A meeting of the Planning and Zoning Commission was held in the
Council Chambers on Tuesday, November 6, 1973• The meeting
was called to order at 7:30 P.M. by Mr. George Hovis, acting
chairman in the absence of Mr. Seaver, with the following members
present: Mrs. Ruth Alice Ray and Messrs. R. Williams, N. Jones
and R. E. Oswalt. City Officials present were: Mayor Smoak,
Councilmen Beals, Czech and Schroedel, City Manager Hopkins
and City Controller Fleming. Others present were: Mrs. Frances
Boone and Messrs. Ozzie Freeman and Samual Boney.
The Involcation was given by Mrs. Ray followed by repeating
of the Pledge of Allegiance in unison by those present.
The Minutes of the meeting held on October 2, 1973, were approved
as written.
Chairman Hovis announced the first order of business to be a Public
Hearing to consider request by St. Mark AME Church for a Conditional
Use Permit to allow construction of a church on the following des-
cribed property:
That part of Tract 1 in Oakhurst Subdivision beginning
at a point on the east line of said Tract 1 that is
165 feet south of the NE corner of said Tract 1, run
thence West parallel to the N line thereof 100 feet,
run thence N parallel to the E line thereof 37.5 feet,
run thence W. Parallel to the N line thereof 225 feet,
run thence S 182.5 feet to the S line of said tract, run
thence E 325 feet to the SE corner thereof, run thence
N 145 feet to the point of beginning.
Mr. Samuel Boney appeared before the Commission on behalf of
this request. There were no objections to the request. Motion
was made by Mrs. Ray, seconded by Mr. Jones, that recommendation
be made to City Council that the Conditional Use Permit be
granted to the church subject to the following conditions recommended
by City Manager Hopkins:
1. The buildings are placed not less than twenty-five (25) feet
from any property line.
2. There is a landscape buffer strip at least five (5) feet wide
planted along the side and rear property lines. It shall be planted
with trees and/or shrubs in such a manner as to provide opaque
screening and shall be properly maintained at a minimum height of
six (6) feet shall normally be reached within two (2) years from
planting.
3. Off street parking shall be provided for church use at a ratio
not less than fourteen (14) square feet of parking space for each
square foot of floor space provided for worshippers within the
church sanctuary. Such off street parking shall be provided contigous
to an integral part of the property whereon the church is located.
4. The structure or use cannot be expanded except as granted by
the City Council under a Conditional Use Permit.
5. Must conform to all provisions of zoning and other applicable
ordinances.
Upon roll call vote on passage of the motion, the result was: Ayes:
Williams, Ray, Oswalt and Jones. Total Ayes: 4. Nayes: None. Abstaining:
Hovis. The motion carried.
Mr. A. E. Langley arrived at the meeting at this time.

Chairman Hovis announced a Public Hearing to consider request
of Mr. and Mrs. W. 0. Boone for the rezoning of Lots 1 thru 16,
inclusive, in 'City Block 84, from its present C-1 zoning to
C-2 Zoning. Mrs. Boone appeared before the Commission in behalf
of this request. Mr. Hovis advised that he had received a preference,
no objection, from Carlisle A. Byrd, in behalf of the First Methodist
Church that a request for a CUP be considered instead of a
rezoning request. In discussion which followed, Mrs. Ray objected
to the rezoning. Motion was made by Mr. Jones, seconded by Mr.
Williams, that recommendation be made to City Council that the
request of Mr. and Mrs. W. 0. Boone for this rezoning be granted.
Upon roll call vote on passage of the motion, the result was:
Ayes: Williams, Oswalt, Hovis, Langley and Jones. Total Ayes: 5•
Nayes: Ray. Total Nayes: 1. The motion carried.
Chairman Hovis welcomed the members of the Council to the meeting.
Mr. Nick Jones offered to make a study of parking requirements for
churches, which offer was accepted by the Commission.
Upon recommendation of City Manager Hopkins, the commission discussed
allowing multiple family residential in C-1 and C-2 zones. Motion
was made by Mrs. Ray, seconded by Mr. Jones, that a recommendation
be made to City Council that Multiple Family Residential be allowed
under a Conditional Use Permit in C-1 and C-2 Zones. The motion
carried with Mr. Williams voting Nay.
A discussion, introduced by Mr. Oswalt, was held on Buffer Zones
and what measures could be taken to assure the proper maintenance
of these zones once they have been established.
