AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CLERMONT, LAKE COUNTY, FLORIDA, PROVIDING FOR THE
ANNEXATION OF A CERTAIN PARCEL OF LAND IN ACCORDANCE
WITH THE INTERLOCAL SERVICE BOUNDARY AGREEMENT
DATED DECEMBER 2, 2014; PROVIDING FOR AN EFFECTIVE DATE,
SEVERABILITY,RECORDING, AND PUBLICATION.
WHEREAS, the City Council of the City of Clermont, Florida approved a Utility
Service Agreement for Water and Wastewater for the subject property, dated April 15, 2005; and
WHEREAS, in accordance with the Clermont Interlocal Service Boundary Agreement
dated December 2, 2014, the subject property is eligible to be annexed into the City; and
WHEREAS, the City Council of the City of Clermont, Florida, has determined that it is
in the best interest of the City and of the property herein sought to be annexed that the City
annex the following described property; and
WHEREAS, the City Council has determined that the area sought to be annexed is in
need of the services which the City can offer and the City has determined that such area sought
to be annexed will be substantially benefited by annexation; and
WHEREAS, the City Council has determined that all requirements of Section 171.044,
Florida Statutes, have been met.
SECTION 1.
NOW, THEREFORE, BE IT ORDAINED, under the provisions of Florida Statute
Chapter 171 and the General and Special Laws of the State of Florida; that the City of Clermont,
Florida, does hereby annex to and make part of its corporate boundaries; the following described
property, to-wit:
Legal Description
A portion of Tract 12, Hartle's replat, according to the plat thereof as recorded in Plat Book 12,
Page 45, Public Records of Lake County, Florida, lying north of SR 50, less the right-of-way for
CR 455, said parcel being more particularly described as follows: Commence at the northwest '/
of Section 26, Township 22 south, Range 26 east, Lake County, Florida, and run south
00°43'09" west along east line and northwest '% for a distance of 657.36 feet to a point of
intersection with the easterly extension of the north line of said Tract 12; thence run north
89°05'29" west, along the easterly extension of the north line of said Tract 12, for a distance of
50.00 feet to a point on the west right-of-way line of CR 455, according to Official Records
Book 1978, Page 908, Public Records of Lake County, Florida; thence, run south 00°43'09"west
along the west right-of-way line of CR 455, for a distance of 457.17 feet to a point on the

north nght-of-way line of SR 50, according to the Florida Department of Transportation right-of-
way map Section number 11070-2505; thence run north 88°53'40" west, along said north right-
of-way line, for a distance of 175.42 feet; thence run south 00o43'09" west, along said north
nght-of-way line, for a distance of 38.00 feet; thence run north 88°53'40" west, along said north
right-of-way line, for a distance of 87.78 feet; to the point of beginning; thence north 88°53'40"
west, along said north right-of-way line, for a distance of 185.00 feet; thence run north 01°06'20"
east for a distance of 282.34 feet; thence run south 89°05'29" east for a distance of 185.00;
thence run south 01°06'20" east for a distance of 282.97 feet to the point of beginning.

SECTION 2.
That the aforedescribed property shall be and hereby is made part and parcel of the City of
Clermont, Florida, and that said property shall be subject to all of the laws, ordinances, and
provisions pertaining to the City of Clermont.
SECTION 3.
All property aforedescnbed shall henceforth be subject to ad valorem taxation by the City of
Clermont, and any other general or special taxes or assessments.
SECTION 4.
Should any Section or part of a Section be declared invalid by any court of competent
jurisdiction, such adjudications shall not apply or affect any other provision of this Ordinance,
except to the extent that the entire Section or part of the Section may be separable in meaning
and effect from the Section to which such holding shall apply.
SECTION 5.
This Ordinance shall be recorded in the public records of Lake County, Florida.
SECTION 6.
This Ordinance shall be published as provided by law, and it shall become law and take effect
upon its Second Reading and Final Passage.
