AN ORDINANCE AlŒNDING ORDINANCE #157, THE SAlŒ BEING "AN ORDINANCE PROVIDING A TAX LEVY ON ALL PROPERTY IN THE CITY OF CLEIDfONT, LAKE COUNTY, FLORIDA, FOR THE YEAR OF 1957; PROVIDING A BUDGET OF EXPENSES FOR THE FISCAL YEAR OF 1957-1958 AND }1AKING APPROPRIATIONS THEREFOR" BY REDUCING THE BUDGET OF EXPENSES FOR NEW STREETS, NEW WATER }fAINS, ELnUNATING CONTINGENCY FUND AND INCREASING UNDER STREETS RE-SURFACING AND UNDER GENERAL EXPENSES INCREASING NEW EQUIP}ŒNT EQUAL TO THE AMOUNT OF REDUCTION PROVIDED HEREIN; AND PROVIDING FOR AN EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS the City Council of the City of Clermont under Ordinance #157 duly passed and,adopted October 15, 1957 provided for a tax levy on all property of the City of Clermont, Lake County, Florida for the year of 1957 and also provided therein for a Budget of Expenses for the fiscal year of 1957-1958 and made appropriations therefore, and, therein did set forth its budget for said fiscal year and under the Street Department provided for an expense for new streets in the amount of $10,000.00 and also therein provided for re-surfacing material for $5,000.00 and, under Water Department provided'for new Mains for $12,500.00 and under Administration Expenses provided for a contingency expense in the amount of $3,750.00 and under General Expenses provided for new equipment in the amount of $1,000.00; and, WHEREAS because of increases in street repairs due to excessive rains and frost damage, it is now necessary to increase the budget for the re-surfacing of the streets and in order to facilitate this re-surfacin~ and to complete same at an early date in order to prevent additional damage to the streets, additional and new equipment is necessary to be purchased; and, the Contingency Fund which was set up for the salary of a City Manager no longer necessary as the qualified voters of the City of Clermont, in ~ general election held in December 1957 voted .. against the employment of a City Manager; and, WHEREAS an emergency exists in the City of Clermont, and in order to immediately take steps to preserve the streets in said City, now in need of immediate repairs because of frost damage and excessive rains, the City Council of the City of Clermont now finds it necessary to readjust its budget by de- .. creasing certain budgeted expenses, increasing others and elim- inating one entirely as follows: Original Budgeted Expenses Amended Budgeted Expenses New Streets $10,000.00 $3,000.00 New Mains 12,500.00 8,000.00 Contingency 3,750.00 -0- New Equipment 1,000.00 8,000.00 Re-surfacing 5,000.00 13,250.00 and that it is to the best interests of property owners and tax- payers of said City that said adjustments as above outlined be immediately made; therefore, BE IT ORDAINED AND ESTABLISHED BY THE CITY COUNCIL OF THE CITY OF CLEID10NT, FLORIDA: SECTION I: That the budget of expenses, and Ordinance #157, duly passed and adopted by the City Council of the City of Clermont, on October 15, 1957 be amended to read as follows: (a) That under the Street Department, new streets be reduced from $10,000.00 to $3,000.00; that re-surfacing materials be increased from $5,000.00 to $13,250.00. (b) That under the Water Department expenses, Mains be decreased from $12,500.00 to $8,000.00. (c) That under Administration Expenses the Contin- gency Expenses of $3,750.00 be eliminated. (d) That under General Expenses new equipment be increased from $1,000.00 to $8,000.00. SECTION II: That the foregoing increases and decreases in the respective budgeted expenses and the elimination of the .. contingency expense does not increase or decrease the Budget of Expenses for the City of Clermont for the fiscal year of 1957-1958. SECTION III: That because of the damage to streets by the excessive cold weather in the month of December, 1957, .. .. and January and February of 1958, and the excessive rains in January and February of 1958, that many of the streets in the City are in immediate need of repairs in order to preserve them for the use of the general public and that in order to provide materials for the re-surfacing and preserving of these streets the alterations and changes in the Budget of Expenses und~r Ordinance #157 as set forth in Section I hereinabove is necessary as well as the purchase of new equipment for re-surfacing and the preservation of streets and therefore a state of emergency exists and this Ordinance is passed as an emergency measure, and the Council does, by the vote by which this Ordinance is passed, hereby declare that an emergency exists, which makes it imperative that this Ordinance should become effective forthwith in order that the public health, welfare, safety and the preservation of streets and capital assets of the City might most effectively be provided for and preserved. SECTION IV: All Ordinances or parts of Ordinances in conflict with the provision of this Ordinance are hereby re- pealed and especially Ordinance #157 as amended herewith. SECTION V: This Ordinance shall take effect immediately upon its passage. - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - PASSED AND ADOPTED By the City Council of the City of Clermont at its Regular Meeting held on March 18, 1958 in the City Hall of the City of Clermont.
