MINUTES
REGULAR COUNCIL MEETING
December 14, 2010
The Clermont City Council met in a regular meeting on Tuesday, December 14, 2010 in the Council
Chambers at City Hall. Mayor Turville called the meeting to order at 7:00 pm with the following Council
Members present: Council Members Mullins and Goodgame. Other City officials present were: City
Manager Saunders, City Attorney Mantzaris and City Clerk Ackroyd.
Council Members Hogan and Van Wagner were absent.
INVOCATION
Council Member Mullins gave the invocation followed by the Pledge of Allegiance.
Mayor Turville announced Groveland City Manager Dolly Miller and Mayor Mike Radzik were present.
Mayor Turville reported on a change to the agenda. Item 7 has been requested to be tabled to the next
meeting.
Item No. 7 — Variance Request Leslie Jerrard
Council Member Goodgame moved to table item 7 to January 11, 2011; seconded by
Council Member Mullins. The motion passed with all members present voting "aye ".

written; seconded by Council Member Mullins. The motion passed with all members
present voting "aye ".

RECOGNITION
Fire Chief Bishop introduced Dr. Paul Banerjee. He recognized Ty Chapel and Wayne Nichols for
receiving the Superior Achievement Award from Dr. Paul Banerjee, Medical Director with Lake Sumter
Emergency Medical Services.
PUBLIC COMMENTS
Wally Herda thanked the city for the lights along Montrose Street. He questioned why there are not any
Christmas lights by the Police Department. City Manager Saunders explained the next phase of the street
scape project will include additional electrical outlets to the Police Department.
Ralph Hopkins, 200 Nautica Mile Drive, proposed to name the waterfront pavilion the Harry Nickell
Waterfront Park Pavilion. He read a letter aloud and distributed to the Council. Kathy Kyle, Diane Travis,
Lacey Nickell, David Pichello, Graham Partain, 11014 Crescent Bay Blvd., David Stoloway and Jeff
Barrett spoke in support of the request.

Cuqui Whitehead disagreed with this request.
Mayor Turville noted this item will be placed on a future agenda for the Council to consider the request.
He suggested staff advertise to entertain proposals for the naming of the facility.
Wally Herda suggested allowing the citizens to vote on the naming.
Mayor Turville stated the city will properly advertise and everyone will be invited to participate.
Tim Murry, 574 E. Desoto Street, thanked the city for taking care of the graffiti and requested the city
follow up on the Shuffleboard Court.
Nancy Fullerton, 368 Montrose Street, commented on the Christmas lights on Montrose Street.
REPORTS
City Manager Saunders reminded Council the next scheduled meeting of December 28 has been
cancelled. Also, a workshop has been scheduled immediately following this Council meeting.
City Attorney Mantzaris — No Report
Council Member Goodgame thanked City Engineer Richardson for her involvement with the Summit
Greens lawns. Also, he thanked Fire Chief Bishop and the Fire Department for the recognition received.
Council Member Mullins thanked city staff for their involvement with the annual holiday parade. He also
reported on the League of Cities meeting held last week in regards to discussions on Home Rule.
Mayor Turville noted several business owners were very pleased with the Christmas parade and thought it
was the best one yet.
CONSENT AGENDA
Mayor Turville advised the next item on the Agenda for consideration was the Consent . Agenda and
requested anyone wishing to have any item pulled for discussion to please come forward at this time.

Item No. 4 — Grant Opportunity Request authorization to apply for a grant
from Firehouse Subs Public Safety
Foundation in the amount of $5,389.79 for
assistance with the purchase of a Bullex
Intelligent Fire Extinguisher Training
Program
Council Member Goodgame pulled items 2 and 4 from the consent agenda.
Council Member Mullins moved to approve the consent agenda items 1 and 3; seconded
by Council Member Goodgame. The motion passed with all members present voting
"aye
Item No. 2 — Council Member Goodgame moved that the PA system not operate before Sam or after 6pm;
seconded by Council Member Mullins. The applicant noted they will not begin until 8:30am and will not
be using the full system.
Council Member Goodgame withdrew the motion and moved to approve item 2 as
written; seconded by Council Member Mullins. The motion passed with all members
present voting "aye ".
Item No. 4 — Council Member Goodgame asked Fire Chief Bishop to explain the grants. Chief Bishop
requested approval to apply for a grant from Firehouse Subs Public Safety Foundation.
Council Member Goodgame moved for the approval of item 4; seconded by Council
Member Mullins. The motion passed with all members present voting "aye ".
NEW BUSINESS
Item No. S - Variance Request Advanced Imaging
Planning and Zoning Director Hitt presented the variance request. The request is to allow a temporary 12
month exterior use for a mobile MRI unit rather than within a completely enclosed building. It will be
located in the parking lot at 262 Mohawk Road. Staffs review found only one with a negative finding. In
accordance with the code requirements, staff must recommend denial of the variance request for a
temporary 12 month variance for a 53 foot mobile MRI unit.
Mike Gallaher, Esq., was present on behalf of the applicant requesting approval. This is a temporary
matter and plans to move into a permanent building.
Mayor Turville opened the public hearing.

Council Member Mullins stated if parking becomes, the mobile unit will need to be removed. He
recommended changing the word "Will" to "May ". Also, he requested temporary/portable landscaping
such as potted trees to be placed in the front and side of the unit to look more attractive.
Council Member Goodgame moved for the approval of No. 5 with the 5 stipulations,
changing the word "Will" to "May" and for temporary landscape around the trailer;
seconded by Council Member Mullins. The motion passed 2 to 1 with Mayor Turville
opposing.
Item No. 6 — Resolution No. 2010 -28 Mad Melon Restaurant
Mayor Turville read Resolution 2010 -28 aloud by title only.
A Resolution of the City Council of the City of Clermont, Lake County, Florida, granting
a Conditional Use Permit to allow a restaurant in the CBD Central Business District.
Planning and Zoning Director Hitt presented the request for a restaurant located at 658 West Avenue.
Staff recommended approval.
Applicant Irma Nyack was present requesting approval.
Mayor Turville opened the public hearing.

Council Member Mullins supported the request.
City Manager Saunders noted the applicant would have to obtain a new Certificate of Occupancy.
Council Member Mullins moved for the adoption of Resolution 2010 -28; seconded by
Council Member Goodgame. The motion passed with all members present voting "aye ".
Item No. 8 — Ordinance No. 2011-01-M Introduction
Mayor Turville read Ordinance 2011-01M aloud by title only.
An Ordinance of the City of Clermont, Lake County, Florida, amending the
comprehensive plan of the City of Clermont, Florida, pursuant to the Local Government
Comprehensive Planning Act, Chapter 163, Part II, Florida Statutes by adopting text
changes to the goals, objectives and policies of the Capital Improvements Element of the
Comprehensive Plan; setting forth the authority for adoption of the comprehensive plan
amendments; setting forth the purpose and intent of the comprehensive plan amendments;
establishing the legal status of the comprehensive plan amendments; providing for
severability, conflict and an effective date.
