RESOLUTION
No. 688
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE
COUNTY, FLORIDA GRANTING A CONDITIONAL USE PERMIT TO OPERATE AN ICE
CREAM PARLOR IN AN EXISTING STRUCTURE LOCATED IN THE C-1 GENERAL
COMMERCIAL DISTRICT.
WHEREAS, the Planning and Zoning Commission of the City of
Clermont, Lake County, Florida at a meeting held July 3, 1990,
recommended approval of the Conditional Use Permit to operate an
ice cream parlor in an existing structure located in the C-1
General Commercial District following location:
677 West Highway 50
The City Council deems it advisable in the interest of the general
welfare of the City of Clermont, Lake County, Florida to grant the
Conditional Use Permit;
NOW THEREFORE BE IT RESOLVED by the City Council of the City
of Clermont, Lake County, Florida that:
SECTION 1.
The application for a Conditional Use Permit to operate an ice
cream parlor in an existing structure located in the C-1 General
Commercial District following location:
1. The property must be developed in substantial accordance
with an approved site plan.
2. If, at a future date, parking at this site proves inade-
quate, the applicant understands and agrees that the City
may require additional parking or rescind this
Conditional Use Permit.
3. No further expansion of the use or additions to this
facility shall be permitted except as approved by another
Conditional Use Permit.
4. All applicable rules and regulations shall be met,
including final site plan approval, landscaping,
drainage, parking and sign regulations, and all yard
setbacks. All required landscaping must be served with
a permanent irrigation system and must be properly
maintained. The drainage and stormwater retention
requirements of the appropriate regulatory agencies must
be met, and approved by the City Engineer. These areas
must be properly maintained.
5. A landscape hedge shall to be placed along the western
and eastern boundaries of the property and along the
southern boundary where a landscape hedge does not exist.

6. A five (5) foot landscape buffer adjacent to the sidewalk
areas on each side of the western entrance from Highway
50 shall be provided. Removal of a 5' strip of asphalt
for this landscape buffer will be required.
7. The perimeter tree requirements shall be met.
8. The existing water retention area to the south shall be
redefined and the existing disturbed areas in and around
the retention area shall be resodded.
9. The sidewalk along 7th Street shall be reconstructed.
The existing curb cut from 7th street to the southwest
corner of the property shall be eliminated.
10. This property may be used only as an Ice Cream Parlor.
11. This permit shall expire if construction has not begun
within one year of the date of this Conditional Use
Permit.
