The Agreement is referenced herein as though set forth in full. WHEREAS, the CITY and the ENGINEER desire to enter into a Written Amendment for Task Order Number 03. (ENGINEER). The City of Clermont was issued a Consumptive Use Permit (CUP) #2478 on September 10, 2002, for a 20 -year duration, along with 54 Conditions of Issuance. The water allocations for CUP #2478 are subdivided into the East and West Service Areas and have specific targets and a drastic 51% "Step" reduction in the year 2013 from 7.378 -mgd to 3.776 -mgd. The following is the timeframe of the CUP renewal application. • In January 2007, ENGINEER on behalf of the CITY submitted the CUP modification application to the St. Johns River Water Management District (SJRWMD). • In February 2007, SJRWMD responded with Request for Additional Information #1 (RAI #1) totaling twenty -six (26) comments with particular focus on confirming population projections with the SJRWMD's population projection consultant (GIS Associates). ENGINEER received the confirmed population projections from GIS Associates in December 2007 and then submitted the response to RAI #1 in January 2008. • In February 2008, SJRWMD responded with RAI #2 totaling twenty-four (24) comments with focus on the CITY's East and West Service Areas projected water use reductions per capita and projected water supply sources limiting additional groundwater withdrawal beyond 2013. ENGINEER reformatted projections to show per capita reductions and received SJRWMD concurrence in December 2008. ENGINEER submitted the response to RAI #2 in January 2009. • In February 2009, SJRWMD responded with RAI #3 totaling eight (8) new additional comments with focus on demonstration of need and water conservation. ENGINEER submitted the response to RAI #3 in June 2009. • In June 2009, SJRWMD responded with RAL #4 totaling six (6) new additional comments with focus on demonstration of need, water conservation and environmental resource impacts. ENGINEER submitted the response to RAI #4 in April 2010. • In June 2010, SJRWMD responded with RAI #5 totaling thirteen (13) new additional comments with focus on demonstration of need, reuse, water conservation and environmental resource impacts. ENGINEER submitted the response to RAI #5 in November 2010. • In December 2010, SJRWMD responded with RAI #6 totaling fourteen (14) new comments with emphasis on the demonstration of need, reuse implementation, and environmental resource impacts. The purpose of this scope of work is to provide services to respond to RAI #6. SJRWMD requested the response be submitted by April 15 2011. Scope of Services The purpose of this scope is to provide services to respond to RAI #6. The ENGINEER and subconsultant hydrogeologist, Connect Consulting, Inc. (CCI) and surveyor, Rapid Surveying Inc., (RSI) will perform the following tasks to respond RAI #6 with the assistance from the CITY. Task 1 Project Management, Invoicing and Meetings 1.1 Prepare project status and invoicing reports (limit 2). 1.2 Prepare for and attend progress meetings with CITY to present the initial findings and progress on RAI #6 responses (limited to two (2) meetings). 1.3 Prepare for and attend progress meetings with SJRWMD to present the initial findings and progress on RAI #6 responses (limited to two (2) meetings). Task 2 Response to RAI #6 Comments SJRWMD issued fourteen (14) RAI comments associated with three (3) areas of concern. Table 1 presents the RAI comment and responsible party for addressing each area of concern for RAI #6. The following tasks are relative to each area of concern: Demonstration of Need 2.1 Create a summary table for Table 2 Projected Water Use and Supply similar to the table provided by the District. (AECOM) Reuse 2.2 Provide reclaimed water implementation schedule that includes golf courses. (AECOM) Environmental and Resource Impacts 2 3 Confirm and submit new model files to the District. (CCI, Included in Task 2.14) 2.4 Update public supply landscape irrigation for subdivisions not expected to receive reclaimed water by 2013 in model. (CCI, Included in Task 2.14) 2.5 Revise the "Recharge Calcs Table" in recharge package for 2013. (CCI, Included in Task 2.14) 2.6 Corroborate Recharge Calcs Table, and CITY's RIB application rates with the City's projected water use for 2013. (CCI) 2 7 Confirm the proposed withdrawal rate for Well #33694 and revise model for 2013 and water use projection tables accordingly (CCI, Complete) 2.8 Provide a summary of flux changes across the western boundary of the SJRWMD ECF Model. (CCI, Complete) 2.9 Summarize the CITY's existing wetland and surface water monitoring data in order to assist the CITY to provide assurances that there have been no adverse impacts to surface waters and wetlands as a result of the current permitted withdrawals. 2.9.1 Update the stage duration curves for the six locations where hydrologic monitoring data is collected by the CITY. (ENGINEER) 2.9.2 Compare ecological indicators of long term hydrology with the stage duration curves at each of the six (6) monitoring locations to evaluate if current groundwater withdrawls have resulted in observable impacts. ENGINEER will establish a transect at each monitoring site and locate the elevations of visible ecological indicators along the transect. Elevations will be located by a licensed surveyor (RSI). The ecological indicators may include: cypress inflection points, adventitious roots, water stain lines, edge of saw palmetto line, top of organic soils 6" in depth, top of organic soil 16" in depth, top of moss collars, and lower edge of lichen lines. Not all indicators may be present at all sites. (RSI/ENGINEER) 2.10 Investigate the CITY's six (6) existing piezometers to determine if wells were constructed deep enough to measure low water levels or if new wells need to be constructed to document low water levels. Specifically, well construction reports provided by the CITY will be compared with the water level