03-11-2014 Regular Council Meeting City of Clermont MINUTES REGULAR COUNCIL MEETING March 11,2014 The Clermont City Council met in a regular meeting on Tuesday, March 11, 2014 in the Council Chambers at City Hall. Mayor Turville called the meeting to order at 7:00 pm with the followmg Council Members present: Council Members Mullms, Goodgame, Bates and Van Wagner. Other City officials present were. Assistant City Manager Blankenship,City Attorney Mantzaris and City Clerk Ackroyd. INVOCATION Council Member Goodgame gave the invocation followed by the Pledge of Allegiance. Mayor Turville remarked on changes to the agenda. City Attorney Mantzans noted the closed session will be part of the March 25,2014 Council meeting. PUBLIC COMMENTS Tom English, Pig on the Pond President, thanked the Council for their support to put on the event He thanked Police Chief Broadway and Captain McMaster for being cooperative. The attendance for the 3 day event was more than 30,000.The proceeds benefit scholarships. Gmger Martin,2440 Prairie Dunes, supported the Mayor in allowing the public to voice their concerns as long as needed at the previous Council meeting. Jim Purvis, 4206 Hammersmith Dnve, congratulated everyone involved in the Pig on the Pond event. Also commented on Mayor Turville allowing the public to speak and encouraged him to consider the rules by allowing a vote to extend the time on comments. A representative of Tuscany Ridge subdivision, across the street from Real Life Church, expressed concern with traffic on Steve's Road. Mayor Turville asked Assistant City Manager Blankenship to follow up. Mike Corradino, 723 Montrose Street, was present on behalf of the Downtown Clermont Merchants. They recently held an event called Vmtage Market. It was a success and all the vendors that participated have asked for another.He thanked the Council and staff for the opportunity. Charlene Forth thanked Stoney Brunson and Lee VanDever from the Public Works Department for erecting the street signs. Also commented on the Pig on the Pond event and suggested relocating the VIP parking area to allow more handicapped parking access. Paul Mascia,2434 Linkwood Avenue,expressed concern regarding the planned apartment project. City Attorney Mantzans noted this item will be on the March 25 Council meeting agenda and suggested to return to express concerns at that meeting. Those issues are not appropriate for the Council to hear tonight. CONSENT AGENDA Mayor Turville advised the next item on the Agenda for consideration was the Consent Agenda and requested anyone wishing to have any item pulled for discussion to please come forward at this time. Item No. 1-Surplus Equipment Consider request to surplus Fire Department Grumman Tower Truck. Item No.2-Contract Approval Consider request to piggyback the Flonda Sheriffs Association contract with Don Reid Ford, Inc. for six new vehicle purchases in the amount of$165,223. Council Member Mullms questioned the request for 4 wheel dnve trucks in the Planning and Zoning Department. Planning and Zoning Director Hollerand responded these are for the Building Official and Inspectors who will be driving on unpaved and undeveloped roads. Council Member Mullins moved to accept the consent agenda;seconded by Council Member Goodgame.The motion passed with all members present voting aye. Item No. 3—Closed Session The closed session has been rescheduled to March 25,2014. UNFINISHED BUSINESS Item No. 4 Event Request Recreation Director Teske presented the request Yellymary Quintero, Vineyards of the World,was present to request approval of the event. It was tabled at the last meeting and has made changes as requested. The hours will be 3pm to 9pm and updated the map. She received a letter from the President of the Downtown Partnership supporting the event request. Furthermore,she distributed a list of merchants in support of the event 2 City of Clermont MINUTES REGULAR COUNCIL MEETING March 11,2014 Council Member Mullins expressed concern with using city staff to assist with trash removal since it is a for profit event Ms.Quintero stated she will take care of it.The street closing will be around 1:30pm or 2pm. Council Member Mullins expressed concern with patrons expecting unlimited beer and requested to clanfy that it is not unlimited beer when marketing the event. Mayor Turville opened the public hearing. Mike Corradino,on behalf of the Clermont Downtown Partnership,the board has voted to support event. Gustav Ortiz,470 Rob Roy, supported the event and requested the city consider providing assistance with waste management. Mayor Turville closed the public hearing. Council Member Mullms expressed concern with the city providing trash removal. Council Member Mullins moved to approve the beer festival without the city providing for trash removal; seconded by Council Member Goodgame. The motion passed with all members present voting aye. Item No. 5 Ordinance No.2014-10;Final Hearing Mayor Turville read Ordinance 2014-10 aloud by title only. An Ordinance of the City Council of the City of Clermont, Lake County, Florida, amending and restating the City of Clermont Firefighters' Pension Trust Fund,as adopted by Ordinance No. 304-C; providing Plan Benefit Revisions;providing for severability of provisions;repealing all ordinances in conflict herewith;and providing an effective date. Finance Director Van Zile stated this amends the pension plan adoption agreement for these changes and was agreed to between the city and the union. He provided information on the amendments. Mayor Turville opened the public hearing. There were no comments. Mayor Turville closed the public hearmg. Council Member Goodgame moved to approve; seconded by Council Member Van Wagner.The motion passed 5 to 0 on a roll call vote. Item No. 7 Ordinance No. 2014-03;Introduction City Clerk Ackroyd read Ordinance 2014-03 aloud by title only. An Ordinance of the City Council of the City of Clermont, Lake County, Florida, adopting the Small Scale Comprehensive Plan Amendment for the City of Clermont, Flonda, pursuant to the Local Government Comprehensive Planning Act, Chapter 163, Part II, Flonda Statutes; setting forth the authority for adoption of the Small Scale Comprehensive Plan Amendment; setting forth the purpose and intent of the Small Scale Comprehensive Plan Amendment; providing for the adoption of the Small Scale Comprehensive Plan Amendment; establishing the legal status of the Small Scale Comprehensive Plan Amendment; providing a severability clause and providing an effective date. Council Member Mullins moved to introduce Ordinance 2014-03; seconded by Council Member Goodgame.The motion passed 5 to 0 on a roll call vote. An Ordinance under the Code of Ordinances of the City of Clermont, Lake County, Florida, amending the official zoning map of the City of Clermont referred to in Chapter 122 of Ordinance No. 289-C, Code of Ordinances; rezoning the real properties descnbed herein as shown below;providing for severability,effective date,and publication. Council Member Mullins moved to introduce Ordinance 2014-04; seconded by Council Member Goodgame.The motion passed 5 to 0 with all members present voting aye. Item No. 9 Ordinance No.2014-05;Introduction City Clerk Ackroyd read Ordinance 2014-05 aloud by title only. An Ordinance of the City Council of the City of Clermont,Lake County,Florida, closing and permanently abandoning the 15 foot right-of-way easement for 574.46 feet of the platted unnamed road lying south of tract 48; repealing all ordinances in conflict herewith,providing for severability,publication,recording,and for an effective date. Council Member Mullins moved introduction of Ordinance 2014-05; seconded by Council Member Goodgame.
