FOR THE CONSTRUCTION OF STREET CURBS FOR ALl"
STREETS IN THE ClTY OF CLERMONT; PROVIDING OTHER
MATTERS RELATING THERETO.

W HER EA S, the City of Clermont, by and through its City Council
and the Street Committee thereof have set up and adopted m:lnimwn standards
for the constJ:'UCtWn and 4esign of all street curbs in the City of Clermont;
and,
W HER E AS, property in said City which has been subdivided by iî:B
owners have, .before their subdivision plats have been approved by said City,
built and constructed their street curbs in conformance with said mintmllTl')
requirements; and,
W HER E AS. the said City Council find they should put said minimum
requirements Ùlto a more permanent form and make copies thereof available
to the general public. and hereby declaring an emergency to exist as possible
subdividers and requeatmg copies thereof; therefore,
BE IT ORDAINED AND ESTABLISHED BY THE CITY COUNCIL
OF THE CITY OF CLERMONT. FLORIDA:
SECTION; 1.
PURPOSE.
The purpose of these sped.fications is to e.9tablish a set of standards
for the construction of street curbs for all street pavements to he constructed
within the City Limits of the City of Clermont, or Ù1 adja.cent subdivisions
which may be annexed to the City of Clannont, Florida. It shall be the policy
of the City of Clermont to require COll.6Itruction of such street curbs to be in
accordance with these specifications until such time as these specifications
are modified or rescinded.
SECTION 11.
GENERAL.
The owner shall be responsible for'the protection of Æ'll existing
structures and all utilities encountered in the project. Any damage caused
by the owner or lús operations shall be repaired by the owner. without
cost to the City. If the street grades are such that existing water lines must
be lowered. this work will be done by the City of Clermont.
SECTION m.
OWNER.
For the purpose of these specifications the owner shall be considered
as the person. firm or corporation that is responsjble for the ('.onstruction
of the street curbs and other facilities in the development. Upon completion
....-.. of the work. and acceptance by the City of Clermont, the worl, will then become
- the property of the Oity of Clermont. whieh shall then become responsihle íur
the maintenance of the curbs, subject to other provisions as stIpulated herein.
SECTION IV.
LICENSES AND PERMITS.
The owner shall secure all required licenses and permits and comply
with allloca1, State and Federal laws, regulations. building and construe-
. tion codes. wage~and-hour laws and other applicable laws and regulations.
I SECTION V. PATENTS.
The owner shall hold and save the City and its officers. agents and
employees harmless from liabilities of any nature or kind for or. on account
of any patented or unpatented Ùlvention, process or appliance used Ùl the
performance of this contract. including its use by the City duriDg c.onsttuction
and/or on completion of the project.
SECTION VI.
INSPECTION.
The City. through its authorized representative and agents. shall be
permitted at all times to Ü1spect all work and materials.
SECTION vn.
INSPECTION AND TESTING OF MATERIALS.
Such inspection and tests of materials as may be required by these
specifications and/or customary SfSlJ1tiArd practices shall be made by testing
laboratories or agencies approved by the City. Test reports shall be furn-
ished as required. and the costs of such tests and inspections shall be bome
by the owner. AU materials that may be rejected at the site of the work shall
be segregated and removed from the site of the work.
SECTION vm.
APPLICABLE SPEOIFICATlONS.
All work to be performed under these specifications shall conform to
the requirements of all standard specifications of the City of Clermont and
to all applicable spectfiœtinns of the Florida. State Road Department. The
latest puhH..med edition of the St9.~rùrrd Specifications of the Flodda State
Road Department is made a part hereof and shall be considered as Ùlcluded
herem.
SECTION IX.
CONCRETE.
. All concrete used in the street curbs shall be ready-mix, Class "Au
concrete. Concrete shall have an average 28 day compressive strength of
not less than 3,500 pounds per square Ùlch and a minimum of 3.000 pounds
per square inch. At the City's request cyHnclAT"S shall be made and tests
run as directed by the City of Olermont, and elsewhere specified herein.
Concrete shall contaJn not less than six bags of Portland cement pe:!.' cubic
yard and shall be poured with a slump not to exceed 4 inches. Where existing
driveways occur. the owner shall install drop curb and paved apron at those
driveways.
SECTION X.
FORMS.
~ AU curbs sha1l be poured in forms. Forms shall be standard, metal
.. curb forms, properly designed for the type of curb to be poured. Forms shall
be cleaned and oiled prior to pouring the curbs. All forms shall be set true
to line and grade and sha1l be properly and adequately braced and anchored
to prevent movement during pouring and fini : hing. No abrupt changes in
nJ18J'111lent or grade will be permitted; all cl¡n1\geB shall be with long, smooth

