The meeting of the Planning & Zoning Commission was called to order Tuesday January 6, 2009
at 7:00 p.m. by Chairman David Pape. Other members present were Bernadette Dubuss, Robert
Boyatt, Nick Jones, Bill Gray, Judy Proli, and Cuqui Whitehead. Also in attendance were Jim
Hitt, Planning Director, Barbara Hollerand, City Planner, Dan Mantzaris, City Attorney, and Joy
Thys, Planning Tech II.
MINUTES of the Planning and Zoning Commission meeting held December 2, 2008 were
approved as written.
REPORTS
Planning Director Jim Hitt stated that he is tentatively planning workshop at 6:00 pm prior to the
February 3`d Planning and Zoning meeting for the Board members to review the Comprehensive
Plan changes. He also stated that for the second item on the agenda, Blessed Sacrament
Conditional Use Permit, the applicant is asking to table so that they can work with staff with
regard to the uses.
Commissioner Whitehead moved to table the request for the Conditional Use Permit for Blessed
Sacrament until February 3, 2009, seconded by Commissioner Dubuss. The vote was unanimous
to table the Blessed Sacrament Conditional Use Permit.
1. REQUEST FOR REZONING

OWNER: Roberts Family Trust
APPLICANT: Quint Roberts, Roberts Family Trust
REQUEST: Rezone 3.24 acres from Urban Estate to C-2
LOCATION: Northwest corner of U.S. 27 and Anderson Hill Road
EXISTING LAND USE: Vacant
FUTURE LAND USE DESIGNATION: Lake County Urban Expansion
City planner Barbara Hollerand stated that this rezoning request is being heard in conjunction
with an annexation request.
Ms. Hollerand stated that the subject property is across from the Wal-Mart shopping center on
U.S. 27. She stated that to the north and east of the property are commercial uses; to the south is
residential use; and to the west is vacant land with Lake County community facility district
zoning.
Ms. Hollerand stated that the owner will need to apply for a conditional use permit prior to
developing the parcel, which is planned as a 26,810-square-foot shopping center.

Ms. Hollerand stated that the site is well served by the transportation network. She said the
property fronts U.S. 27, and Anderson Hill Road runs along its southern boundary. She stated
that preliminary site plans show cross access to the driveway of the property to the north, which
has an existing curb cut on U.S. 27. She stated that additional access to the site from Anderson
Hill Road is show on the preliminary plan.
Ms. Hollerand stated that the Lake County future land use of Urban Expansion is sufficient to
develop the parcel as a commercial property. She said the owner will be required to apply for a
small-scale comprehensive plan amendment to assign a City future land use.
Ms. Hollerand stated that this location is appropriate for commercial development and the Lake
County future land use of Urban Expansion is sufficient to develop the property as commercial.
Ms. Hollerand stated that staff recommends approval of the rezoning request.
John Herbert stated that he is the engineer for the project and was present to answer any
questions from the Board.
Commissioner Dubuss asked if there were any proposed tenants for the shopping center.
Mr. Herbert stated that they have no tenants at this time.
Commissioner Proli asked if they were looking for restaurant tenants, retail or both.
Mr. Herbert stated that they are looking for a mixed use of retail and restaurant. He stated that
restaurants will be limited due to the amount of parking required by code. He stated they will
have to have a variance if restaurants do come into the project.
Commissioner Whitehead stated that Anderson Hill Road goes right into a residential area. She
stated there will be traffic issues. She stated that she sees 19 units for this project, and she
already sees so many empty stores in that area.
Mr. Herbert stated that most tenants will probably use 2 units to occupy their space. He stated
that by the time the project is complete, the recession should be improving.
Chairman Pape asked if a market study was done or are they prepping the ground so they can sell
later.
Mr. Herbert stated that the owners have another project in Oviedo which is one or two weeks
away from getting a CO. He stated that the property owners do build and own their
developments; they do not sell the land at this time.

Commissioner Whitehead asked what the plans for the topography were for this project.
Mr. Herbert stated that the topography is suitable for what they want to do. He stated that there
is an incline up from Highway 27, but on top it is flat.
Commissioner Jones moved to approve the request for the Rezoning, seconded by Commissioner
Boyatt. The vote was S - 2 to recommend for approval to City Council with Chairman Pape and
Commissioner Whitehead opposing.
2. REQUEST FOR A CONDITIONAL USE PERMIT
PROJECT: Blessed Sacrament Catholic Church
OWNER: Jesus & Ana Quintana
APPLICANT: Thomas G. Wenski, Bishop of the Diocese of Orlando
REQUESTED ACTION: Request for an amendment to a Conditional Use Permit (CUP) to
add new property and building to the CUP
LOCATION: 1170 Desoto St. (property to be added to CUP) - N.E. corner of Desoto
St. and Twelfth St.
SIZE OF PARCEL: 13.14 acres total (0.54 acres to be added to CUP; Existing: 8.1 ac
developable acres, 4.5 acres wetland)
EXISTING ZONING: R-3, Residential/Professional District
EXISTING LAND USE: Multi-family unit residential building
FUTURE LAND USE DISTRICT: NED-6, Non-established District
FUTURE LAND USE CLASSIFICATION: Residential
There being no further business, the meeting was adjourned at 7:30.
