10-03-1972 Regular MeetingPLANNING AND ZONING COMMISSION A meeting of the Planning and Zoning Commission was held in the Council Chambers on Tuesday, October 3, 1972. The meeting was called to order at 7:30 P.M. by Chairman Czech with the following members present: Mrs. Ruth Alice Ray and Messrs. Bratton, VanderMeer, lovelady, Jones, Williams and Oswalt. City officials present were Mayor Don E. Smith, Councilwoman Watson, Councilmen Beals and Schroedel, City Manager Hopkins, City Controller Fleming and Director of Community Services Smythe. Others present were: Mr. and Mrs. G. Narehood, Mrs. L. Plowman and Messrs. D. Madden, F. E. Williams and R. Peterson. The Invocation was given by Mr. VanderMeer, followed by a welcome to the guests from Chairman Czech. The minutes of the meeting held on July 5, 1972 were approved as written. Under new business a request from Mr. F. E. Williams of 970 Juniata Street, to construct a fruit stand on Lot 16, Block 18 (North side of SR 50 between Second and Third Streets) was considered. Motion was made by Mr. Williams, seconded by Mr. Jones, and carried, that recommendation be made to the City Council that Mr. Williams' request be granted. Chairman Czech welcomed Mayor Smith and the Council members to the meeting. A request of Mr. Alvin Knight to open a fish market in an existing building located on Lots 4 and 5, Block 111, Sunset Park (West side of Tenth Street between Juniata and Broome Streets) was considered by the Commission. Objections to permitting a fish market at this location were voiced by Messrs. Williams and Narehood and Mrs. L. Plowman. Motion was made by Mrs.~Ray, seconded by Mr. Lovelady, and carried, that recommendation be made to City Council that since retail sales are not permitted uses in the M -2, Medium Industrial District that Mr. Knight's request be denied. Amendments to the Zoning Ordinance, as per attached "Items for Consideration" were discussed section by section with the following action taken by the Commission: Section 26-2 District Boundaries on Zoning Map Motion was made by MR. Jones, seconded by Mr. VanderMeer, and carried, that recommendation be made to the Council to "change the classification of newly annexed property from R1A to R1AA". Section 26-22A R3A Townhouse Residential District and 26-23 Residential Professional District. Motion was made by Mrs. Ray, seconded by Mr. Jones, and carried, that recommendation be made to City Council that these two sections be amended to read "Require site plan approval for townhouses and multiple family dwelling". Motion was made by Mrs. Ray, seconded by Mr. Oswalt, that recommendation be made to Council that no change be made in the parking requirements in the existing ordinance. Upon roll call vote on this motion, the result was: Ayes: Ray, Oswalt, Czech, Lovelady, Williams, Total Ayes: 5. Nayes: VanderMeer, Jones, Bratton, Total Nayes: 3. The motion carried. Section 26-30 Area, Yard and Height Requirements(Table). Motion was made by Mr. Oswalt, seconded by Mrs. Ray, that recommendation be made to City Council that "Has been incorporated in other sections" be deleted. Upon roll call vote on the motion the result was: Ayes: Ray, Oswalt, Czech, Lovelady, Williams, Jones, Bratton, Total Ayes: 7. Nayes: VanderMeer. Total Nayes: 1. The motion carried. Section 26-41 Off Street Automobile Parking Motion was made by Mr. Oswalt, seconded by Mrs. Ray that it be recommended to Council that the fa~lov,+ing changes be made in Section 26-41 Off Street Automobile Parking. Line 3 - Delete the word "below" No. 1 through 21 - Delete "Have been incorporated in other sections No. 22 Change to read No. 1 Delete the word "above~in line 2 No. 23 Change to read No. 2 No. 24 Change to read No. 3 Upon roll call vote on passage of the motion the result was: Ayes: Ray, Oswalt, Jones and Lovelady. Total Ayes: 5. Nayes: VanderMeer, Czech and Williams. Total Nayes: 3. the motion carried. Section 26-62 Cluster Development. It was concensus of the commission that cluster development is an item that should be considered, and requested the City Manager and Mr. Mazzotta to prepare specific proposals for this type of development for the commission's further consideration. Section 26-64 Mobile Home Parks Recommendation was made by the Commission that Change No. 5 read: "That there shall be a minimum back line of 20' from the centerline of interior street." The vote was Ayes 6. Nayes 2. Recommendation was made by Commission that change No. 7 read "Setbacks from lot line shall be Side - 5 feet minimum (except in case of corner lots, in which use the setback be 72 feet on the side street. Rear 5 feet minimum). The vote was A~ es 7. Nayes 1 . The City Manager requested the Commission to give consideration to modifying the present ordina nre covering the Parking of Trailers. The matter was discussed by the Commission and the City Manager was requested to prepare changes ~coc• the ordinance for further consideration of the commission.
