A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE
COUNTY, FLORIDA AMENDING CONDITIONAL USE PERMIT GRANTED AS
RESOLUTION NO. 620 TO ALLOW THE EXPANSION OF A CONVENIENCE STORE
INTO AN EXISTING SECOND BUILDING, LOCATED IN THE C-1 LIGHT
COMMERCIAL DISTRICT.
WHEREAS, the Planning and Zoning commission of the City of
Clermont, Lake County, Florida at a meeting held November 3,
1992, recommended approval of the amendment to Conditional Use
Permit granted as Resolution No. 620 to allow the expansion of a
convenience store into an existing second building, located in
the C-1 Light Commercial District at the following location:
677 West Highway 50
The City Council deems it advisable in the interest of the
general welfare of the city of Clermont, Lake County, Florida to
grant the Conditional Use Permit;
NOW THEREFORE BE IT RESOLVED by the City Council of the City
of Clermont, Lake County, Florida that:
SECTION 1.
The application for the amendment to Conditional Use Permit
granted as Resolution No. 620 to allow the expansion of a
convenience store into an existing second building, located in
the C-l Light Commercial District be granted subject to the
following conditions:
1. The property must be developed in substantial accordance
with an approved site plan.
2. If, at a future date, parking at this site proves inade-
quate, the applicant understands and agrees that the City may
require additional parking or rescind this Conditional Use
Permit.
3. No further expansion of the use or additions to this
facility shall be permitted except as approved by another
Conditional Use Permit.
4. All applicable rules and regulations shall be met, including
final site plan approval, landscaping, drainage, parking and sign
regulations, and all yard setbacks. All required landscaping
must be served with a permanent irrigation system and must be
properly maintained. The drainage and stormwater retention
requirements of the appropriate regulatory agencies must be met,
and approved by the City Engineer. These areas must be properly
maintained.
5. This property may be used as a convenience store only. No
other business operation may be conducted from this facility,
except as approved by another conditional use permit.

6. A landscape hedge shall be placed along the western and
eastern boundaries of the property and along the southern
boundary where a landscape hedge does not exist.
7. A five (5) foot landscape buffer adjacent to the sidewalk
areas on each side of the western entrance from Highway 50 shall
be provided. Removal of a 5' strip of asphalt for this landscape
buffer will be required.
8. The perimeter tree requirements shall be met.
9. The existing water retention area to the south shall be
redefined and the existing disturbed areas in and around the
retention area shall be resodded.
10. The sidewalk along 7th street shall be reconstructed. The
existing curb cut from 7th street to the southwest corner of the
property shall be eliminated.
11. The final certificate of Occupancy cannot be issued until
each of the stated conditions has been met.
12. This permit shall expire if construction has not begun
within one year of the date of this Conditional Use Permit.
13. The conditions of this CUP shall be binding on the applicant
and any heirs, assigns or successors in title or interest.
14. If any of the stated conditions are violated, the applicant
understands and agrees that the City Council may revoke this
Conditional Use Permit by resolution.
