City of Clermont MINUTES REGULAR COUNCIL MEETING July 14, 2015 The Clermont City Council met in a regular meeting on Tuesday, July 14, 2015 in the Council Chambers at City Hall. Mayor Ash called the meeting to order at 6:30pm with the following Council Members present: Council Members Goodgame, Mullins, Bates and Travis Other City officials present were: City Manager Gray,City Attorney Mantzans, and City Clerk Ackroyd. INVOCATION Pastor Ralph Henderson gave the invocation followed by the Pledge of Allegiance. PRESENTATIONS Fire Chief Bishop recognized Gary Schmdele for ten years of volunteer service to the Clermont Fire Department Police Chief Broadway distnbuted the Police Department's 2014 Annual Report highlighting significant accomplishments for 2014. PUBLIC COMMENTS Helmut Michelson recognized Council Member Travis for winning a gold medal at a duathlon race. Edward Apadaca; Clermont Office Suites Co-owner and President of the Clermont Downtown Partnership, thanked the City for the progress in the Downtown area over the past ten years and the City's current vision He commented the current Downtown Gateway sign at 8th Street and Highway 50 needed to be replaced and auxiliary lighting should be installed for use dunng downtown events. Jim Purvis congratulated Council Member Travis on winning a gold medal. He expressed concern regarding traffic exiting from the Arts and Recreation Center and turning north into the south bound traffic on U.S. Highway 27. Mr. Purvis encouraged Council to request staff to conduct a traffic study of the property and provide recommendations to Council Ginger Martin complimented the Public Works department. Sasha Weyer; Vineyards of the World Owner, thanked the Clermont Downtown Partnership for the food truck events and requested the City provide funding assistance to the Clermont Downtown Partnership to improve the event. He requested the City increase signage for the Downtown Distnct on Highway 50 and update the Gateway sign on 8`h Street and Highway 50. Mayor Ash stated the Master Plan will address issues such as the signage on 8th Street and Highway 50 The Plan will include additional efforts to draw patrons to the Downtown Distnct REPORTS City Manager Gray reported the Clermont Redevelopment Agency will meet on July 28 at 6pm pnor to the 6:30pm Council Meeting. The budget workshops are scheduled for July 22 and July 23 at 6.00pm The Request for Proposal to demolish the old Fire Station is in progress. He thanked all who attended the 4th of July event. City Attorney Mantzans—No report. 1 City of Clermont MINUTES REGULAR COUNCIL MEETING July 14, 2015 Council Member Bates thanked staff for their work on the July 4th event. He reported State Representative Metz will hold an open house to recap the Florida Legislative session at the Clermont City Center on July 15 at 6:00pm Council Member Goodgame thanked the Police Department for their efforts when his home was burglanzed. Council Member Mullins commended staff for the July 4`h event. He reported the Tourism Bed Tax revenues for the month of May 2015 increased 1.7%over May 2014 The year-to-date revenue increased 6.6%compared to the same penod last year. Council Member Travis reported a Celebnty Softball Tournament, Police vs Fire, will be held on August 21. She thanked Mike Corradmo; South Lake Tablet, for providing a lesson on wnting an effective press release. The Central Flonda Expressway Authonty will give a presentation at the South Lake Chamber Breakfast on Fnday, July 17. The South Lake Chamber is preparing for the Taste of South Lake to be held on November 5. Mayor Ash thanked staff for the 4`h of July event. CONSENT AGENDA Mayor Ash advised the next item on the Agenda for consideration was the Consent Agenda and requested anyone wishing to have any item pulled for discussion to please come forward at this time Item No. 1 —Meeting Minutes Consider request to approve minutes of the February 24, 2015 and March 10, 2015 Regular Council meeting; and the February 26, 2015 and March 23, 2015 Special Council meeting. Item No. 2—Surplus Request Consider request to declare surplus end of life inventory as surplus from Fire, Environmental Services,Parks and Recreation, and Public Works Departments and dispose of in accordance with the Purchasing Policy. Item No.3—Contract Award Consider request to piggyback the City of Orlando contract with Altair Environmental Group, LLC and B&D Waterblastmg Company, Inc. d/b/a B&D Enterpnses to provide sewer cleaning and inspection. Item No.4—Contract Award Consider request to piggyback the City of Orlando contract with Rush Truck Center of Flonda to provide vehicle repair services including garbage and fire trucks. Item No. 5—Contract Award Consider request to piggyback Volusia County B C.C. contract with Cintas Corporation No. 2 to provide umform rental/lease services. 