09-22-2015 Regular Meeting City of Clermont MINUTES REGULAR COUNCIL MEETING September 22,2015 The Clermont City Council met in a regular meeting on Tuesday, September 22, 2015 in the Clermont City Center. Mayor Ash called the meeting to order at 6:30pm with the following Council Members present: Council Members Mullins, Bates, Goodgame, and Travis. Other City officials present were: City Manager Gray,City Attorney Mantzaris,and City Clerk Ackroyd. INVOCATION Pastor Carlos Aviles gave the invocation followed by the Pledge of Allegiance. PROCLAMATION City Clerk Ackroyd read the Fire Prevention Week 2015 proclamation aloud. Mayor Ash presented the proclamation to Clermont Fire Department staff members William Harrison and Jennifer Pearce. PRESENTATION City Manager Gray introduced Parks and Recreation Director Scott Davidoff. Arts and Recreation Update Parks and Recreation Director Davidoff provided an update on the Arts and Recreation Center to include the partnership with the Boys and Girls Club, gymnasium usage, Senior Program attendance, room rentals,and the Aquatic Center usage. Jeannie Lenders updated the Council on the progress of the Performing Arts Center, facility upgrades, talent bookings, and preparations for the Grand Opening Gala. Ms. Lenders thanked Council for their support. Parks and Recreation Director Davidoff provided information on the renovations to the Performing Arts Center and the future vision of the Arts and Recreation Center facility. PUBLIC COMMENTS Jim Purvis commented on the late amval of the water utility bill in September,the due date providing less than a week to pay,and his check not cleanng in a timely manner. Hope Lamb stated she did not receive a water utility bill. Ms. Lamb requested Council take action opposing the Florida bear hunt scheduled for October. Council Member Mullins inquired if there was a resolution the City could wnte in opposition of the bear hunt. City Attorney Mantzans stated Council could send a resolution in support of eliminating the bear hunt. The injunction hearing will be held on October 1, 2015. Council supported wnting a resolution m opposition of the bear hunt. City Manager Gray will work with City Attorney Mantzans on drafting a resolution. 1 City of Clermont MINUTES REGULAR COUNCIL MEETING September 22, 2015 Charlene Forth spoke m opposition of the time limit for public comments. She commented on a water payment placed m the drop box and located after a month. Ms Forth supported drafting a resolution in opposition of the bear hunt. REPORTS City Manager Gray—No report City Attorney Mantzans—No report. Council Member Bates attended the Lake County League of Cities meeting last week. He announced his nomination to sit on the new Water Safety Advisory Committee. The Lake County Board of County Commissioners will vote on the nomination m a few weeks. Council Member Goodgame reported he attended the Metropolitan Planning Organization meeting and the Florida Department of Transportation denied the Metropolitan Planning Organization's application to fund a pedestnan crossover on U. S Highway 27 near Lake Louisa Road. Council Member Mullins attended the Lake County Sales Tax Oversight Committee on September 14, 2015 to review the Lake County, School Board and Lake County city's proposed budget expenditures for the sales tax funds. Council Member Travis announced the South Lake Chamber of Commerce has published a new Visitor and Relocation Guide The South Lake Chamber of Commerce breakfast will be held on October 16, 2015 and Pam Stewart; State Commission on Education,will be the speaker. Mayor Ash—No report. CONSENT AGENDA Mayor Ash advised the next item on the Agenda for consideration was the Consent Agenda and requested anyone wishing to have any item pulled for discussion to please come forward at this time. Item No. 1 —Meeting Minutes Consider request to approve minutes of the July 14, 2015 and July 28, 2015 Regular Council meeting Item No.2—Surplus Request Consider approval to declare end of life inventory as surplus from vanous departments and dispose of in accordance with the Purchasing Policy. Council Member Goodgame moved for approval of the Consent Agenda as submitted; seconded by Council Member Mullins. Council Member Goodgame moved to table to October 27; seconded by Council Member Mullins. The motion passed with all members present voting aye. Item No.4—Lien Release,Eglise De Dieu Tabernacle De Louange Development Services Hollerand reported the property located at 1018 School Street had an existing lien in the amount of$2,606 and additional expenses for mowing and administrative costs m the amount of $366. The new property owner was not aware of the lien when purchasing the property and was requesting elimination of the fine and release of the lien. Staff recommended the full amount be paid. Mane Jean; Owner, stated the property was purchased in 2012 at an auction and was not aware of the lien at the time of purchase. She recently received a letter from the City regarding the lien and requested the lien be released. Mayor Ash opened the public heanng. There were no public comments. Mayor