R-01-1233City of Clermont RESOLUTION NO. 1233 Page 1 • A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, SUPPORTING EXTENSION OF LAKE COUNTY'S ONE-CENT INFRASTRUCTURE SALES SURTAX. WHEREAS, The City of Clermont, Florida, is actively involved in community issues in Lake County; and, WHEREAS, Section 212.055(2), Florida Statutes, authorized the governing authority in each county to levy a one percent (one-cent) local government infrastructure sales surtax (hereinafter "Sales Surtax") upon taxable transactions occurring within the county as provided in Section 212.054, Florida Statutes; and, WHEREAS, Section 212.055(2), Florida Statutes, provides that the levy of the Sales Surtax shall be pursuant to an odinance enacted by the Board of County Commissioners of the county and approved by a majority of the electors of the county voting in a referendum on the Sales Surtax; and, • WHEREAS, proceeds from the Sales Surtax and any interest accrued thereto, are required by Section 212.055(2), Florida Statutes, to be used to finance, plan and construct needed infrastructure; and, WHEREAS, on August 18, 1987, the Lake County Board of County Commissioners adopted Ordinance 1987-9 which levied the Sales Surtax for a period of fifteen (15) years, beginning January 1, 1988, subject to voter referendum; and, WHEREAS, on November 3, 1987, the levy of the Sales Surtax for an initial fifteen (15) year period was approved by a majority of those voting on the question in the special election; and, WHEREAS, the November 3, 1987 approved Sales Surtax is scheduled to expire at midnight on December 31, 2002; and, WHEREAS, Section 212.055(2), Florida Statutes, authorized the Lake County Board of County Commissioners to extend the levy of the Sales Surtax pursuant to an ordinance and subject to approval of a majority of the electors of Lake County voting in a referendum on the Sales Surtax; and, Resolution No. 1233 Page 1 of 1 • • City of Clermont RESOLUTION NO.1233 Page 2 • WHEREAS, there exists a dire need on the part of Lake County, the municipalities within Lake County and the School District of Lake County to extend the Sales Surtax to finance, plan and construct various infrastructure facilities and improvements as authorized in Section 212.055(2), Florida Statutes, which planning and construction cannot be continued without an expected funding source; and, WHEREAS, the extension of the Sales Surtax would result in a one-cent sales surtax for an additional fifteen (15) years; and, WHEREAS, without extension of the Surtax many vital needs of Lake County citizens will go unmet, and property taxes and other governmental revenue sources will likely increase; NOW, THEREFORE, Be it Resolved by the City of Clermont, Florida, as follows: SECTION 1. The Recitals above are true and correct and hereby incorporated within as a part of this Resolution. SECTION 2. For the reasons expressed above, the City of Clermont supports the continuation of the sales surtax within Lake County, and hereby urges all registered voters to . support the continuation of sales surtax by voting for such continuation on November 6, 2001. SECTION 3. A copy of this Resolution shall be spread upon the minutes of this meeting and a copy delivered to the Lake County Board of County Commissioners. SECTION 4. This Resolution shall take effect immediately upon adoption.