2 City of Clermont MINUTES REGULAR COUNCIL MEETING July 14, 2015 Item No. 6—Bid Award Consider approval of bid award to Jordan Brothers Construction,LLC to provide stormwater improvements to Linden Street and Lake Avenue in the amount of$518,006.30 and contingency cost of$51,800. Item No. 7—Bid Award Consider approval of bid award to Innovative Construction&Engineenng LLC to provide extenor renovation of historical Kern House and Cooper Library and a budget amendment in the amount of$17,220. Item No.8—Event Request Consider Event and Road Closure Request to allow the Downtown Partnership to host a monthly car show on the second Saturday of every month in Downtown Clermont. Ron Smart pulled Item 8. Council Member Goodgame pulled Item 1 Council Member Bates moved to approve Consent Agenda Items 2 through 7; seconded by Council Member Mullins. The motion passed with all members present voting aye. Council Member Goodgame requested the February 24, 2015 minutes reflect the fundraiser at the Family Chnstian Center was for the McCorkle family. Council Member Bates moved to approve Item 1 as amended; seconded by Council Member Goodgame. The motion passed with all members present voting aye. Ron Smart addressed Item 8, the Clermont Downtown Partnership request for road closure for a car show the second Saturday of each month. In the preliminary submission, the request for an open container entertainment zone was removed He requested the entertainment zone be included, inclusive of the barricaded areas with signage stating"No alcohol beyond this point." Council Member Mullins moved to approve Item 8 as amended; seconded by Council Member Goodgame. The motion passed with all members present voting aye 3 City of Clermont MINUTES REGULAR COUNCIL MEETING July 14, 2015 UNFINISHED BUSINESS Item No.9—Hancock Park Grant Request City Manager Gray stated the Council tabled the Hancock Park grant request at the June 23, 2015 meeting to receive an update on amending the Lake County Tounst Development Council grant application. Lake County Commissioner Parks was contacted and confirmed the grant application could be amended and he would bnng the amended application to the Lake County Board of County Commissioners. The Hancock Park expansion would be removed and the application amended to include field expansions on the Lake Sumter College property. The amended application would be approved by the City Council, South Lake Hospital Board, and Lake Sumter College Board The application is expected to go to the Lake County Board of County Commissioners in October Mayor Ash inquired if Hancock Park would remain as is City Manager Gray confirmed. City Manager Gray stated no action was required by Council. Council Member Mullins inquired if enhancements to Hancock Park could be included. City Manager Gray stated staff would look into any potential enhancements as part of the grant application. NEW BUSINESS Item No. 10—Lien Release;Belgian Capital/South Lake Medical Arts Center Development Services Director Hollerand presented the request for a Code Enforcement fine reduction from $306,250 to $3,000. Belgian Capital Fund, LLC has complied with Code Case 12-797 as of June 30, 2015 for violations of failure to maintain landscape and unlawful maintenance of nuisances on the South Lake Medical Arts Center property located at Oakley Seaver Dnve and Citrus Tower Boulevard. The City incurred administrative costs in pursuing the matter, however a reduction to $3,000 was acceptable to the City. The lien would be released upon approval by Council and payment received within 30 days. Attorney Jimmy Crawford was present on behalf of Belgian Capital Fund, LLC Belgian Capital Fund, LLC spent over$40,000 to clear up the Code Enforcement issues. A landscape company is maintaining the property, a professional management company has been retained, and the property is in full compliance. A family physician group would like to purchase the property; however a $300,000 lien is more than the property value. Attorney Crawford requested Council approve a fine reduction to$3,000 Mayor Ash opened the public heanng. Jim Purvis spoke in opposition of the reduction request. Mayor Ash closed the public heanng. Council Member Mullins questioned if the case had been actively pursued by staff Development Services Director Hollerand stated the open case was on the review list; however the request was from the applicant due to a pending sale of the property. 4 City of Clermont MINUTES REGULAR COUNCIL MEETING July 14, 2015 Council Member Goodgame inquired how long the property was not in compliance City Attorney Mantzans stated the fine accrued was based on 1,225 days of non-compliance with the Code Enforcement Board's order. Council Member Bates asked how the $3,000 was determined. Development Services Director Hollerand responded the amount was offered by Belgian Capital's attorney Council Member Bates inquired how long would the process have continued if the property had not been sold City Attorney Mantzans stated staff had contact with Attorney Crawford over the past several years and Belgian Capital was responsive to the Code Enforcement Board's order. The next step would have involved appearing before the Code Enforcement Board and the City proceeding to foreclose on the lien. Attorney Crawford commented the Code Enforcement Board's order was not ignored. The process was difficult to work through due to the expense involved regarding the landscaping The violations were cleared within a month after the fines began, with the exception of the landscape violation. The graffiti problems occur every few months and are handled each time. The fine accrues against the common area of the property with a percentage owned by all property owners. The hen prevents any property owner from selling a building. Mayor Ash inquired how the ongoing issues were being addressed. Attorney Crawford stated additional pnvate secunty was hired and cameras were installed Belgian Capital cleared Code Enforcement issues which were not part of the onginal violation and attempted to resolve any problems occurring on the property. Mayor Ash asked what violations continue to exist. City Attorney Mantzans stated there were