A meeting of the Planning & Zoning ,Commission was held in the
Council Chambers on Tuesday, September 6, 1977. The meeting was
called to order at 7:30 P.M. by Chairwoman Ray with the following
members present: Mrs. L. Cook, and Messrs. Jones, Meginley, Thompson,
Sargent, and Sullivan. City officials present were: City Manager
Tiffany and City Attorney Baird. Others present were Miss Denise
• Blanchard, Mrs. J. Smith, and Mr. P. Searles.
The Invocation was given by Chairwoman Ray.
The Minutes of the July 13, 1977 meeting were approved as written.
Chairwoman Ray extended a welcome to Mr. Robert Thompson, newly
appointed member of the Planning & Zoning Commission. Mr. Thompson,
appointed by the City Council to fill the vacancy created by the
extended absence of Kenneth Norquist, was appointed to the following
sub-committees: Safety and Subdivision.
PLANNING COMMITTEE REPORT
Planning Subcommittee Chairman Jack Sargent submitted a draft
report of permitted and conditional uses in Cl, C2, M1, and M2
zones, as prepared by his committee. h1embers of the Planning
Committee reported that this draft would loosen the existing
ordinance, make it more general and comprehensive, and establish
a workable ordinance for the City and its citizens.
Upon recommendation of Chairwoman Ray, it was consensus of the
Committion to delay further action on the report until the
October 4th meeting, to insure study time by all Commission
members.
RIPARIAN STRUCTURES
City Manager Tiffany reported on a letter received from Bill
Hennessey, Lake County Pollution Control Director, which
commented on the proposed regulations for riparian structures.
Following discussion, motion was made by Mrs. Cook, seconded
by Mr. Meginley, and unanimously carried that the City Attorney
prepare an ordinance for regulations on riparian structures,
amending the proposed regulations to conform to recent State
Supreme Court rulings on measuring lake water level, and to
recommend the proposed ordinance to the City Council for their
consideration and for adoption.
CONDITIONAL USE PERMIT PROCEDURES
City Manager Tiffany recommended that Section 26-87 of our code
(Which sets up the requirements for granting conditional use
permits) be amended to reduce the minimum time required for the
granting of such permits, and to reduce the existing $50 to $500
application fee..
Following discussion, motion was made by Mr. Jones, seconded by
Mr. Thompson and unanimously carried that the City Attorney
prepare an ordinance amending Section 26-67 concerning conditional
use permits to incorporate the following changes: (1) Reduce
the minimum time for application to be received to 10 days before
P & Z consideration, but enable the Planning and Zoning Commis-
sion to hold special meetings to consider extraordinany CUP
requests, (2) Reduce the application fees from $50 to $500 to
$10 to $100, and (3) combine notices of Public Hearing of the
planning and Zoning Commission and City Council. The draft
ordinance will be submitted to the Commission at the October 4th
meeting for further consideration.
DRIVEWAYS
City Manager Tiffany reported on a 1973 opinion from former
City Attorney Robert Vason, which indicated that, although
• on-site parking is generally required by our City code, drive-
ways are not specifically covered by the code.
Following discussion regarding traffic and safety hazards caused
by on-street parking, and establishment for use of private
property for parking, Chairwoman Ray requested City P1anager
Tiffany to suggest possible amendments, and submit to the
Commission at the October 4th meeting for further consideration.
OTHER BUSINESS
City Manager Tiffany reported that the changes in the preliminary
plat of Lakeview Hills Subdivision as recommended by the Planning
and Zoning Commission have been met for this phase of development;
That Council. has recently adopted the zoning changes for that
subdivision; and That the Improvement Phase of development was
underway.
City Manager Tiffany invited Commission members to two meetings
particular interest this month: (1) Comprehensive Planning
Committee, 3:00 P.M., Thursday, September 8th in his office to
discuss land use, population, and community facilities survey;
and (2) East Central Florida Regional Planning Commission staff
presentation on regional land use planning, to be at the regular
City Council meeting, September 27th.
