The meeting of the Planning & Zoning Commission was called to order Tuesday
February 2, 2010 at 7:00 p.m. by Chairman David Pape. Other members present were
Nick Jones, Cuqui Whitehead, and Judy Proli. Also in attendance were Barbara
Hollerand, City Planner, Dan Mantzaris, City Attorney, and Rae Chidlow, Administrative
Assistant.
Commissioner Whitehead moved to table the nomination of Chairman and Vice
Chairman until the March 2, 2010 meeting; seconded by Commissioner Jones. The vote
was unanimous to recommend to table the nomination.
MINUTES of the Planning and Zoning Commission meeting held January 5, 2010 were
approved as written.
REPORTS

1. REQUEST FOR A LARGE SCALE COMP PLAN AMENDMENT
OWNER: Richard E. Bosserman, Gladys T. Bosserman, Co-trustees
APPLICANT: Chris Roper, Akerman Senterfitt, PA
REQUESTED ACTION: Request for a large scale comp plan amendment changing
the future land use from Lake County Urban to City Residential/Office
LOCATION: Southwest corner of Hooks Street and Excalibur Road
EXISTING ZONING: Lake County R-6 and CFD (becomes Urban Estate upon
annexation)
EXISTING LAND USE: Vacant
FUTURE LAND USE DISTRICT: Lake County Urban
City planner Barbara Hollerand stated that the two agenda items tonight are both
proposed large-scale comprehensive plan amendment requests. She stated that each has a
related annexation request going before the City Council February 23.
Ms. Hollerand stated that the first of the requests is for the Bosserman 17 property. She
stated that the vacant 17.03-acre property, comprised of three parcels, is south of S.R. 50,
on the southwest corner of Hooks Street and Excalibur Road. She stated that East Ridge
High School is to its east, and East Ridge Middle School is to its south. She stated that
vacant property is to the north and west. She stated that the subject property is
contiguous to the City on its northern side.

Ms. Hollerand stated that the owners are Richard E. Bosserman and Gladys T.
Bosserman, co-trustees. She stated that the applicant is Chris Roper with Akerman
Senterfitt.
Ms. Hollerand stated that the request is for alarge-scale comprehensive plan amendment
to change the future land use from Lake County Urban to Residential/Office in the City.
She stated that the future land use of Residential/Office would allow both an office
development or multifamily with a maximum density of 12 units/acre. She stated that a
conditional use permit is required for densities of more than 8 units/acre.
Ms. Hollerand stated that the zoning, which is currently R-6 and Community Facilities
District in the County, would revert to Urban Estate in the City upon annexation. She
stated that there is no application being brought forward at this time for a rezoning, and
there are no immediate plans for development.
Ms. Hollerand stated that the site is accessible by both Hooks Street and Excalibur Road.
She stated that a signalized intersection at Citrus Tower Boulevard and Hooks Street is in
place and a second signal at Citrus Tower Boulevard and Steves Road/Excalibur Road is
planned.
Ms. Hollerand stated that upon annexation of this property, it is appropriate to assign a
City future land use of Residential/Office at this location.
Ms. Hollerand stated that staff recommends approval of the Future Land Use Map change
to Residential/Office.
Chris Roper, 420 S. Orange Ave., Orlando, stated that they are in agreement and he is
here to answer any questions.
Commissioner Proli is concerned about the amount of development on this property with
this being residential. She does not feel the schools could handle any more children
entering the schools.
Mr. Roper stated that the property is currently zoned County Urban which is seven units
per acre. He stated that seeking annexation into the city, the maximum density is eight
units to the acre and any more than that would require a conditional use permit. He stated
that the density calculation would be based on the portion of land that would be
residential as opposed to the whole 17 acres. He stated that as an urban designation as
currently in Lake County, it allows commercial up to 50,000 square feet. He stated that if
they bring this property into the City, commercial will no longer be allowed.
Chairman Pape asked if there will be office or apartments on this property.

Mr. Roper stated that it is hard to say right now, but with the market at this time, more
than likely it would be office because there is no market for housing.
Commissioner Whitehead moved to approve the request for the large scale comp plan
amendment; seconded by Commissioner Jones. The vote was unanimous to recommend
for approval to Ciry Council.
2. REQUEST FOR A LARGE SCALE COMP PLAN AMENDMENT
OWNER/APPLICANT: DeWitt Enterprises, Inc.
REQUESTED ACTION: Request for a large scale comp plan amendment changing
the future land use from Lake County Urban to City Commercial
LOCATION: Southwest corner of Citrus Tower Boulevard and Hooks Street
EXISTING ZONING: Lake County R-6 (becomes urban Estate upon annexation)
EXISTING LAND USE: Vacant
FUTURE LAND USE DISTRICT: Lake County Urban
City planner Barbara Hollerand stated that this request is also accompanied by a related
request for annexation that will be heard by the City Council February 23.
Ms. Hollerand stated that DeWitt Enterprises, Inc. is the owner and applicant, represented
by Ted DeWitt. Arthur Nix of Montverde Engineering is the engineer.
Ms. Hollerand stated that the vacant 27.32-acre property, comprised of three parcels, is
south of S.R. 50, on the southwest corner of Citrus Tower Boulevard and Hooks Street.
She stated that the subject property is contiguous to the City on its northern side, adjacent
to property owned by DeWitt Enterprises that was annexed in September 2008 and
assigned a commercial land use in 2009.
Ms. Hollerand stated that the request is for alarge-scale comprehensive plan amendment
to change the future land use from Lake County Urban to Commercial in the City.
Ms. Hollerand stated that the zoning, which is currently R-6 in Lake County, would
revert to Urban Estate in the City upon annexation. She stated that there are no
applications being brought forward at this time for rezoning. She stated that there are no
immediate plans for development. She stated that the site is well served by the
transportation network with signalized intersections at Citrus Tower Boulevard and
Hooks Street and at Sandhill View Boulevard and S.R. 50.
Ms. Hollerand stated that to the south of the subject property is a large stormwater pond
which borders Lost Lake Reserve residential to its south. She stated that this tract

provides a buffer between the proposed commercial property and the residential uses to
the south.
Ms. Hollerand stated that upon annexation of this property, it is appropriate to assign a
City future land use of Commercial.
Ms. Hollerand stated that staff recommends approval of the Future Land Use Map change
to Commercial.
Arthur Nix, 17550 CR 454, Mountverde, stated that to the north is Lowes so this is
consistent to make this commercial. He stated that a lot of the property is on a slope and
the retention pond is already there. He stated that Hooks Street from there to Highway 27
should be complete in 4 to 5 months.
Commissioner Proli asked about future plans for this property.
Mr. Nix stated that the owner has someone interested in independent living, but there is
no contract.
Commissioner Jones moved to approve the request for the large scale comp plan
amendment; seconded by Commissioner Whitehead. The vote was unanimous to
recommend for approval to City Council.
There being no further business, the meeting was adjourned at 7:15 pm.
