RESOLUTION
NO. 759
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE
COUNTY, FLORIDA GRANTING A CONDITIONAL USE PERMIT TO AMEND
RESOLUTION NO. 541 TO ALLOW THE PLACEMENT OF A YARD OFFICE IN THE
M-1 (INDUSTRIAL DISTRICT).
WHEREAS, the Planning and Zoning Commission of the city of
Clermont, Lake County, Florida at a meeting held July 7, 1992,
recommended approval of the Conditional Use Permit to amend
Resolution No. 541 to allow the placement of a yard office at the
following location:
LEGAL DESCRIPTION: Begin at the intersection of the northerly Right
of Way line of Minneola Avenue and the Easterly Right of Way line
of West Lake Drive, Northerly along East Right of Way 270', East
parallel to North Right of Way line of Minneola Avenue to East
boundary line of Government Lot 8, South to the North Right of Way
line of Minneola Avenue, West to the Point of Beginning, Section
23, Township 22, Range 25.
GENERAL LOCATION:
Northeast corner of Minneola Avenue and West
Lake Drive (11th Street)
The City Council deems it advisable in the interest of the general
welfare of the City of Clermont, Lake County, Florida to grant the
Conditional Use Permit;
NOW THEREFORE BE IT RESOLVED by the City Council of the City
of Clermont, Lake County, Florida that:

The application for a Conditional Use Permit to amend
Resolution No. 541 to allow the placement of a yard office in the
M-1 (Industrial District) be granted subject to the following
conditions:
1. The property shall be developed in substantial accordance with
an approved site plan.
2. All applicable jurisdictional entity regulations shall be met,
including but not limited to, final development plan approval,
landscaping, stormwater abatement, drainage, parking and
signage.
3. No further expansion of the use or additions to this facility
shall be permitted except as approved by another Conditional
Use Permit.
4. This facility may be used as a yard office for employee use
only. No other business operation may be conducted from this
facility.
5. All conditions stated in Resolution No. 541 shall be adhered
to.

6. Perimeter landscaping shall include a five (5) foot wide
buffer, with shrubs installed according to City standards,
trees installed along rights-of-way at a ratio of one (1) tree
for each fifty (50) feet of road frontage and along adjacent
property lines at one (1) tree for every seventy-five (75)
feet along property lines. All required landscaping shall be
served with a permanent source of irrigation and state
mandated back-flow prevention devices. All landscaped areas
shall be properly maintained in accordance with City standard.
7. The drainage and stormwater abatement requirements of the
jurisdictional regulatory agencies shall be met and approved
by the city Engineer. Permits appropriate to the proposed use
and site must be received from all agencies prior to actual
development activity. All drainage and stormwater abatement
areas must be properly maintained.
8. Off street parking requirements shall be met in conformance
with adopted City standards including but not limited to
number, size, and buffering criteria.
9. The final Certificate of Occupancy cannot be issued until each
of the stated conditions has been met.
10. This permit shall expire if construction has not begun within
one year of the date of this Conditional Use Permit.
11. If any of the stated conditions are violated, the applicant
understands and agrees that the City Council may revoke this
Conditional Use Permit by resolution.
