A meeting of the Planning and Zoning Commission was held in the
Council Chambers on Tuesday, June 7, 1977. The meeting was called
to order at 7:30 P.M. by Chairwoman Ray with the following members
present: Mrs. Laura Cook and Messrs. Czech, Meginley, Sargent,
Jones, Ogden and Sullivan. City Officials present were City P~1anager
Tiffany, City Attorney Baird and Director of Community Development
Nagel. Others present were Mr. and Mrs. Dennis Cannon, Mrs. Meginley,
and Messrs. Cook and Searles.
The Invocation was given by Chairwoman Ray.
The Minutes of the May 3, 1977 meeting were approved as written.
PUBLIC HEARING - CONDITIONAL USE PERMIT FOR THOMAS F. MCCOY
Mr. Dennis Cannon appeared before Commission in support of the
request of Mr. Thomas McCoy, his manager, fora Conditional
Use Permit to provide secondary living quarters in conjunction
with an Insurance Company business at 635 Highway 50, for the
security of office quarters.
Discussion followed as to how many residents would occupy the
building, how many employees would be working in the building,
and comments on letters written to adjacent property owners
concerning this request. Mr. Cannon advised there would be two
residents (Mrs. Cannon and himself) and one employee (Mrs. Cannon).
The City Manager advised that he had received no objections from
adjacent property owners regarding this request.
In discussion, the Commission found that the proposed use is
desirable at this particular location; that such use will not be
detrimental to the health, safety or general welfare of persons
residents or working in the vicinity; that the proposed use will
comply with the regulations and conditions specified in the codes
for such use; and that the granting of the conditional use will
not adversely affect the officially adopted Comprehensive Plan
of the City.
Following the discussion, motion was made by Mr. Czech, and
seconded by Mr. Sullivan that the request be recommended to
Council for their approval.
After a brief discussion concerning requirements for the
Conditional Use Permit with regards off-street parking, the
Commissioners unanimously passed the motion.
SUBDIVISION COMMITTEE
Mr. Czech reported that the May 31, 1977 meeting of the
Subdivision Committee was constructive and informative. Several
problems in the present ordinance were identified and solutions
proposed. Amoung these problems were (1) creation of non-
conforming lots, (2) definition of "Subdivision", and (3) appeal
procedures to the governmental authority. Mr. Czech further
advised that he believed the ordinance could be modified to suit
the city's need, but that more meetings will be required.
PLANNING COMMITTEE
Mr. Sargent reported that the Planning Committee began their
study of permitted and conditional uses at their meeting on
June 2, 1977 and that more meetings will be required.
COP1MUNITY APPEARANCE STANDARDS COMMITTEE
Mr. Peginley reported that the Community Appearance Standards
Committee had met May 6, 1977 to continue their study. He
advised that the Committee had reviewed the site plans of several
buildings to compare the site plans on paper vs. the actual
structure.
• Mr. Meginley further reported that his Committee was attempting
to draft an appearance guide for new Commercial and multi-family
buildings with a target date set for the September meeting.
SECTION 26-10 REVISION
City Manager Tiffany offered a brief review ofaproposed Ordinance
revising 26-10 of the Code of Ordinances, advising he believed this
was a good ordinance and recommended approval for Council action.
City Attorney Baird discussed the legal aspects of granting
special exceptions for non-conforming residences. He advised that
through the language of this ordinance, it will allow the City
Council and the Planning and Zoning Commission action on the
merits of each request. Following discussion, motion was made by
h1rs. Cook, seconded by Mr. Meginley and carried that the ordinance
be recommended to the City Council for adoption.

Due to recent variance requests, the City Council has again asked
the Planning and Zoning Commission to consider the definition of
"Structure", with regards to setbacks, yards, lot coverage and
"Building".
Chairwoman Ray advised that she believes the ordinance reads
correctly, with City Attorney Baird reporting no problems in the
existing ordinance if it is related to other ordinances. Discussion
followed with regards driveways being a "Structure" in which
Mr. Jones stated that he is frequently faced with the problem of
crossing the setback with a driveway, especially in Commercial
Zones, and that a variance need not be required to do same, and
recommended further study.
Chairwoman Ray requested the Planning Committee, in their next
meeting to discuss the subject of driveways and setbacks in
commercial zones.
RIPARIAN STRUCTURES
City Manager Tiffany advised that due to a recent transfer of the
Clermont area from the Southwest Florida Water Management District
to the St. Johns Water Management District, the City should adopt
standards for location, regulation of size and elevation of such
structures, to be enforced for the protection of adjacent property
owners and to protect our Lakeshore from too many, too large
• riparian structures (boathouses, docks, etc.). The St. Johns
Water Management District has no specific regulations regarding
this matter. City Attorney Baird stated he was in agreement with
this, in that now the City has no control over length, bulk or
size. City P~lanager Tiffany agreed to draft proposed standards
for Commission consideration.
PRELIMINARY PLAT - LAKEVIEW HILLS

City Manager Tiffany advised that the preliminary
Swann Subdivision located South of the Minnehaha
Subdivision, and to be named Lakeview Hills, was
office Friday, June 3, and that a public hearing
requested for the July meeting of the Commission.
