R-90-700• CITYOF CLERMONT RESOLUTION NO. 700 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA GRANTING A CONDITIONAL USE PERMIT TO OPERATE A PRE- SCHOOL IN THE C-2 GENERAL COMMERCIAL BU$INE$8 DISTRICT. WHEREAS, the Planning and Zoning Commission of the City of Clermont, Lake County, Florida at a meeting held December 4, 1990, recommended approval of the Conditional Use Permit to allow the operation of a Pre-School in the C-2 General Commercial Business District at the following location: PROPERTY: Lot 8 and 9 of City Block 90 LOCATION: 885 W. Desoto Street The City Council deems it advisable in the interest of the general welfare of the City of Clermont, Lake County, Florida to grant the Conditional Use Permit; NOW THEREFORE BE IT RESOLVED by the City Council of the City of Clermont, Lake County, Florida that: SECTION 1. The application for a Conditional Use Permit to allow the operation of a Pre-School in the C-2 General Commercial Business District be granted subject to the following conditions: 1. The property must be developed in substantial accordance with an approved site plan. 2. If, at a future date, parking at this site proves inadequate, the applicant understands and agrees that the City may require additional parking or rescind this Conditional Use Permit. 3. No further expansion of the use or additions to this facility shall be permitted except as approved by another Conditional Use Permit. 4. All applicable rules and regulations shall be met, including final site plan approval, landscaping, drainage, parking and sign regulations, and all yard setbacks. All required landscaping must be served with a permanent irrigation system and must be properly maintained. The drainage and stormwater retention requirements of the appropriate regulatory agencies must be met, and approved by the City Engineer. These areas must be properly maintained. 5. The first story of the building shall be used for two residential units. The second story shall be used for a pre-school facility. 6. All of the improvements required by the Fire Marshall must be met prior to issuance of a certificate of occupancy. 7. All of the requirements of other regulatory agencies concerning day care or pre-school facilities must be met. All required improvements must be completed prior to a certificate of occupancy for the requested use. 8. Standard sidewalk shall be constructed along Desoto Street. • • CITY OF CLERMONT RESOLUTION NO. 700 9. A minimum of six off-street parking spaces must be provided. Permeable parking may be provided on the condition that all parking spaces be filled with wood chips or a similar material approved by the Building Department and properly maintained. All such spaces must be delineated with an approved material such as railroad ties. The driveway into the parking areas must be at least 12 feet in width and paved. The applicant understands that the City may require impermeable parking in the future if permeable parking proves inadequate. The existing driveway on Desoto Street shall be used only for parking of the residence at 801 West Avenue. 10. The existing residence at 801 West Avenue may be used as a combined residence and office, as long as all City Building and Zoning Codes are met. Any expansion of the home or office will require an amendment to the Conditional Use Permit. 11. The final Certificate of Occupancy cannot be issued until each of the stated conditions has been met. 12. This permit shall expire if construction has not begun within one year of the date of this Conditional Use Permit. 13. If any of the stated conditions are violated, the applicant understands and agrees that the City Council may revoke this Conditional Use Permit by resolution.
