O-53-118 ORDINANCE NO. 118 . AN ORDINANCE PERMANENTLY CLOSING AND VACATING HIBISCUS STREET LYING NORTHERLY OF SUNNYSIDE DRIVE AND SOUTHERLY OF HIGHLAND AVENUE, ALL _ ACCORDING TO MAP OR PLAT OF SUNNYSIDE UNIT, CLERMONT HEIGHTS, FILED FOR RECORD ON 3/11/26 AND RECORDED IN PLAT BOOK 8, PAGES 66 and 67, PUBLIC RECORDS OF LAKE COUNTY, FLORIDAi PRO- VIDING FOR THE REVERSION OF SAID LANDS TO THE ABUTTING PROPERTY OWNERS; PROVIDING FOR OTHER MATTERS RELATING THERETO. " . V~EREAS, the State Road Department of the state of Florida, a component agency of the State of Florida, has surveyed, located and proposes to construct State Road 50, section 1107, through Clermont, Florida, with said state road to be constructed over, through and across said Hibiscus Street in an easterly to westerly direction; and, WHEREAS, the grade on said Sunnyside Drive is many feet lower than the grade of Highland Avenue and the contour of the land on which Hibiscus Street has been laid out on the above des- cribed plat is such that the construction of State Road 50 over, through and across Hibiscus Street would make it impossible for those entering said Hibiscus Street from Highland Avenue to cross said State Road 50 and drive on said Hibiscus Street to said Sunny- side Drive and likewise because of the grade construction of State Road 50 it would be impossible for cars to travel on said Hibiscus Street from Sunnyside Drive to Highland Avenue after the construction of said roadi and, WHEREAS, said Hibiscus Street has been paved but there being no homes located on the lots abutting Sunnyside ~ive or any portion of the lots or blocks lying immediately North of Lake Sunnyside Drive and South of said Highland Avenue; and, it is found necessary by the State Road Department of Florida that said Hibiscus Street be permanently closed and the traveling public be restricted from using said street, and after due consideration by the City Council of the City of Clermont said City Council finds the foregoing facts to be true and that said street should be permanently closed and abandoned and that the property lying within the boundaries of said Hibiscus Street South of Highland Avenue and North of Sunnyside Drive- should revert to and become the property, in equal portions, of the owners of the property abutting said street on the easterly and westerly boundaries thereof, LESS the right of way for said State Road 50; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLERMONT, FLORIDA: Section 1. That Hibiscus Street lying South of Higland Avenue and North of Sunnyside Drive according to the map or plat of Sunny- side Unit, Clermont-Heights, filed for record on 3/11/26 and recorded in Plat Book 8, pages 66 and 67, public records of Lake County, Florida, be and the same is hereby forever closed as a street in the City of Clermont and that said street is hereby permanently Vacated and can- celled on said plat and the general traveling public is hereby forever restricted from the use of said Hibiscus Street as a general thorough- fare or street within the City of Clermont, LESS that part thereof over, through and across which State Road 50 will be constructed. Section 2. That said Hibiscus Street lying within the boundaries of Highland Avenue and Sunnyside Drive as more particularly set forth in Section 1 hereinabove, having by this ordinance been hereby perm- anently vacated and closed as a public street and cancelled on said .. e·"'''·'''' ..:1' plat of Sunnyside Unit, Clermont Heights, the easterly portion of said street LESS right of way for state Road 50 shall revert ~o and become the property of the abutting p:operty owners, t?-w~t:. Lots land 38 of Block 7 according to sa~d plat of Sunnys~de Un~t, Clermont Heights, with the owner or owners of Lot 1 acquiring and having reverted to them the North half of East half of said Hibiscus Street, LESS right of way for State Road 50i and, the owner or owners of Lot 38 of said Block 7 shall have reverted to them and become the owner or owners of the South half of East half of said Hibiscus Street, LESS right of way for State Road 50; and, that the westerly portion of said street, LESS right of way for State Road 50, shall revert to and become the property of the abutting property owners, to-wit: Lots land 49 of Block 9 according to said plat of Sunny- side Unit, Clermont Heights, with the owner or owners of Lot 1 acquiring and having reverted to them the North half of West half of said street LESS right of way for state Road 50; and, the owner or owners of Lot 49 of said Block 9 shall have reverted to them and become the owner or owners of the South half of West half of said Hibiscus Street, LESS right of way for State Road 50i and, that from this date on the respective owners, of the lots in the respective blocks to which that portion of the easterly and westerly halves less the right of way for State Road 50 have reverted to and become the property of, are hereby placed in full possession, control and ownership of said property with the right to sell¡ mortgage, lease or otherwise dispose of said premises the same as if they could, had they originally owned said lands and said lands had not been laid out and platted on said map or plat as a street for the general use of the traveling public and had not been so improved by paving. Section 3, That a certified copy of this ordinance be filed of record in the public records of Lake County, Florida, and that h~reafter the tax assessor of the City of Clermont do, beginning w~~h January 1, 1954, assess those portions of said Hibiscus Avenue ly~ng South of Highland Avenue and North of Sunnyside Drive,less r~ght. of way for State Road 50, as herein;;bove more specifically descr~bed, to the owner or owners and the~r successors in title thereto the same as if said Hibiscus Street had never been laid out, platted and improved as a public street. . Section 4. This ordinance shall take effect immediately upon ~ts passage and approval by the Mayor in accordance with the Charter and ordinances of the City of Clermont and the laws of the state of Florida and t~at this ordinance is passed and the above and within named street ~s hereby permanently closed and discontinued under and by authority of Chapter 167.09, Florida Statutes 1951, and all amend- ments thereto. - - - - - - - - - - - - - - - - ------ - - - ------ - - - - PASSED by the City Council of the City of Clermont at its regular meeting held on September 1, 1953.
