A meeting of the Planning and Zoning Commission was held in the Council
Chambers on Tuesday, August 3, 1976. The meeting was called to order at
730 P. M. by Vice Chairman Czech with the following members present:
Mrs. Laura Cook and Messrs. Sullivan, Knowles, Cunningham, Jones and
Sargent. City officials present were Councilman Beals, City Manager Tiffany,
City Attorney Baird and Building Official Nagel. Others present were
- Messrs. Steve Hagner, Richard Black, Robert Black, John Rocker and Attorney
William Stone.
PUBLIC HEARING R AND S CONDITIONAL USE PERMIT
Attorney William Stone appeared before the Commission to request
that the Messrs. Black and Hagner be allowed an Occupational license
for the purpose of conducting an Auto Paint and Body Shop business
in the old cabinet shop at 721 West Avenue (just north of the Police
Station). He requested a classification of use determination from
the P & Z Commission as to whether this business would be a permitted
use within this C-2 zoning district, and if not, he requested a
classification of use as a conditional use and approval of a
Conditional Use Permit to allow the business.
Following discussion and assurance from the petitioners that the
auto repair and painting work would be carried on entirely within
the confines of the building and that the off-site parking of
cars would be kept to a minimum and only for the transaction of business,
and that the hours of business would be limited so as not to be
obnoxious to the neighborhood, it was consensus of the Commission
that this business should be classified as a conditional use and
the business be allowed under a Conditional Use Permit.
Motion was made by Mr. Jones, seconded by Mrs. Cook and carried
with Mr. Knowles voting naye, that recommendation be made to
City Council that Messrs. Black and Hagner be granted a Conditional
Use Permit under Section 26-87 (B) of the Zoning Code to operate
their business under the following conditions: (1) that no vehicles
will be repaired or painted outside the building; (2) that no
vehicles awaiting work will be stored on the public right-of-way ;
and (3) that no paint or body work will be conducted on the
property between the hours of 9:00 P. M. and 7:00 A. M.

Mr. Jones inquired the status of

REDUCED MINIMUM LIVING AREA
Mr. Jones stated that there is a trend developing in our economy
whereby people cannot afford to build single-family homes of the
minimum living area required by our zoning ordinance and that he
suggested consideration be given to a reduction of the minimum
square footage allowed.
There being no further business, the meeting was adjourned by Chairman
Czech at 8:17 P. M.
