01-06-1976 Regular MeetingPLANNING AND ZONING COMMISSION MEETING A meeting of the Planning and Zoning Commission was held in the Council Chambers on Tuesday, January 6, 1976. The meeting was called to order by Chairman Czech at 7:30 P.M. with the following members present: Mesdames Ray and Cook and Messrs. Williams, Cunningham and Jones, City Officials present were City Manager Hopkins, City Attorney Baird and Director of Community Services Smythe. Others present were Sisters Roseanne and 0"Brien of East Coast Migrant Headstart and Mrs. W. 0. Boone and Messrs. Sargent and Karl Drake. The invocation was given by Mrs. Ray. The minutes of the meeting held on December 2, 1975 were approved as written. Chairman Czech announced the first order of business to be a Public Hearing to consider a request by the East Coast Migrant Headstart for a Conditional Use Permit to use the property described as the Blessed Sacrament Catholic Church, 270 Twelfth Street, Clermont, Florida, for a nursery school for migrant children under the age of three. Sister Geraldine O'Brien appeared before the commission in behalf of the request. There were no objections from the floor. Motion was made by Mrs. Ray, seconded by Mr. Cunningham that the Planning and Zoning Commission recommend to the City Council that the request be granted with the following conditions: (1) The nursery school must be approved by the Blessed Sacrament Catholic Church. (2) The nursery must meet all state requirements. (3) If an outdoor play area is provided, the area must be enclosed by a fence at least four (4) feet high. (4) The structure or use cannot be expanded except as granted by the City Council under a Conditional Use Permit. (5) Must conform to all provisions of zoning and other applicable ordinance. Upon roll call vote on passage of the motion the result was: Ayes: Williams, Ray, Cunningham, Czech, Cook and Jones. Nayes: None. Absent: Seaver, Wilkins and Doughtery. The motion carried. Under old business the following items were discussed: That the sign ordinance had been passed by the City Council on December 23, 1975. Mr. Cunningham reported that the Subdivision Committee met at City Hall on December 18, 1975 to discuss the necessary changes to the Subdivision Regulations. The following changes were discussed: 1. City Council approval of preliminary plat Under the existing regulations, the preliminary plat is not reviewed by City Council before final plat preparation is authorized. Parks and recreation site .?)-16 (F) Under the present regulations, a developer must dedicate 5% of his site to parks or pay to the city a sum of money equal to five percent of the value of the property for park purposes. The committee debated the merits of this provision and decided against any changes. 3. Curb and gutter 20-17 (G) (7) (e) and 20-17 (1) (3) The present regulations require curb and gutter The committee felt the provision should be amended to call for curb and gutter when required by the City Council upon recommendation of the Planning and Zoning Commission. This flexibility would allow for drainage swales and similar natural drainage systems when appropriate. 4. Water Main 20-17 (H) (3) The present regulations require cast iron water mains The committee felt that new types of PVC class water pipe should be allowed when recommended by the city engineer and approved by the City Council. 5. Motion was made by Mr. Jones, seconded by Mrs. Ray and unanimously carried that the recommendations of the Subdivision Committee for changes to the Subdivision ordinance be accepted by the commission and that these recommendations be submitted to the City Council for their consideration. The commission felt the changes would definitely strengthen the regulations. Mr. Cunningham advised that he had no further information to report on the Police and Fire Improvements. Regarding zoning, particular on the perimeter of the Central Business District (CBD), a work meeting was held immediately following the Planning and Zoning Commission. Motion was made by Mrs. Ray, seconded by Mr. Jones that a Certificate of Appreciation be drawn up for presentation to City Manager Hopkins for his efforts in behalf of the Planning and Zoning Commission.