no current violations. Mayor Ash expressed concern the violations would reoccur. Attorney Crawford commented a professional management company was hired and a system was in place to ensure continued compliance. Council Member Bates requested to view photographs of the property taken when the violations occurred. Development Services Director Hollerand provided the photographs taken in October 2011. Council Member Mullins was in favor of accepting a lower amount. Mayor Ash was opposed to the requested reduction amount. Council Member Goodgame moved the fine be assessed for thirty days for a total amount of$7,500; seconded by Council Member Travis. City Attorney Mantzans stated a time frame for payment was typically included. Council Member Mullins suggested thirty days. Council Member Bates inquired how much time and effort staff spent on the case. Development Services Director Hollerand responded the records show the property was checked regularly. 5 City of Clermont MINUTES REGULAR COUNCIL MEETING July 14,2015 Council Member Goodgame moved the fine be assessed for thirty days at $250 per day for a total amount of$7,500, payable within thirty days; seconded by Council Member Mullins. City Attorney Mantzans stated technically the motion is the fine would be reduced to $7,500 if paid within thirty days, if it is not paid within thirty days, it would defer to the full amount. Mayor Ash opened the heanng for public comment on the motion Mary Jo Pheiffer commented the motion should include the onginal amount the fine was reduced from. She stated the amount the fine was reduced to was too low. Chris Jenkins recommended the City offer Belgian Capital the amount of$150,000 Tim Murry commented the City should collect at least 25%of the fine Attorney Crawford stated Code Enforcement recommended approval of the$3,000 offer. Ginger Martin recommended the amount be set for a minimum of 10%of the fine. Mayor Ash closed the public heanng. Council Member Travis commented she handles a lot of foreclosed properties and it takes a long time to have issues corrected. Typically higher fines are not paid and the property remains vacant Mayor Ash was opposed to reducing to $7,500 and stated 10% would be adequate and acceptable, due to the number of years the violation continued. City Attorney Mantzans stated the statute clearly establishes the intent of the Code Enforcement process is to motivate compliance Case law is clear and set reductions have been thrown out by courts in Code Enforcement issues because every case stands on its own ment. Fining a Code Enforcement case is based on three factors: gravity of the violation, the cooperation of the respondent, and if the respondent had a similar violation in the past. Council Member Mullins called for the question Mayor Ash commented when fines are reduced, a violation of City Code will not be taken senously. City Clerk Ackroyd read motion into the record: The fine to be reduced to$7,500 if paid within thirty days; if not, it defers to the full amount. The motion passed 3 to 2 with Mayor Ash and Council Member Bates opposing 6 City of Clermont MINUTES REGULAR COUNCIL MEETING July 14, 2015 Item No. 11 —Variance Request;Sundar Investments Senior Planner Kruse presented the request to allow a rear-yard setback of 20 feet from the property line at 4444 Harts Cove Lane. The applicant was requesting the variance to install a 32-foot wide by 16-foot deep porch with a solid roof and screened walls The porch would intrude 5 feet into the setback line. Staff recommended denial of the variance request Suseema Basdeo, Applicant, commented the property was for her mother-in-law and the back of the property is steep, making it difficult to walk Ms.Basdeo requested approval of the vanance request Mayor Ash opened the public heanng. Chris Jenkins spoke in opposition of the request. Mayor Ash closed the public hearing Council Member Mullins inquired if the property behind the house had a patio or awning Senior Planner Kruse responded a 7.5 foot setback variance was granted on the parcel for a screened in porch in 2009 The current request is similar to the vanance on the property behind the house Council Member Goodgame asked if the applicant received approval from the Home Owners Association. Senior Planner Kruse stated staff had not received documentation from the applicant regarding approval. Ms Basdeo stated the Home Owners Association approved the request. Mayor Ash inquired why the porch would need to be 16 feet deep. Ms. Basdeo responded they anticipate future mobility challenges for her mother-in-law Council Member Mullins asked if a retaining wall would be required. Ms. Basdeo was not certain how the porch would be constructed. Council Member Mullins inquired if a letter of approval from the Home Owners Association was required. City Attorney Mantzaris stated if Council grants the request upon reliance of approval by the Home Owners Association,the approval from the Home Owners Association could be a condition Council Member Goodgame moved to approve the variance request on the basis that it will be approved by the Home Owners Association; seconded by Council Member Bates. Council Member Travis expressed concern of setting precedence. Council Member Mullins inquired if the applicant would be able to return for another variance if this vanance was not granted City Attorney Mantzans commented the request could be tabled to allow the applicant to modify the request The motion failed 1 to 4 with Council Member Goodgame voting for approval.
