DISTRZCT.
WHEREAS, the City Council deems it advisable in the interest
of the general welfare of the City of Clermont, Lake County,
Florida to grant this Conditional Use Permit at the following
location:
LEGAL DESCRIPTION: That part of Lots 4 through 12 of FAIRVIEW
PLACE, Plat Book 9, Page 6 and also that part of Lots 127, 128, and
129 of CLERMONT HEIGHTS, Plat Book 4, Page i as recorded in the
Public Records of Lake County, Florida, as described as follows:
Begin at the Southwest corner of the East 1/2 of Lot 10 of
aforesaid FAIRVIEW PLACE; Thence run N 89'55'01" E along the South
line of aforesaid Lots 10 and 9 for a distance of 78.86 feet:
Thence run N 0'22'49" W for a distance of 131.61 feet to a point
that is 17.50 feet south of, when measured perpendicular to, the
South line of the aforesaid Lot 129 of CLERMONT HEIGHTS, thence run
N 89'58'35" E parallel with the South line of the aforesaid Lot 129
for a distance of 25.00 feet; thence run N 0'22'49" W parallel to
the West line of said Lot 129 for a distance of 78.84 feet; thence
run N 45'22'49" W for a distance of 35.36 feet to the West line
said Lot 129; thence run N 0'22'49" W along the West line of said
Lot 129 for a distance of 107.74 feet to the South right-of-way
line of Almond Street; thence run S 89'59'59" W along the South
right-of-way line of Almond Street for a distance of 210.19 feet to
the Northwest corner of the aforesaid Lot 127 of CLERMONT HEIGHTS;
thence run S 00'23'38" E along the West line of said Lot 127 and
the West line of the aforesaid Lot 12 of FAIRVIEW PLACE for a
distance of 343.34 feet to the Southwest corner of said Lot 12;
thence run N 89'55'01" E along the South line of aforesaid Lots 12,
11 and 10 of FAIRVIEW PLACE for a distance of 131.24 feet to the
Point of Beginning. CONTAINING 1.708 acres, more or less, and
being subject to any easements or rights of way of record.
NOW THEREFORE BE IT RESOLVED by the City Council of the City
of Clermont, Lake County, Florida that:
SECTION 1.
The application for a Conditional Use Permit to allow the
construction of a two-story office complex with integrated parking,
ingress/egress and water retention in the R-3 Residential/
Professional District and the C-2 General Commercial Business
District:
1. The property must be developed in substantial accordance with
an approved site plan.
2. If, at a future date, parking at this site proves inadequate,
the applicant understands and agrees that the City may require
additional parking or rescind this Conditional Use Permit.

3. No further expansion of the use or additions to this facility
shall be permitted except as approved by another Conditional Use
Permit.
4. Ail applicable rules and regulations shall be met, including
final site plan approval, landscaping, drainage, parking and sign
regulations, and all yard setbacks. Ail required landscaping must
be served with a permanent irrigation system and must be properly
maintained. The drainage and stormwater retention requirements of
the appropriate regulatory agencies must be met, and approved by
the City Engineer. These areas must be properly maintained.
5. The applicant shall provide either a letter of authorization
from SunBank for legal utilization of their property if a combined
Conditional Use Permit is to be implemented or proof of purchase of
the SunBank property if single entity development of the site is to
occur.
6. In conformance with Policies 2-5 and 2-8 of the Transportation
Element of the adopted City Comprehensive Plan, the applicant shall
dedicate a ten (10) foot wide strip of land the length of the
applicants property along Disston Avenue to meet designated
collector street width requirements.
7. In conformance with Policy 2-8 of the Transportation Element
of the adopted Comprehensive Plan the applicant shall provide
necessary road improvements such as but not limited to:
a. Turn lanes at each entrance to the site.
b. Pro rata share of additional road drainage improvements.
c. Pro rata share of'additional road engineering costs.
d. Pro rata share of additional road transportation studies.
e. Pro rata share of traffic sign or traffic light
improvements.
8. The applicant shall meet all City requirements related to
setbacks (25 feet from each right-of-way frontage, 12 feet side
yard), buffer and stormwater abatement.
9. The final Certificate of Occupancy cannot be issued until each
of the stated conditions has been met.
10. This permit shall expire if construction has not begun within
one year of the date of this Conditional Use Permit.
11. If any of the stated conditions are violated, the applicant
understands and agrees that the City Council may revoke this
Conditional Use Permit by resolution.
