05-03-1977 Regular MeetingPLANNING AfJD ZOPJING COMMISSION A meeting of the Planning and Zonir~y Commission was held in the Council Chambers on Tuesday, f~~a,y 3, 1977. The i,~eeting was called to order at 7:30 P. M. by Chairwoman Ray with the following members present: f~lessrs. Sargent, Jones, Czech, Meginley, Ogden and Sullivan. City Official present was City Manager Tiffany. Others present were Messrs. Searles and Ray. The Invocation was given by Chairwoman Ray. f~inutes of the April 5, 1977 meeting were approved as ~~~ritten. SUBDIVISIOPJ COMMITTEE Mr. Czech reported that the Subdivision Committee had met on April 11 and that considerable time was spent on working up a proper definition for "Subdivision" with the assistance of Councilman Blackburn and City Manager Tiffany. The study will be continued by the Committee and progress reports made to the Commission. PLANNING COMMITTEE Mr. Sargent reported the Planning Committee met on May 2 to discuss "Priority of Use" regulations in Section 26-10 of the Zoning Code. The Committee recommends that Section 26-10 be amended to continue allowing the next lower use in Cl, C2, f~11 and P12 zones as conditional uses. The effect of this ari~en~lment would be to make C2 uses in existinb buildings in Cl zones conditional, rather than permitted uses, with the same requirements for Ml uses in C2 zones and M2 uses in Ml zones. It was felt that this change would give the city more flexibility in administrating the ordinance, and would protect the integrity of the zoning districts. City Attorney Baird will be requested to prepare an ordinance incorporating these recommendations. COMh1UNITY APPEARANCE STANDARDS Mr. P1eglin'ely reported that the Committee had process of"reviewing city ordinances covering landscape, junk yard and mowing program which on community appearance, as well as reviewing ordinances of other cities. The Committee ho recommendation for the commission at the next met and is in the subdivision, all have an effect appearance yes to have a meeting. A meeting of the Committee was schedule for Friday, May 6, at 3 P. M. in the City Manager's office. RESIDENTIAL NON-CONFORMING USES A draft ordinance that was prepared by City Attorney Baird as a result of discussion on Transition Zones was reviewed and discussed by the commissioners. The ordinance will be resubmitted to the City Attorney for redrafting to include discretionary authority in granting exceptions by the Planning and Zoning Commission and the City Council. STRUCTURES P1r. Searles requested a clarification of the definitions of "Structures" and "Building" as used in the zoning ordinance. Considerable discussion followed on this subject with reference to past action by the commission on this definition. It was agreed that City Manager Tiffany would request the City Attorney to give his interpretation of the definitions of "Structure" and "Building". PERMITTED AND CONDITIONAL USE STUDY • • Upon recommendation of the City Mnaager, and as a result of discussions of the Planning Committee on the Priority of Use Subject, Chairwoman requested regested the.P'~anni~ng Committee to undertake this study. As part of this study, at the suggestion of Mr. Meginley, City Manager Tiffany was requested to ask the City Attorney for an interpretation of non-conforming uses vs non-conforming structures.
