AN ORDINANCE DISCONTINUING AND VACATING PALM
COURT AND FRACTIONAL JUANIATA STREET, IN THE
CITY OF CLERMONT, LAKE COUNTY. FLORIDA;: PRO-
VIDING EFFECTIVE DATE HEREOF AND OTHER MATTERS
RELATING THERETO.
WHEREAS, PALM COURT, a street in Palm Gardens, a subdivision
in the City of Clermont, Lake County, Florida, and as represented on the
Map or Plat thereof duly filed and recorded in the Public Records of Lake
County, Florida, has never been opened, improved, or used by the public
and is not needed as a street or thoroughfare in said City for the reason
that said Palm Gardens and the lands lying immediately North of, abutting
and adjacent thereto, are owned by the Board of Public Instruction of Lake
County, Florida, and said lands are exclusively used by said Board in the
operation of the Clermont-Minneola High School for white students; and,
WHEREAS, the lands lying immediately North and South of, abutting
and adjacent to the East 275 feet of Juaniata Street lying West of Bloxam
Avenue and East of School Avenue (which street is East of Scott Street), as
represented on the Maps or Plats of Lincoln Park Annex and Lincoln Heights
School, respectively, subdivisions in said City, duly filed and recorded in
the Public Records of Lake County, Florida, are owned by the Board of
Public Instruction of Lake County, Florida; and that said Board is preparing
to construct a High School for colored students on said adjoining lands, and
that to continue to allow said East 275 feet of Bloxam Avenue to remain open
as a street or thoroughfare in said City would endanger the lives of the
students in said school; and,
WHEREAS, there are not utility, sewer, water, gas, or electric
lines within the right-of-way of any of said streets above described except
the said East 275 feet of Juaniata Street wherein this City has a buried water
main which it is now preparing to remove; and,
WHEREAS, the best interests of this City would be served by the
discontinuing and vacating of said above described streets, and it would be
to the best interests, general welfare and safety of the students in each of
said schools that the said streets be discontinued and vacated, now, therefore,

BE IT ORDAINED AND ESTABLISHED BY THE CITY COUNCIL OF
THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA:
SECTION I: That Palm Court, a street in Palm Gardens, a
subdivision in the City of Clermont, and as represented on the Map or Plat
thereof, duly filed and recorded in the Public Records of Lake County,
Florida, be, and the same is hereby, discontinued and vacated; and, that

all lands within the right-of-way of said Palm Court shall revert in fee
simple, in equal proportions to the owners of the real property lying
adjacent and abutting thereto.
SECTION II: That the East 275 feet of Juaniata Street lying West
of Bloxam Avenue and East of School Avenue (which street is East of Scott
Street), as represented on the Maps or Plats of Lincoln Park Annex and
Lincoln Heights School, respectively, subdivision in the City of Clermont,
Florida, as filed in the Public Records of Lake County, Florida, be, and
the same is hereby discontinued and vacated; and, that all lands within
the right -of-way of said East 275 feet of Juaniata Street shall revert in fee
simple in equal proportions to the owners of the real property lying adjacent
and abutting thereto.
SECTION III: That a copy of the Resolution adopted by the City
Council of this City on November I, 1960, Proof of Publication of Notice,
as published in the Clermont Press on November 3 and 10, 1960, and
this Ordinance, duly certified to by the City Clerk of the City of Clermont,
shall be recorded in the Public Records of Lake County, Florida; and, when
so recorded will, in every respect, operate as a conveyance in fee simple
of the lands within the right-of-way of said above described streets, in
equal proportions to the owners of the real property lying adjacent and abutt-
ing to said respective streets above described.
SECTION IV: That the City Council of the City of Clermont finds
it necessary to declare the passage of this Ordinance to be an emergency
measure and, therefore, same shall become effective immediately upon its
passage and approved by the Mayor of this City.

PASSED AND ADOPTED by the City Council of the City of Clermont,
Lake County, Florida, at its Adjourned Regular Meeting held on December
