A meeting of the Planning and Zoning Commission was held in the
Council Chambers on Tuesday, June 5, 1973• The Meeting was called
to order at 7:25 P.M. by Vice Chairman Seaver with the following
members present: Messrs. Perry, Giachetti, Loomis, Williams,
Oswalt and Dupee. City officials present were City Manager Hopkins
and Councilman Schroedel.
The Invocation was given by Vice Chairman Seaver.
The Minutes of the meeting held on May 1, 1973 were approved
as submitted.
City Manager Hopkins submitted a re-draft of the tree ordinance
which was reviewed and discussed by the commission. Motion was
made by Mr. Dupee, seconded by Mr. Loomis and carried, that
recommendation be made to City Council that the tree ordinance
not be enacted at this time subject to development of a general
landscaping area control for all greenbelt areas in commercial
developments (new construction).
Under new business the first item discussed was Section 26-66
of the Code of Ordinances pertaining to the regulations for swimming
pools, which in the opinion of the City Manager, are too restrictive,
particularly with respect to setbacks and fence height require-
ments. Following discussion of this section, motion was made by
Mr. Giachetti, Seconded by Mr. Perry, and carried, that recom-
mendation be made to City Council that Section 26-66 be changed
to read: Swimming pools shall be located back of the front
building line; the minimum side and rear yard setbacks shall be
equal to the minimum side yard requirements for the zone, and
that residential swimming pools shall be enclosed by a fence or
wall at least four (~) feet in height.
At the request of City Council the commission considered allowed
cluster developments in all residential zoning districts subject
to the condition of Section26-63. Motion was made by Mr. Oswalt,
seconded by Mr. Loomis, and carried, that recommendation be
made to Council that Section 26-63 be changed to allow for cluster
development on a parcel of 20,000 square feet minimum and that
cluster development be allowed as a condition use in the R-2
Medium Density Residential District.