data from groundwater monitoring wells: Jacks Lake (2478 -PZ3), Lake Apshawa (2478 - PZ4), Lake Felter (2478 -PZ5), US27 South (2478 -PZ6). (CITY/ENGINEER) 2.11 Conduct a Wetland and Surface Water Impact Analysis to assist the CITY to provide reasonable assurance that there will be no adverse impacts to surface waters and wetlands as a result of the proposed withdrawals for the permit duration for two scenarios: the City Only and the Cumulative. This analysis is largely a desk top exercise using GIS databases and existing literature. Tasks include: 2.11.1 Figures depicting drawdown in the surficial aquifer based on the CITY's proposed withdrawals alone using contour intervals of 0.2 -foot (starting at 0.1). Scale figures to focus on the CITY's zone of influence and relevant landscape features. (CCl/ENGINEER) 2.11.2 Figures depicting cumulative drawdown in the surficial aquifer based on the CITY's proposed withdrawals plus permitted and pending withdrawals using contour intervals of 0.2 -foot (starting at 0.1). Scale figures to focus on the CITY's zone of influence and relevant landscape features. (CCl/ENGINEER) 2.11.3 Figures depicting the City Only and the cumulative drawdowns in the surficial aquifer overlaid on a base map depicting wetlands /surface waters within CITY's zone of influence. (CCl/ENGINEER) 2.11.4 Assessment of potential impact to wetlands /surface waters in the CITY' s zone of influence due to the CITY's withdrawals only and due to cumulative groundwater model withdrawal. The assessment will include descriptions of wetland / surface water habitats, based on the soils, vegetation, and hydrology, and an assessment for the potential level of harm for each system. (ENGINEER) 2.11.5 The wetland/surface water assessment will include an assessment of the current monitoring plan, and will evaluate the need for additional monitoring sites. (ENGINEER) 2.12 Assist the CITY to explain how the CITY will minimize potential impacts to surface waters and wetlands during the duration of the permit. ENGINEER will assist the CITY describe the current proposed withdrawal schedules and how to reduce impacts. (CITY/ENGINEER) 2.13 Revise drawdown data for lakes with established MFL based on revised model including: a) List MFL water bodies in Lake, Orange and Seminole Counties (CCI) b) Cumulative Drawdown (CCI) c) Drawdown Limit (CCI) d) Percent Contribution of Project Only drawdown to Cumulative drawdown (CCI) 2.14 Revise model data for springs with established minimum flows or screening levels including: a) List springs included in the ECF model (CCI) b) Estimated actual annual 1995 flow(CCI) c) Simulated 1995 flow as reported by the SJRWMD (CCI) d) Simulated flow for modeled scenarios (City Only, Cumulative) (CCI) e) Difference and percent difference in simulated flow as compared to simulated 1995 flow (CCI) f) Minimum flow or screening flow (CCI) Task 3 Prepare Response Letter to RAI #6 Comments 3.1 Prepare draft letter response for RAI #6 for QC review prior to submittal to SJRWMD. 3.2 Submit final letter response for RAI #6 to SJRWMD. 3.3 Prepare for and attend a strategy meeting with CITY to review and strategize response for RAI #7 (if needed). CITY'S RESPONSIBILITIES The CITY will provide the information and services described in Table 1. • Access to monitoring locations. • Copies of monitoring well construction reports, survey, and stage data. The ENGINEER will be entitled to rely upon the above direction, information, and documents provided by the CITY without independent review or verification. SERVICES NOT INCLUDED The following sections will be excluded from the RAI #6 response until the SJRWMD concurs with the projected demands. At that time, the CITY shall direct the ENGINEER that the excluded sections are to be added to the scope of work and additional compensation for the excluded sections will be determined. 1. Wetland or other field investigations not described in this scope. 2. Specific wetland or surface water mitigation plans. 3. Review of alternative sources of potable water. Should the District request the CITY to pursue alternative water (such as a supplemental surface water supply for potable water use), the work will be completed by a separate scope of services as an Additional Service. 4. No budget included for future RAIs. 5. Permitting fees DELIVERABLES The ENGINEER will submit four (4) signed and sealed response letters to RAI #6 and supplemental information to the SJRWMD on behalf of the CITY. It is anticipated that a response letter to RAI #6 will be prepared and submitted within 120 days from Notice To Proceed (NTP), assuming timely delivery of CITY's data. ENGINEER will observe the time limitations; however, should there be delays in receiving information from others and in obtaining subsequent authorization, approvals, and review comments from the CITY, and other governmental agencies, the schedule will be updated and adjusted as mutually agreed upon by ENGINEER and CITY. ENGINEER shall not be responsible for delays that occur as the result of action or inaction of CITY or others. COMPENSATION This Scope of Services establishes a total not -to- exceed cost of $52,850 for services described herein. This fee was determined based on the assumptions presented herein and in the attached Project Budget. The fee breakdown is apportioned in Project Budget (Exhibit 1). Progress payments shall be due and payable on a monthly basis. SUBCONSULTANT Hydrogeologic modeling services are to be provided by Connect Consulting, Inc (CCI). ENGINEER survey will be provided by Rapid Survey Inc, (RSI). Services to be provided by CCI and RSI are incorporated in to the scope of services budget and are presented in Exhibit 2 for reference. AUTHORIZATION This Task Order No. 03 serves as an Exhibit to the Consultant Agreement dated October 13, 2009, between the City of Clermont and AECOM Technical Services, Inc., and is hereby incorporated into this Amendment by reference.
