AN ORDINANCE UNDER THE CODE OF ORDINANCES OF THE
CITY OF CLERMONT, LAKE COUNTY, FLORIDA, AMENDING
CHAPTER 4, ANIMALS AND FOWL, SECTIONS 4-1 AND 4-2,
AND REPEALING SECTIONS 4-5, 4-6, 4-7, 4-8, and 4-9;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, PRO-
VIDING FOR SEVERABILITY, PROVIDING FOR AN EFFECTIVE
DATE, AND PROVIDING FOR PUBLICATION.
THE CITY COUNCIL OF THE CITY OF CLERMONT HEREBY ORDAINS THAT:
SECTION 1.
Section 4-1. Birds and game - Sanctuary created is hereby
amended as follows:
The entire area within the City of Clermont is hereby declared
to be a bird sanctuary for all birds, game or otherwise, which are
protected under the laws of the State of Florida.
The molesting, shooting, trapping or otherwise killing or injury
of any bird within the city limits of this city is hereby prohibited,
provided however, this section may be suspended by the council for
ten (10) days in the event any birds become a nuisance or destructive.
Signs posted within the city reading substantially "Bird Sanctuary"
are due notice to all persons of the provisions herein and of their en-
forcement.
SECTION 2.
Section 4-2. Same - Unlawful to shoot or trap; exceptions is hereby
amended as follows:
It shall be unlawful for any person to kill, trap, shoot at or other-
wise injure or molest any squirrel or other game or any bird within the
limits of the city, except however, English sparrows, starlings, crows,
hawks and pigeons may be trapped or shot but only by or under the direc-
tion of the city.
SECTION 3.
The following Sections of Chapter 4 Animals and Fowl of the Code of
Ordinances of the City of Clermont are hereby repealed:
Section 4-5. Impounding Fees
Section 4-6. Same - Notice
Section 4-7. Same - Redemption; Sale
Section 4-8. Same - Care; Collection of Fees
Section 4-9. Cruelty to Animals
SECTION 4.
All ordinances or parts of this ordinance in conflict herewith are
hereby repealed.
SECTION 5.
Should any section or part of this section be declared invalid by
any court of competent jurisdiction, such adjudications shall not apply
or affect any other provision of this ordinance, except to the extent
that the entire section or part of the section may be inseparable in
meaning and effect from the section to which such holding shall apply.

SECTION 6.
This ordinance shall be published as provided by law and it
shall be come law and shall take effect immediately upon its
second reading and final passage.