Ash closed the public hearing. Council Member Mullins inquired if a title search had been completed before purchasing the property. City Attorney Mantzans stated the property was acquired through a tax deed sale at an auction and tax deed sales are not handled through a traditional closing. Council Member Mullins commented the purchaser did not perform due diligence Mayor Ash stated purchases made in this manner are typically"as is"purchases. Council Member Bates asked if someone would have notified Ms. Jean of a lien on the property. City Attorney-Mantzaris commented there was a certain amount of responsibility and liability to the individual purchasing the property. The Lake County Clerk of Court's office does not assume the responsibility to conduct title searches on properties offered through an auction. Council Member Bates inquired how the property owner became aware of the hen. City Attorney Mantzans stated Code Enforcement Board staff had been reviewing older hens, particularly liens where the City expended funds,and the current property owner was sent a letter regarding the lien Council Member Mullins commented the City expended funds to clean the property. 3 City of Clermont MINUTES REGULAR COUNCIL MEETING September 22, 2015 Council Member Bates inquired if the amount owed included interest City Attorney Mantzans stated the amount did not include interest Ms Jean commented the church cleaned the property and mowed the grass. Mayor Ash stated the amount owed were the expenses the City paid to demolish the building and clean up the debns. City Attorney Mantzans stated $366 was for mowing The majority of the expenses were for demolishing the structure,removal of vehicles,and removal of debris. Council Member Bates inquired if the property was owned by the church. Ms. Jean stated the church owned the property. Council Member Travis stated buyers are cautioned to do a title search when purchasmg through an auction. Council Member Mullins moved to deny the request; seconded by Council Member Travis.The motion passed with all members present voting aye. Item No.5—Tourist Development Council Funding Application City Manager Gray stated Council directed staff to work with South Lake Hospital and Lake Sumter College regarding amending an application for a Tourist Development Council grant. Lake Sumter College has agreed to expand the fields at Legends Way. The amended application deadline is October 1, 2015 and will be on a future Lake County Board of County Commissioners agenda for consideration. The amended application will be submitted after approval by the City Council, South Lake Hospital, and Lake Sumter College. The City assisted with the layout and engineering of the plans, however no funds will be expended by the City and the City will not manage the facility. Economic Development Director Hitt commented the onginal application was not approved by the Tourist Development Council. The amended application included over 300 parking spaces, five ball field diamonds, and allows the location to be marketed as a ten-field softball complex. The estimated costs have been reduced and the amended application is requesting under$3 million, as opposed to the $7 to $8 million in the original application. Mayor Ash opened the public hearing. Item No.6—Parkrun Parks and Recreation Director Davidoff stated the Parkrun is a free, weekly community 5K Run operated by the participants. The Parkrun accesses the trail from Waterfront Park, has between 50 to 100 participants each Saturday, and the run begins and ends at the Historic Village 4 City of Clermont MINUTES REGULAR COUNCIL MEETING September 22,2015 The South Lake County Histoncal Society requested the Parkrun relocate to Lake Hiawatha Preserve. The Parkrun organizers expressed concern the move would create additional administrative work and loss of participants. The organizers have agreed to maintain the course, restrooms, and request permission to install signage and use of a storage area Mayor Ash opened the public heanng. Karen Bowler, Joshua Castleman, Knstine Rocha, Ron Murdock, William Post, Amanda Walsh, Frances Post,Kimberly Grogan, and Jody spoke in favor of the Parkrun utilizing the Histonc Village location Charlene Forth, Jim Purvis, Hope Lamb, Donna DiGennaro, Dodie King, Mickm Blackburn Nagel, and Larry Rescoe spoke in opposition of the Parkrun utilizing the Historic Village location. Mayor Ash closed the public heanng Mayor Ash recessed the meeting at 8:52pm. Mayor Ash reconvened the meeting at 9:07pm Council Member Mullins commented the Downtown merchants benefit when events are closer to the Downtown Histonc District. Mayor Ash suggested creating a committee consisting of representatives from the Histoncal Society, Parkrun,and City staff. Council Member Goodgame stated visitors to the Histonc Village are charged a rental fee to use the facilities and the Parkrun participants have used the facilities at no charge. Council agreed a committee consisting of a mediator,representatives from the Historical Society, Parkun, and City staff. City Manager Gray will move forward with a committee.
