ORDINANCE NO. '1-7
AN ORDINANCE REQUIRING SALESMEN, SOLICI-
TORS, COLIECTORS AND OTHERS, WHO HAVE NO
LICENSE ISSUED BY THE CITY OF CLERMONT
TO REGISTER AT THE CITY HALL AND OBTAIN
A PERMIT BEFORE OPERATING IN CLERMONT,
AND PROVIDING PENALTIES FOR VIOLATION OF
THIS ORDINANCE.
WHEREAS, it has been brought to the attention of
the City Council that many citizens of Clermont have been
imposed upon and deprived of money by those persons who
represent themselves to be Agents, Solicitors or Collec-
tors, and under such representations collect money from
the citizens of this City, and sometimes such mon~ so
collected are mis-appropriated by the persons collecting
same, leaving the citizens without recourse because such
persons have departed and their whereabouts are unknown;
and
WHEREAS, the City Council deems it necessary that
some action be taken to protect the citizens of the Gity
of Clermont, THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLERMONT:
SECTION 1. Every person who shall collect money
. for any materials to be later furnished, or for any labor
to be done in the future, or who shall take orders fer
any such material and/or labor, whether some other per-
son or agen~7 shall furnish the materials and/or labor,
or who shall collect any money or other thing of value
for services or labor rendered, or materials furnished,
must register at the City Hall.and obtain a permit to
operate in the City of Clermont, with the following ex-
ceptions;
1. When such person has a license issued by the

City of Clermont to engage in the business followed.

2. When such person sells only to dealers in
Clermont who have license issued by the City.
3. Employees and agencies of the United States,
the State of Florida and the County of Lake are excepted
from the provisions of this Ordinance.
SECTION 2. The provisions of this Ordinance are
particularly directed against those representing them-
selves to be solicitors and collectors fòr publications,
for so-called termite exterminators, buyers of old gold
and others for whom no license to operate has been issued
by the City of Clermont.
SECTION 3. Any person desiring a permit to operate
in Clermont shall make application to the City Clerk on
form furnished by the City, which shall state:
1. Nature of business to be engaged in.
2. Name of applicant and address.
3. Name of employer, if any, and address.
4. Not less than two references to other places
where applicant or his employers have done business.
SECTION 4. All applications must be accompanied

by a fee of 25 cents to partly defray cost of investiga-
tion and issuance of permit. When application is re-

ceived, the City Clerk shall issue the permit, but the

same shall be subject to cancellation if it is found that

applicant has made any mis-representation in his applica-
tion, or that the business proposed to be followed vio-
lates any law of the State of Florida or any Ordinance
of the City of Clermont. All applications, after permit
is issued, shall be turned over to the Mayor for investi-
gation.
SECTION 5. No permit issued under this Ordinance
shall operate to relieve the permitee from any license
required by the Ordinances of the City.

SECTION 6. Any person engaging in t he business

of taking orders, soliciting, collecting, without having
first secured a permit, or in any manner violating the
provisions of this Ordinance, shall be deemed guilty of
engaging in business without the ne~essary permit, and
upon conviction thereof in the Municipal Court shall be
fined not more than Twenty-five dollars, or imprisoned
not more than 15 days, or be punished by both such fine
and imprisonment, at the discretion of the Mayor.
SECTION 7. This Ordinance is enacted under the
Police power of the City, in the preservation and pro-
tection of the rights ani properties of its citizens,·
and not for revenue; so much as may be necessary to en-
fòrce the proýislons of this Ordinance is hereby ap-
propriated from the General Revenue Fund of the City.
SECTION 8. This Ordinance shall take effect
upon its passage and approval by the Mayor.
