CODE ORDINANCES N~ 391 ORDINANCE NO. l35-C AN ORDINANCE UNDER THE CODE OF ORDINANCES OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, AMENDING ARTICLE III'OF AFPENDIX A OF THE CODE OF ORDINANCES: DEFINING YARD, FRONT YARD, SIDE YARD, AND REAR YARD: REPEALING ALL ORDINANCES IN CONFLICT HEREWITH: PRO- VIDING FOR SEVERABILITY: PROVIDING AN EFFECTIVE DATE: AND PROVIDING FOR PUBLICATION. THE CITY COUNCIL OF THE CITY OF CLERMONT, HEREBY ORDAINS TRAT: SECTION 1. Subsection 34 of Article III of Appendix A of the Code of Ordinances of the City of Clermont, Lake County, Florida, is hereby amended to read as follows: SECTION 2. (34) YARD. A required open space at grade between a building line and the adjoining lot line, unoccupied and unobstructed by any portion of a structure from the ground upward. Flag poles, clothes lines, bird houses, and other yard accessories and ornaments may be permitted in any yard if they do not constitute substantial impediment to vision or to free flow of light and air across the yard. Yard measurements shall extend and be measured inward from .the.:·re.speé.t'ive_:1:ot:.lines'.__ Thfs 'ooall not apply to fences, walls and retaining walls. Subsection 35 of Article III of Appendix A of the Code of Ordinances of the City of Clermont,~akè.cCounty,Florida, is hereby amended to read as follows: (35) FRONT YARD. a principal between the to the said area. A required open space on the same lot with a principal building, unoccupied except by a permitted accessory use building, or use, extending the full width of the lot and located between the rear line of the lot and the rear building line projected to the side lines of the lot. SECTION 4. Subsection 37 of Article III of Appendix A of the Code of Ordinances of the City of Clermont, Lake County, Fl~rida, is hereby amended to read as follows: (37) SIDE YARD. A required open, unoccupied space on the same lot with a principal building located between the side building line and the side of the lot extending from the front building line to the rear building line except where used as a paved parking area when abutting a street or alley. . . Should any section or part of a section be declared invalid by any court of competent jurisdiction, such adjudications shall not apply or affect any other provision of this Ordinance, except to the extent that the entire section or part of the section may be inseparable in meaning and effect from the section to which such holding shall apply. SECTION 7. This Ordinance shall be published as provided by law, and it shall become law and take effect thrity (30) days from the date of its Second Reading and Final Passage.
