A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA,
GRANTING A CONDITIONAL USE PERMIT TO AMEND RESOLUTION NO. 1167 TO ALLOW AN
INCREASE IN AREA OF APPROXIMATELY FIVE (5) ACRES FOR THE CONSTRUCTION OF THREE
(3) ADDITIONAL BUILDINGS TO BE USED AS PROFESSIONAL OFFICES.
WHEREAS, the Planning and Zoning Commission of the City of Clermont, Lake County, Florida
at a meeting held March 5, 2002 recommended approval of this Conditional Use Permit to amend
Resolution No. 1167 to allow an increase in area of approximately Five (5) acres for the construction of
three (3) additional buildings to be used as professional offices; at the following location:

Citrus Tower Lot 7 and the North 295' of Lake Highland Co. tract 16 and the East 125' of the North 295' of
Lake Highland Co tract 15.
The City Council deems it advisable in the interest of the general welfare of the City of Clermont, Lake
County, Florida to grant this Conditional Use Permit
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Clermont, Lake County,
Florida that:
This application for a Conditional Use Permit to amend Resolution No. 1167 to allow an increase in area
of approximately five (5) acres for the construction of three (3) additional buildings to be used as
professional offices; be granted subject to the following conditions:
CONDITIONS:
Section 1 -General Conditions:
1. The conditions as set forth in this Conditional Use Permit shall be legally binding upon any heirs,
assigns and/or successors in title or interest.
2. The property shall be developed in substantial accordance with the conceptual site plan dated
01/31/02 as prepared by McCoy and Associates, Inc. Formal construction plans, incorporating all
conditions of this permit, shall be submitted for review and approval by the Site Review Committee prior
to authorization and issuance of a development permit. The conceptual site plans submitted with the
CUP application are not the approved construction plans.
3. No further expansion of the use or additions to the facility shall be permitted except as approved
by another Conditional Use Permit.
4. No person, firm, corporation or entity shall erect, construct, enlarge, alter, repair, remove,
improve, move, convert, or demolish any building or structure, or alter the land in any manner within the
boundary of the project without first submitting necessary plans, obtaining necessary approvals, and
obtaining necessary permits in accordance with the City of Clermont Land Development Regulations and
those of other appropriate jurisdictional entities.

5. The conditional use permit must be executed and filed in the office of the City Clerk within 90
days of its date of grant by the City Council or the permit shall become null and void.
6. This permit shall become null and void if substantial construction work has not begun within one
(1) year of the date of issuance of this Conditional Use Permit. "Substantial construction work" means the
commencement and continuous prosecution of construction of required improvements ultimately finalized
at completion.

Section 2 -Land Use
1. The proposed development may contain up to i 12,000 square feet of medical/professional office
space.
Section 3 -Transportation
1. The permittee shall provide a sidewalk constructed in accordance with City standards along
Citrus Tower Blvd. and Grand Highway the length of the subject property.
2. The permittee shall dedicate right-of-way along the length of the subject property as to create 40
feet of right-of-way from the centerline of the right-of-way of Citrus Tower Boulevard and Grand Highway.
3. The permittee shall provide cross access to the property to the west. And access through the site
from Citrus Tower Blvd. in the north to Grand Highway in the east.
4. In the event Lake County does not make the improvements to Citrus Tower Blvd. the permittee
shall re-construct the section of Citrus Tower Boulevard from just east of the driveway on Citrus Tower
Blvd. west to a point where the road tapers back to two lanes. The section of roadway to be constructed
is a four lane section including east and west bound travel lanes, turn lane and eastbound right decel into
the site as agreed upon by Lake County, the City of Clermont, and the permittee/developer and as shown
on the conceptual site plan.
5. A northbound left turn lane from Grand Highway into the subject property shall be constructed.
6. The permittee/developer shall construct Hunt St. from U.S. 27 to Grand Highway prior to the
issuance of a Certificate of Occupancy for the third building.
7. The permittee/developer shall construct a southbound decel lane from Grand Highway onto Hunt
St. at the time of Hunt St. construction.

8. Cross access between Lots 4 and 5 and the Conditional Use Permit property shall be provided if
deemed necessary by the City.
Section 4 - Site development , utilities, and landscaping
1. The water system shall be looped connecting on Citrus Tower Blvd. and Grand Highway.
2. Landscaping for Phase II of the project shall be in conformance with the Land Development
Regulations as adopted at the time of site review of Phase II.
Section 5 — Commitment to adjoining property owner
1. In the event the existing Hunt Street right of way is vacated the southern half of the right of way
shall be dedicated to the property owner to the south.
2. The roadway connecting the property to the south with the realigned Hunt Street, shall be
constructed by the Permittee /Developer at the time of Hunt Street construction unless otherwise agreed
to by the City and the property owner to the south.
IP 3. Utilities for the Clermont Professional Center shall be designed and sized so as to accommodate
the needs of the property to the south.
