11-03-1976 Regular MeetingPLANNING AND ZONING COMMISSION MINUTES A meeting of the Planning and Zoning on Wednesday, November 3, 1976. The by Chairwoman Ray with the following Messrs. Czech, Cunningham, Sullivan, officials present were City Manager Official Nagel. Others present were Cook. Commission was held in the Council Chambers meeting was called to order at 7:30 P. M. members present: Mrs. Laura Cook and Jones, Norquist and Knowles. City Tiffany, City Attorney Baird and Building Miss Cochran and Messrs. Fason and The Invocation was given by Chairwoman Ray. The Minutes of the meeting held on September 7, 1976 were approved as written. CENTRAL BUSINESS DISTRICT ZONING Mr. Tiffany reported that the City Council had tabled the proposal to rezone the Central Business area until completion of the City's Comprehensive Plan, and had directed the Comprehensive Planning Committee to give the central business area special consideration in preparing the Plan. Mr. Czech suggested notifying the Central Business District property owners of the City Council action. Mr. Sargent entered the meeting at this point. COMPREHENSIVE PLANNING Mr. Tiffany reported that the questionnaire prepared by the Lake County Planning Department would be ready for mailing to City residents in about a week. Mr. Knowles Eommented that the questionnaire had been reviewed and substantially revised by the Committee. PUBLIC HEARrNG: CONDITIONAL USE PERMIT FOR CHURCH Mrs. Blanche Bell appeared before the Commission in support of her request for a Conditional Use Permit to use the existing building at 743 East Montrose Street as a Church. She stated that the proposed church would serve youth of the immediate neighborhood. Mr. Nagel reported that he had inspected the building and found it in excellent condition. Mr. Tiffany discussed the proposed use in relation to the neighborhood, reported that no objections had been received from the neighbors, and recommended granting the permit without restrictions. Mr. Sullivan asked how long the building had been vacant. After some discussion it was reported that the building had been vacant for more than twelve months and had therefore lost its legal non-conforming use status. Mr. Sullivan said that the church would be an asset to the neighborhood. Mr. Norquist moved, seconded by Mrs. Cook, that the Commission recommend to the City Council that a Conditional Use Permit for use of the existing building at 743 East Montrose as a church be granted, with the conditions (1) that existing landscaping not be reduced; (2) that the use not be expanded except with a Conditional Use Permit granted by the City Council, and (3) that the building conform to building code requirements. Motion passed unanimously. ~J HOME OCCUPATIONS Referring to his October 22 memo which had been previously circulated to the Commissioners, Mr. Tiffany said that the City Council had referred to the subject of Home Occupations to the Planning and Zoning Commission for their study and recommndations. He further stated that under existing zoning, home occupations are not allowed except as conditional uses in R-3 zones, but that in fact numerous home occupations exist in all zones. Mr. Baird discussed legal aspects of regulating home occupations, and introduced the ordinance from Thousand Oaks, California (which has been previously distributed to the Commissioners) as a sample ordinance that, with modifications, would be workable in Clermont. There was a general discussion of problems relating to regulating home occupations, including unfair competition with commercial area businesses, traffic in~residential areas, ~ occupational licensing, and other problems. The Commission then reviewed the ordinance from Thousand Oaks, California and suggested several changes. Mr. Tiffany said that he would prepare a revised ordinance incorporating these changes for consideration at the next meeting. STREET LIGHTING After a brief discussion, Mr. Jones moved, seconded by Mr. Norquist and unanimously carried, that the Commission recommend to the City Council that three tree lights be installed. along Grand Highway between East Avenue and the Orange Hill Subdivision.
