O-57-160 .. . , ,\ ORDINANCE No./~ 0 AN ORDINANCE ADOPTING THE FLORIDA MODEL TRAFFIC ORDINANCE,. BEING CHAPTER 57-333 OF THE LAWS OF FLORIDA, 1957. . BE IT ORDAINED AND ESTABLISHED BY THE COUNCIL OF THE CITY OF CLERMONT, FLORIDA: SECTION I: That there is hereby adopted by the City of Clermont that certain ordinance known as the Florida Model Traffic Ordinance, being Chapter 57-333, Laws. of Florida 1957, not less than three copies of which are now filed and have been on file for ten days in the office of'the Clerk of the City of Clermont, and said Florida Model Traffic Ordinance is hereby adopted and incorporated as fully as if set out at length herein. SECTION ll: That wherever the ,word "municipality" is used in the Florida Model Traffic Ordinance it shall be held to mean the City of Clermont. SECTION ill: That any person violating the provisions of the Florida Model Traffic Ordinance adopted by reference in Section I of this ordinance shall be deemed guilty of a misdemeanor and punished by a fine of not less than $1.00 and not more than $300.00, or by imprisonment for a period of not less than one (1) hour nor more than sixty (60) days, or be both so fined and imprisoned. Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such hereunder. SECTION IV: If any section, .sub-section, sentence, clause, phrase or , portion of this ordinance is for any reason held invalid or unconstitutional by .. .. any Court of competent jurisdiction, such portion shall be deemed a separate distinct and independent provision and such holding shall not effect the validity of the remaining portions hereof. SECTION V: This ordinance shall take effect immediately upon its passage. SECTION VI: All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. SECTION Vll: The general traffic ordinances of this City are anti- quated, obsolete and in many instances have been amended and re-amended and are now so scattered throughout the ordinance book of the City that the public cannot ascertain their true content and the Police Department and Judge of the Municipal Court do not know which ordinances are enforceable. Therefore, this ordinance is passed as an emergency measure, and the Council does, by the vote by which this ordinance is passed, hereby declare that an emergency exists, which makes it imperative that this ordi- nance should become effective forthwith in order that the public health, welfare and safety might most effectively be provided for. - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - P ASSEDAND ADOPTED by the City Council of the City of Clermont at its Regular Meeting held ÍJ1 the City Hall in the City of Clermont :on ~.
