AN ORDINANCE UNDER THE CODE OF ORDINANCES OF THE
CITY OF CLERMONT, LAKE COUNTY, FLORIDA, AMENDING
CHAPTER 3, ALCOHOLIC BEVERAGES, SECTIONS 3-2 AND
3-3, AND REPEALING SECTION 3-1, REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH, PROVIDING FOR
SEVERABILITY, PROVIDING FOR AN EFFECTIVE DATE,
AND PROVIDING FOR PUBLICATION.
THE CITY COUNCIL OF THE CITY OF CLERMONT, FLORIDA HEREBY ORDAINS THAT:
Chapter 3, Section 3-1. Licenses Tax, and Section 3-2. State
Beverage Law Adopted are hereby amended as follows:
SECTION 1.
Section 3-1. Licenses Tax of the Code of Ordinances of the
City of Clermont is hereby repealed.
SECTION 2.
Section 3-2. State Beverage Law Adopted of the Code of Ordinances
of the City of Clermont is hereby amended as follows:
The provisions of Chapters 561, 562, 563, 564, and 568, Florida
Statutes, relating to alcoholic beverages, except those sections
thereof which are by their nature inapplicable to municipalities,
are hereby adopted as a part of this code as fully as if set forth
herein in full, except as otherwise provided by the charter or ordi-
nances of the city. The police department shall be charged with the
duty of enforcing the provisions hereof and shall be vested with the
powers and authorities of state and county officials as set forth in
the beverage laws of the state in carrying out their duties hereunder.
SECTION 3.
Section 3~3. Licensing Vendors Near School or Church; Standard of
Measurement of the Code of Ordinances of the City of Clermont is hereby
amended as follows:
No license shall be granted to any licensee under this chapter where
the vendor's or licensee's place of business is within five hundred(500)
feet of an established church or school (which distance shall be mea-
sured by following the shortest route of ordinary pedestrian travel
along the public throughfare from the main entrance of said place of
business to the main entrance of the church and, in case of a school,
to the nearest point of the school grounds in use as part of the school
facilities) .
SECTION 4.
All ordinances or parts of this ordinance in conflict herewith
are hereby repealed.
SECTION 5.
Should any section or part of this section be declared invalid
by any court of competent jurisdiction, such adjudications shall not
apply or affect any other provision of this ordinance, except to the
extent that the entire section or part of the section may be insep-
arable in meaning and effect from the section to which such holding
shall apply.

SECTION 6.
This ordinance shall be published as provided by law and it shall
become law and shall take effect immediately upon its second reading
and final passage.
