A meeting of the Planning and Zoning Commission was held in the
Council Chambers on Tuesday, October 4, 1977. The meeting was called
to order at 7:30 P.~1, by Chairwoman Ray with the following members
present: Messrs. Czech, Jones, Thompson, Sargent, Ogden, Meginley,
and Sullivan. City Officials present were: City P~anager Tiffany and
City Attorney Baird. Others present were Mrs. J. Smith and ~~1r. Boone.
The Invocation was given by Chairwoman Ray.
Chairwoman Ray requested a change in the proposed Minutes of the
meeting held September 6, with regards Conditional Use permit fees:
Reduce the application fees from $50 to $500 to $10 to $100. The
Minutes of the meeting held September 6 were then approved.
SPECIAL EXCEPTION APPLICATION
City f~anager Tiffany presented a building permit application for
a carport to be constructed at 528 Chestnut Street. The non-
conforming residence is located in a C1 zone and would be expanded
by this carport. Due to recent zoning code amendments, special
exceptions could be granted by the City Council after P&Z approval
for the reconstruction, enlargement or expansion of non-conforming
residences as long as these improvements were determined not to be
detrimental or obnoxious to the district and when such denial woul~
create a hardship on the owner of the non-conforming residential
use. City Manager Tiffany said that since this was the first
such application under this new amendment, the P&Z should con-
sider administrative procedures for special exception applications
to set a precedent for future cases.
Following discussion regarding the proposed construction and
inquiry as to the necessity of notifying adjacent property owners
of an application for a special exception, motion was made by
Mr. Czech, seconded by Mr. Jones, and unanimously carried that
the Commission recommend to the City Council that the special
exception for the construction of a carport at 528 Chestnut
Street be granted, noting that in this case, adjacent property
owners were not notified of the application. It was the consensus
that in some cases it will be desirable to notify adjacent
property owners and to publish notice. In many cases (such as
this one) the expansion is slight and will not harm the district,
so notice and publication were not necessary.
PLANNING COMMITTEE REPORT
Mr. Sargent reported that the Planning Committee was continuing
its study on the draft report of permitted and conditional uses
in Cl, C2, Ml, and M2 zones as prepared by his committee and
presented at the September P&Z meeting.
Following discussion, it was the consensus of the Commission to
delay further action on the proposed uses until after public
meeting on the Land Use Element of the City's Comprehensive Plan,
at which time a Public Hearing will be held to receive public
comment on these proposed uses.
COMMUNITY APPEARANCE STANDARDS COMMITTEE
Mr. P1eignley presented a ststus report on the objectives and
action taken by his committee. A copy is attached hereto. He
further advised that due to the complexity and broad range of
subjects that are included in his committee study, more meetings
would be required, and called for a meeting of the committee
for Thursday, October 13 at 3:00 P.P1. in the City Manager's office.
RIPARIAN STRUCTURES
City Manager Tiffany presented a proposed ordinance for the
regulations on riparian structures as recommended by the P&Z
Commission last month.
following discussion. motion was made by f~lr. Meginley, seconded
by Mr. Jones,, and carried that the proposed ordinance be
submitted to Council for their adoption after the following
wroding changes: (1) D-Deck elevation shall be at least one foot
above the established maximum desirable or operating level of the
water, except for floating structures, and (2) F-All state and
county regulations are met.
Mr. Czech voted Naye on the motion stating that the reason for
his vote was a disagreement over the wording of the ordinance,
but that he supported the the proposed regulations.
CONDITIONAL USE PERMIT PROCEDURES
City Manager Tiffany presented a proposed ordinance amending
Section 26-87 of our code to reduce the minimum filing fee for
conditional use permits from $50 to $10 and simplifying publi-
cation and meeting schedule requirements. He further advised
that he recommended these changes, except deleting the fee of
$10 for a home occupation CUP since it is no longer required.
The Commission was in agreement and motion was made by Mr. Jones,
seconded by Mr. Sargent, and unanimously carried that the pro-
posed ordinance be submitted to Council for their consideration,
after deleting the $10 fee for a home occupation CUP.
DRIVEWAYS
City Manager Tiffany presented excerpts from our code with
regards the definition of a driveway and required off-street
parking space. The Commission was in agreement that the defi-
nition of an off-street parking space includes a driveway.
Following discussion in which Mr. Jones inquired as to the
possibility of amending the code to allow the construction of
a driveway into required sideyard setbacks, it was consensus that
further study time was needed with regards the arrangement of
parking spaces to allow access to the right-of-way.
SIDEWALKS
h1r. Meginley reported that he had appeared before the City
Council (as a private citizen) to request a study of sidewalk
needs as related to school traffic patterns. The Council has
requested a P&Z study of this subject. Chairwoman Ray requested
that the Safety Committee review this subject, noting that
consideration be given to possible changes in pedestrian traffic
patterns as a result of SR50 improvements. Mr. Meginley agreed
to serve as a resource person to the Committee.
OTHER BUSIPJESS
Mr. Jones advised he would like to see newspaper reports of
P&Z action in order to receive citizen discussion and involvement.
City Manager Tiffany advised that he will be unable to attend
the November 1 meeting of the Commission due to a conference
in Atlanta, but he would have a representative present.