CUI"les. The use of wooden curb forms will be permitted only with the
specific approval of the City of Clermont. .
SECTION Xl. FlNlSHING.
.. After the curb is poured, the exposed surfaces shall be finished
by worlanen skilled in this work. All sw:fa.ces shall be smooth and uniform
and final finish shall be with a wood float to produce a rough textured finish.
SECTION XII.
CURING.
Upon completion of the finishing operations, and a.s soon as it has
attained an Ù1itial set, the curb shall be protected from the elements for a.
three day curing period. During this curing period the curb shall be kept
wet and shall not be disturbed. Curing may be accomplished by covermg
the curb with sand or burlap, which shall be kept continuously wet, by cover-
ing with Sisalkraft paper or a plastic covering recommended for this purpose,
or by spraying with a covering of curing compo'ø.lnd. The me1;¡'1od and procedure
ox the curing shall be approved Ùl advance by the City.
SECTION XIn.
TYPE OF CURB:
The type of curb to be used on any paving project subject to these
specifications shall be one of three (3) types as shown on the drawing attaChed
hereto marked Drawing No.1, and made a part hereof as if fully and at large
set forth herein. The type of curb for each specific project shall be as
directed by the City of Clermont.

SECTION XlV.
CLEAN UP.
.
Upon completion of the work, the owner shall clean up the site of
his operations as required to remove all roots, trash, forms. excess
material and other debris.
SECTION XV.
FINAL INSPECTION.
When the work. or any Ùldividual section thereof, is completed, the
owner may request the City for a final inspection, which will be dmade as soon
aa practicable. All sections of the work must receive a tiDal inspection before
acceptance by the City of Clermont.
However. final Ü1spection and approval or acceptance thereof
will in no wa.y constitute approval or acceptance of the street to be or being
constructed between said curbs.
SECTION XVI.
GENERAL GUARANTEE.
Neither the final acceptance or approval of the curb as provided Ùl
Section XV above, shall constitute an acceptance of work done in accordance
with the owners plans and specifications or relieve the owner of any liability
for faulty workmanship or materials which shall appear within one (1) year
from the date of final acceptance or approval of the worl::.
In the event defects Ùl the curbs is found within said period
and same is due to faulty materials or workmanship the City shall notify the
owner Ùl writing of the abserved defects who shall remedy same within a
reasonable time at the owners expense. 1£ not so done the City shall remedy
same and the owner shall be fully liable for same and the said City shall have
a lien upon the lands of the owner enforceable as prescribed by law.
SECTION XVII.
STREET CURBS CONSTRUCTED BY
ClTY OF CLERMONT.
Nothing herein shall in any way be Ùlterpreted to allow the City of
Clermont to construct any street curbs below the minimum standars or require-
ments as required in this Ordinance.
SECTION XVIll.
VIOLATIONS.
. ,
Any person. firm or corporation violating any provisions of this
OrdinAnce shall not receive the final approval or acceptance thereof and the
City of Clermont will not assume the maintenance of same.
SECTION XIX.
SEPARABILITY.
If any section, sub-section, sentence, clause. phrase or portion of
this Ordtn¡¡nce is for any reason held inva.1id or unconstitutional by a Court
of competent jurisdiction. such portion shall be deemed a separate, distinct
and Ùldependent provision and such holding shall not affect the validity of the
reJTIAinirtg portions thereof.

SECTION XX.
DECLARATION OF EMERGENCY,
EFFECTIVE DATE, REPEAL OF
CONFLICTING ORDINANCES.
The City Council and its Street Committ.ee having heretofore prepared

minimwn constrUction requirements for all street curbs and fiDd there are
no further available copies of same and same should also be put: :into a more
permanent form so when amended or altered the public would have full
knowledge thereof; and. further finding that streets have been constructed
to conform to said requirements and some are about to be COl1structed and
that it is now necessary as an emergency that this Ordinance be passed.
Therefore. this Ordinance is, passed as an emergency
measure and the Council does, by the vote by which this Ordinance is passed.
hereby declare that an emergency eKists, which makes it imperative that this
Ordinance shall become effèctive forthwith Ù1 order that the public health.
welfare and safety might most effectively be provided for.
This OrdJnatlce shall become effective immedis,tely.
All Ordinances cr partE! of Ordinances Ùl confl.ict with this
Ordinance. or any part there,of, are hereby expressly repealed.
