148-M.
This frontage road is designed for safety and to protect
the carrying capacity of Highway 50. It will be owned and
maintained by the abutting property owners. The frontage
road will be extended as property is developed to the east.
5. The owner agrees to install immediately, at his expense,
an eight (8) inch water main to the eastern boundary of the
property annexed by Ordinance 148-M. This line will then
be continued as property to the east is developed. The
City will be granted a fifteen (15) foot .easement over the
water line and fire hydrant.
6. The owner will, at his expense, immediately install a
Mueller fire hydrant at the east end of the annexed property.
7. The owner will be allowed to construct a service line from
the annexed property to the sanitary sewer in Grand Highway
to serve only the property annexed by Ordinance 148-M. The
installation of this sewer line will be under the direction
of the City Utilities Director.
8. The owner further agrees to construct a sanitary sewer main
at his expense past the annexed property once it becomes
necessary to service the remaining parcels east of the
property annexed by Ordinance 148-M.
9. A buffer strip will be planted the full length of the west-
ern property line along Grand Highway. The plantings in
this buffer strip must reach a height of six (6) feet with-
in three years. It is designed to act as a buffer between
the proposed Quincy's Restaurant and the residential prop-
erties across the street. The plantings in the south 150
feet of this buffer need reach a height of only three (3)
feet. This is the portion facing the commercial property
across Grand Highway. All buffer landscaping and other
landscaping required by the City Landscape Ordinance will
be serviced by an underground sprinkling system.
10. The owner agrees to provide a buffer fence six (6) feet in
height (shadow box or picket) along the north property
line of the property annexed by Ordinance 148-M.
11. All applicable rules and regulations shall be met, in-
cluding final site plan approval, landscaping, parking,
on-site drainage retention, and sign regulations.
12. The Grand Highway entrance shall be moved south to ease
problems for residences across the street.
13. There shall be a fifty (50) foot easement line across the
entire length of the Highway 50 frontage.
14. The position of the sign shall be shown on the site plan.
15. The City Engineer shall be asked to investigate the feas-
ibility of widening Grand Highway in the future.
