A meeting of the Planning and Zoning Commission was held in the
Council Chambers on Tuesday, April 5, 1977. The meeting was
called to order at 7:30 P.M. by Chairwoman Ray with the following
members present: Mrs. Laura Cook and Messrs. Sargent, Jones,
Czech, Meginley and Odgen. City officials present were Mayor
Claude E. Smoak, Jr., Councilmen Byrd, Schroedel, Blackburn and
Honey; City Manager Tiffany, City Attorney Baird and Director
of Community Development Nagel. Others present were: Messrs.
Schmidt, Luke, Fleming, Willett, Searles, Swett and Ray, and
Secretary Dollar.
The Invocation was given by Chairwoman Ray.
The Minutes of the meeting held on March 1, 1977 were approved
as written.
TRANSITION ZONES
Commissioner Jack Sargent reviewed the recommendations
of the Planning Committee on transition zones as
reported by the City Manager in his memo to the
Planning and Zoning Commission (copy attached) and
stated that the committee had voted to recommend
rezoning the Transition Zones as follows:
TZ 1: M-2 zoning except for lots 14 - 26 and 4 - 6,
Block 120, Lots 10 - 15, Block 119, and all of
Block 118 which would be C-2 zoning,
TZ 2: M-1 zoning except Blocks 93 and 94, lots 15 -
20, Block 79, and the portion of the government
lot north of Block 93 between West Avenue and
8th Street, which would be C-2 zoning, and,
TZ 3: R3A zoning.
A key committee recommendation was that R-3A uses be
permitted uses in C-1, C-2, M-1, or M-2 zones through-
out the City. This change would allow existing non-
conforming uses in commercial or industrial areas to be
improved, expanded or rebuilt and for new residential
uses to be established in any commercial or industrial
district. The Committee felt that because residences
are of a higher use they would not degrade commercial
or industrial uses; that this recommendation would
protect the right of residential property owners to
use their homes and would encourage ungrading of
existing non-conforming residences.
There was considerable discussion of the Committee's
recommendations, particularly that R3-A uses be permitted
in Commercial and Manufacturing Zones. There was some
thought that this recommendation would ultimately lead
to degrading the residences more than upgrading the
businesses. It was felt by the Commission that more
thought should be put into this recommendation by the
Committee before action is taken by the Commission and
that these recommendations also be considered in con-
junction with the City's Comprehensive Plan. City
Attorney Baird suggested some consideration might be
given to allowing exceptions to non-conforming uses in
order that homeowners in non-conforming zones would be
allowed to expand or rebuild after review on a case by
case basis.
Motion was made by Commissioner Jones, seconded by
Commissioner Sargent and carried that the recommendations
of the Planning Committee be tabled for further study.
COMMUNITY APPEARANCE STANDARDS
At their March 8 meeting, Council requested the Planning
and Zoning Commission to study and to make recommendations
on the subject of community appearance standards and
regulations. City Manager Tiffany recommended referring
the subject to an appropriate committee for study and
report back to the Commission, whereupon Chairwoman Ray
appointed a Community Appearance Standards Committee as
follows: Jim Meginley, Chairman; Rufus Sullivan, Laura
Cook, and Nick Jones, members. A meeting of the committee
was scheduled for Thursday, April 14, at 2:00 P.M. in the
City Manager's office. Councilman Blackburn suggested
that sign regulations be considered as part of this study.

COMPREHENSIVE PLANNING
at the suggestion of City Manager

Mr. Michael Willett, Lake County Planning Director, reviewed
the GOALS AND OBJECTIVE AND SURVEY RESULTS FOR THE CITY OF
CLERMONT as revised by his department in response to Com-
prehensive Planning Committee action in March.
There was considerable discussion and comments on the
questionnaire results and on the suggested goals and
objectives. Mr. Willett also described the planning
process under the Local Government Comprehensive
planning Act.
SUBDIVISIONS
A meeting of the Subdivision Committee was scheduled for
Monday, April 11, at 3:00 P.M. in the City Manager's office
to begin study of the subdivision ordinance.
There being no further business to come before the Commission, the
meeting was adjourned at 9:25 P.M.
