CODE ORDINANCES N~ 423 ORDINANCE NO. l42-C AN ORDINANCE UNDER THE CODE OF ORDINANCES OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, AMENDING ARTICLE III OF APPENDIX A OF THE CODE OF ORDINANCES; PROVIDING FOR SWIMMING POOL AND PATIO REGULATIONS: REPEALING ALL ORDINANCES IN CONFLICT HEREWITH: PRO- VIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE: AND PROVIDING FOR PUBLICATION THE CITY COUNCIL OF THE CITY OF CLERMONT, HEREBY ORDAINS THAT: SECTION 1. Section 26-66 of Article III of Appendix A of the Code of Ordinances o! the City of Clermont, Lake County, Florida, is hereby amended to read as follows: No swimming pool or patio shall be so located, designed, operated, or maintained as to interfere with the rights of the adjoining property. Lights used to illuminate any swimming pool or patio shall be so arranged and shadowed as to reflect light away from the adjoining premises. The minimum side and rear yard setbacks shall be equal to the minimum side yard requirements for the zone. Swimming pools and patios shall be located back of the front building line. Residential swimming pools shall be enclosed by a fence or wall at least four (4) feet in height. Residential shall mean single family and duplex dwellings. SECTION 2. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed. SECTION 3. Should any section or part of a section be declared invalid by any court of competent jurisdiction, such adjudications shall not apply or affect any other provision of this Ordinance, except to the extent that the entire section or part of the section may be inseparable in meaning and effect from the section to which such holding shall apply. SECTION 4. This Ordinance shall be published as provided by law, and it shall become law and take effect thirty (30) days from the date of its Second Reading and Final Passage.
