O-53-117 ORDINANCE NO. //7 . AN ORDINANCE PROVIDING FOR THE ISSUING OF DUPLICATE TAX SALE CERTIFICATES HERE- TOFORE ISSUED OR HEREAFTER ISSUED BY THE CITY OF CLERMONT, WHICH CERTIFICATES HAVE BEEN LOST OR DESTROYED; PROVIDIf\\3 FOR BONB INDEMNIFYING THE CITY OF CLERMONT FOR LœS; PROVIDING FOR OTHER MATTERS RELATING THERETO. BE IT ORDAINED BY THE CITY CCUNCIL OF THE CITY OF CLERMONT I FLORIDA, AS FOLLOWS: WHEREAS, from time to time owners of tax sale certificates representing delinquent taxes levied and assessed by the City of Clermont and lost by the ownes thereof request the issµing of duplicates thereof and/or owners of certificates are requesting the City to cancel same of record or purchasers of property and/or owners are desiring to redeem said certificates and there is no provision under the general ordinances of the City of Clermont providing for the manner and form for application of dup~ate certificates and providing for indemnifying the City against loss of the original lost or destroyed tax certificate if same has been assigned to some other person other than the original purchasers of same; therefore Section 1. That hereinafter any owners of a tax sale certi- ficate regularly sold by the City of Clermont covering delinquent taxes for any year prior or subsequent hereto or his or her assignee thereof shall be entitled to the issuance of a duplicate ~ax sale certificate upon application to the City Clerk of the City of Clermont which application shall describe the certificate by number and year issued and the amount of the original face value thereof; shall provide that the certificate or any interest therein has not been sold or . transferred or assigned to anyone for a valuable consideration; and that the certificate has been lost or destroyed and diligent search does not reveal same; and if duplicate is issued thereof that if the original is found it will be returned to the City for cancellation. That said application shall embrace therein a bond to be signed by the applicant as principal thereof together with two sureties which sureties shall be residents of the City of Clermont and/or Lake County, State of Florida, in double the amount of the original · .~ face value of the certificate and shall provide that said prin- cipal and sureties shall jointly and severally bind themselves, their heirs, executors and administrators, for the payment thereof if said certificate should be presented to the city of Clermont by any person whomsoever, assigned or otherwise, for payment or applic- ation for tax deed thereon. That said application shall be approved at any regular or special meeting of the City Council of the City of Clermont or adjourned meeting thereof and that said application shall further provide therein for the applicant to appoint the City Clerk of the City of Clermont as his or her attorney in fact for the purpose of signing same as said attorney in fact to effect the'cancellation of said certificate on the tax sale records of the City of Clermont. 2. That said application for duplicate tax sale certificate and/or cancellation thereof shall be in form as follows: . . section 3. NOTICE OF INTENTION TO APPLY FOR LOCAL OR SPECIXL LEGISLATION NOTICE is hereby given that application will be made to the 1953 Legislature of the State of Florida for the passage of a special or local law providing in effect for the amendment of the charter of the City of Clermont to provide for the appointment of a city tax assessor instead of the annual election of a city tax assessor and authorizing the city tax assessor to employ any person, firm or corporation to assist in the annual assessment of all property in the City of Clermont, Florida.
