1950-08CONTRACT
THIS CONTRACT, made and entered into this 28th, day of February
A.D. 1950, by and between the City of Clermont, a Municipal Corporation
of the County of Lake and State of Florida, hereinafter referred to as
the CITY, AND WARREN P. HUNNICUTT, trading and doing business as
Hunnicutt and Associates, of the County of Pinellas and State of Florida,
hereinafter referred to as " HUNNICUTT",
WITNESSETH: That for and in consideration of the mutual promises
and agreements herein contained, the City hereby hires, employs, and
contracts with Hunnicutt for the said Hunnicutt to appraise all the
taxable real and personal property in the City of Clermont, and
Hunnicutt hereby accepts said hiring and employment and contracts with
the said City to appraise all of said taxable real and personal
property in the City of Clermont, all upon the following terms and
conditions hereby agreed upon, to-wit:
1. WHAT IS TO BE APPRAISED.
HUNNICUTT will make a tax appraisal of all taxable real and
personal property within the City of Clermont.
2. HOW THE APPRAISAL WILL BE MADE.
Quality of Work:, In making the appraisal, Hunnicutt will use what
is to the ,best of his knowledge the best and most scientific methods
of making mass appraisals for tax purposes.
Real Property: Each individual parcel of property will be
appraised according to the legal description now on the tax roll. Land
and improvements will be appraised and valued separately. All improve-
ments will be appraised separately. The values of the land, improvements,
and total value will be furnished for each parcel.
Business Personal Prope~ty: Hunnicutt will prepare a list of
the names of the owners and appraise all items of Business Personal
Property. The appraisals will be made from inventories and lists of
equipment and fixtures furnished by the property owners and by
inspection.
Household Personal Property: Household Personal Property will
,be appraised by the method of taking a percentage of the value of the
'building wherein the property is located. The value of the taxable
household personal property located in each parcel of real property
will be furnished by Hunnicutt; however, it will be the duty of the
Assessor to indicate which properties are subject to exemptions for
household personal property.
3. LEVEL OF VALUES.
It will be the duty of Hunnicutt to determine what in his
opinion is the proper level of values for the assessment of land,
improvements, business and household personal property, and to so
advise the Assessor and Council of said City. The City Assessor of
said City will select the level of value to be used in making the
appraisal, and so advise Hunnicutt.
4. WHAT THE CITY WILL RECEIVE.
Real Property:
The City will receive an Assessment Appraisal
System having for each separate parcel of property now legally described
on the tax roll a property record card Showing the name of the owner,
the legal description, drawings and appraisal calculations for each
individual improvement, and the appraised value of the land, improve-
ments, and the total value of the property, and also a set of maps show-
ing, according to the legal descriptions of the tax roll, the
location and boundaries of each individual parcel of land, the use
of each parcel, and basic land values.
Business Personal Property: The City will receive a list of
the names of the owners and the appraised value of the property.
Household Personal Property: The City will receive a list of the
names of the owners and the appraised value of all items of household
personal property.
5. WHEN WORK WILL BEGIN.
Hunnicutt will begin work in sufficient time to complete the job
by July 1, 1950.
6. WHEN APPRAISED VALUES WILL BE DELIVERED TO THE ASSESSOR OF
THE CITY.
Hunnicutt will complete the appraisal and deliver the values to
the City on or before the 1st day of July, 1950.
7. PUBLIC INSPECTION OF APPRAISAL RECORDS.
Prior to delivering the values to the City, Hunnicutt will hold
open for inspection by the property owners all appraisal records and
values for a period of one week.

8. EQUALIZATION BOARD.
Hunnicutt agrees to have a representative at all meetings of the
Equalization Board.
9. WHEN APPRAISAL IS COMPLETE.
The appraisal will be considered completed and the work ended upon
final acceptance of a tax roll by the City, and the completion of any
changes necessary in the appraisal records to make same conform with
the acceptance of the tax roll.
10. PRICE TO BE PAID HUNNICUTT BY CITY.
Price: The City shall pay Hunnicutt for his services under
this contract the sum of Four Thousand Five Hundred Dollars ($4,500.00),
provided however, that in the event the total cost of the work to
Hunnicutt, plus a profit of twenty-five percent (25%), as hereinafter
explained, amounts to a sum less than the said $4,500.00; then and in
that event the City shall only pay the said Hunnicutt said lesser sum
rather than the said sum of $4,500.00.
Basis of Cost Plus Price: The cost of the work to Hunnicutt will
be determined under the usual business policies and bookkeeping prac-
tices of Hunnicutt and Associates, and tabulated in a separate Clermont
Appraisal Account in the books of the Municipal Appraisal Department of
Hunnicutt. All charges to this account shall consist of all actual
expenses, including all salaries, materials and other expenses which
shall constitute the direct costs. The indirect costs for overhead
and other indirect costs all will be computed to be seven percent (7%)
of the direct costs. The total cost of the work will be, therefore,
the total' of the direct and indirect costs. The profit will be
computed to be twenty-five percent (25%) of the total cost. Hunnicutt
will, as and when the same is requested, furnish to the City, complete
itemized statement of all direct costs.
Weekly Payments: The City agrees to pay Hunnicutt on said contract
price, weekly payments of Four Hundred Dollars ($400.00) on or before
Friday of each week, beginning with the week work begins; provided,
however, that the total sum of said weekly payments shall not exceed
the sum of Three Thousand Six Hundred Dollars ($3,600.00). In the
event the cumulative direct costs of the work at any time exceeds the
cumulative weekly payments as above, the City will make additional

payments to Hunnicutt at such time or times in an amount or amounts
sufficient to make the cumulative payments on said contract equivalent
to the cumulative direct costs to any such date.
Final Payment: Upon completion of the work , or as soon thereafter
as possible, a final statement will be presented for payment. Final
payment shall be made within ninety (90) days following completion
of the work.
11. DEFENSE OF VALUES,.
Hunnicutt agrees that in the event any legal attack be made upon
any of his appraised values, he wi 11 do any and al,l things reasonably
necessary to assist the City in the defense of any such suit, without
any extra charge, all court costs and attorneys fees to be paid by the
City.
12. OFFICE SPACE.
The City will furnish adequate office space in the City Hall for the
employees of Hunnicutt.
13. POST COMPLETION WORK.
Following completion of the appraisal, as stated in Section Nine (9)
and in excess of the price stipulated in Section Ten (10), the City agrees
to pay Hunnicutt cost plus Twenty-Five Percent (25%) computed in the same
manner stipulated in Section Ten (10) for any and all work done.
IN WITNESS WHEREOF, the said City of Clermont has caused these
presents to be executed by its duly authorized officers, and the official
seal to be hereunto attached, all pursuant to lawful authority, and the
said Warren P. HUnnicutt, trading and doing business as Hunnicutt and
Associates, has duly executed the same, all in duplicate, the day and
year first above written.
