ORDINANCE NO. ,~-~
AN ORDINANCE PROVIDING FOR THE REGULATIONS AND USE OF
BICYCLES ON THE PUBLIC STREETS OF THE CITY OF CLERMONT;
PROVIDING FOR REGISTRATION OF BICYCLES; PROVIDING OTHER
MATTERS RELATING THERETO; PROVIDING A PENALTY FOR
VIOLATION THEREOF; PROVIDING FOR THE REPEAL OF ORDINANCE
NUMBER 32.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLERMONT:
ARTICLE I -- DEFINITIONS.
Section 1. BICYCLES. The term "bicycle" shall include
every device propelled by human power. upon which any person
may ride, having two tandem wheels either of which is over
20 inches in diameter.

Section 2. OWNER. The word "owner" as used in this
ordinance shall be held to include.minors who have the use
and control of a bicycle with the knowledge and consent of
their parents or guardian.
ARTICLE II -- EQUIPMENT.
Section 1. Every bicycle operated upon the public streets
of the City of Clermont shall have the following equipment:
(a). A LAMP or OTHER LIGHT in front and a red light
or reflector in the rear, visible 300 feet or more in,each
direction, when used any time there is not sufficient 1ight
to see persons or vehicles on the public streets of the City
of Clermont.
(b). A BELL or OTHER DEVICE capable of giving signals
for a distance 'of 100 feet.
(c). A BRAKE in good working order.
Section 2. The operator of any bicycle upon the public
streets of the City of Clermont shall at all times have his
bicycle under perfect control and equipment in perfect
operating condition.
ARTICLE III -- TRAFFIC RULES FOR BICYCLES.
Section 1. MOTOR VEHICLE LAWS APPLICABLE. Every person
operating a bicycle upon the public streets of the City of
Clermont shall be subject to the provisions of the traffic
ordinances of the City of Clermont and of the statutes of the
State of Florida applicable to the drivers of motor vehicles,
except as to special regulations hereof and except as to those
provisions of said ordinances and statutes which by their
nature can have no application.
Section 2. OBEDIENCE TO SIGNALS. Any person operating
a bicycle shall obey the directions of official traffic signals,
if any, signa and other control devices applicable to other
vehicles unless otherWise directed by a police officer and
shall obey direction.signs relative to turns permitted unless
such person dismounts fr9m the bicycle, in which event he shall
then obey the regulations applicable to pedestrians.

Section 3. OPERATING ON SIDEWALK. No bicycle shall be
operated on any sidewalk within the city limits of the City of
Clermont, except that an operator may dismount and push the bi-
cycle on any sidewalk in the City of Clermont and may ride across
any of thk sidewalks within the city in order to a;proach a va-
cant lot or rack to park the bicycle.'
Section 4. CLINGING TO OTHER VEHICLES. No person riding
upon any bicycle on a public street shall attach the same or him-
self to any moving motor driven vehicle or other vehicle upon
said street.
Section 5. MORE THA~ OIŒ RIDING ON A BICYCLE. Two (2)
persons may ride on a bicycle anywhere within the city limits
of the City of Clermont including the prohibited area as de-
fined in Section 3 hereinabove, provided the person operating
the bicycle is 16 years of age. At no times shall more than
two (2) pers'ns ride on a bicycle anywhere within the Cit:\ of
Clermont. .
Section 6. PARKING. No pFrson shall park a bicycle on a
public street within the prohibited area as defined in Section
3 hereinabove unless same be parked in a Bicycle Rack provided
by the City Council of the City of Clermont and/or the owner
or operator of one or more stores with the consent of the City
Council of the Citv of Clermont. No motor vehicle shall be
parked in front of " any bicycle rack which has been permitted
to be installed in any motor vehicle parking area within the
prohibited area as defined in Section 3.
Section 7. Any bic7lcle parked upon a sidewalk within the
prohibited area as defined in Section 3 shall be parked in such
a manner as to afford the least obstruction to pedestrians.
Section 8. No bicycle shall be parked on the street out-
side of the prohibited area as defined in Section 3 after dark.
Section 9. RECKLESS OPERATION. No person shall operate
a bicycle on a public street within the City of Clermont at a
speed greater than is reasonable and prudent under the conditions
then existins and shall not operate the same in such manner as
to constitute a willful or wanton disregard for the safety of
persons or property. '
ARTICLE IV -- REGISTRATION OF BICYCLES.

Section 1. ' Within thirty (30) days from the passage of
this ordinance every owner as defined in Article 'I, Section 1
of this ordinance shall register his bicycre or bicycles with
tbe City Clerk of the City of Clermont on a form prescribed and
furnished by his office. At the time of said r~gistration the
City Clerk shall furnish the owner with a duplicate of the
registration certificate.
Section 2. Any bicycle purchased after the passß,ge of this
ordinance anq subsequent to the thirty (30) day period of time
as prescribed in Section 1 hereinabove shall, within ten (10)
days from the date of purchase, register his bicycle as prescribed
in the above Section 1 and at the time of registration he shall
furnish written evidence of his ownership of the bicycle.

Section 3. Any bicycle previously reßistered by the City
of Clermont that is transferred to an owncr other than the
orisinal registrant must be re-registered with the City Clerk
within ten (10) days of such transfer and a new Re2istration
Certificate shall be furnished the new owner; shall bear the
name of the previous owner or owners, and shall show the
original registration number.
Section 4. No bicycle shall be operated in the City of
Clermont by anyone unless same is r:gistered as provided in
Section I hereof.
OVffiers shall not be required to carry this Registra-
tion Certificate on their person, but they shall produce same
to any police officer of the City of Clermont or at the Mayor's
Court a~ such time when called for by such officer or the said
Court.

ARTICLE V -- PENALTY.
Section I. Any person, firm or corporation violating any
of the provisions of this ordinance, upon conviction in the
Mayor's Court, shall be punished by a fine not to exceed $5.00
or by suspension of the O~TIers Registration Certificate for a
period not tQ exceed ten (10) days or by both such fine and
suspension of the Resistration Certificate in the discretion
of the ¡v¡ayor. Each day that a violation is permitted to exist
shall constitute a separate offense.
ARTICLE VI -- VALIDATING PROVISIONS.
Section 1. REPEALHTC ORDDTANCE NO. 32,.. Ordinance No. Z11-
of the City of Clermont as passed by the City Council of the
City of Clermont at their Regular Meeting held on Tuesday,
October 5th, 1937, and approved by the Mayor on Tuesday, October
5th, 1937, the same being an ordinance reading as follows:

Section 2. OTHER REPEALING CLAUSE. That all ordinances,
other than Ordinance No. 32 as more fully described in Section
1 hereof, or parts of ordinances in conflict herewith be, and
the same are hereby repealed.
Section 3.' It is hereby determined that the passage of
this ordinance is essential for the immediate preservation of
the public peace, health, prosperity and aafety of the people
'of the City of Clermont and shall take effect immediately upon
its passage and being signed by the President of the City
Council and approval by the Mayor.
