ORDINANCE NO. 199-C
AN ORDINANCE UNDER THE CODE OF ORDINANCES OF THE
CITY OF CLERMONT, LAKE COUNTY, FLORIDA, PROVIDING
FOR THE ESTABLISHMENT OF THE PLANNING AND ZONING
COMMISSION FOR THE CITY OF CLERMONT, FLORIDA.
THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA,
HEREBY ORDAINS THAT:
This Ordinance provides for the establishment of the City of
Clermont Planning and Zoning Commission, with all the duties and respon-
sibilities required by Article VIII of the Charter of the City of
Clermont, Florida.
SECTION 1. Membership.
The Planning and Zoning Commission, provided for herein, shall be
comprised of nine (9) members, to be appointed by a majority vote of
the City Council at its first regular meeting in January of each year,
or as soon as possible thereafter.
Each seat for the Planning and Zoning Commission shall be numbered
one through nine (1-9). Members of the Commission originally appointed
to fill odd numbered places 1, 3, 5, 7, and 9, shall be appointed for a
term of one year. Members of the Commission originally appointed to
fill even numbered places 2, 4, 6, and 8, shall be appointed for a term
of two years. Thereafter, the term of each Commission member shall be
two (2) years.
SECTION 2. Qualifications for Membership.
Qualifications for membership on the Planning and Zoning Commission
shall be as follows:
I. Be eighteen (18) years of age or older.
2. Be a registered elector residing in the City of Clermont.
3. Any interested person should petition the City Council no
later than the first regular meeting in January to demonstrate
sufficient interest in appointment.
SECTION 3. Annual Meeting.
The annual meeting of the Planning and Zoning Commission shall be
the first regular meeting in the month of February of each year. Such
meeting shall be devoted to the election of officers for the ensuing
year and such other business as shailll be scheduled by the Planning and

Zoning Commission.
SECTION 4. Regular Meetings.
Regular meetings of the Planning and Zoning Commission shall be
held in the Council Chambers at 7:30 P.M. on the first Tuesday of each
month. A regular meeting may be cancelled or rescheduled by the
Commission.
SECTION 5. S2ecial Meetings.
Special meetings of the Planning and Zoning Commission shall be
held at a time and place designated by the officer calling the same
and shall be called by the Chairman or Vice-Chairman. Written notice
thereof shall be given to all the members not less than twenty-four
(24) hours in advance thereof.
SECTION 6. Quorum.
At any meeting of the Planning and Zoning Commission, a quorum shall
consist of five (5) members of the Commission. No official action shall
be taken in the absence of a quorum, except to adjorn the meeting to a
subsequent date.
SECTION 7. Voting.
A. At all meetings of the Planning and Zoning Commission, each
member shall be entitled to one vote, at which time a voice vote will
be taken, unless a request is made for a roll call vote. If a member
has a personal conflict of interest, he may abstain under the provisions
of Florida Law.
B. A record of each and evevy meeting shall be made as provided
by law.
SECTION 8. Rules of Procedure.
All meetings of the Planning and Zoning Commission shall be conducted
in accordance with Robert's Rules of Order.
SECTION 9. Officers.
The officers of the Planning and Zoning Commission shall consist
of a Chairman and a Vice Chairman, elected by the Planning and Zoning
Commission members at the annual meeting for a term of one year. The

City Manager or his designated representative shall be the Secretary
of the Commission.
SECTION 10. Duties of Officers.
The duties and powers of the officers of the Planning and Zoning
Commission shall be as follows:
A. Chairman.
(I) To preside at all meetings of the Commission.
(2) To call special meetings of the Commission in accordance
with these By-Laws.
(3) To sign documents of the Commission.
(4) To see that all actions of the Commission are properly
taken.
(5) To serve as an ex-officio member of all Sub-Committees.
B. Vice Chairman.
During the absence, disability or disqualification of the
Chairman, the Vice Chairman shall exercise or perform all the duties
and be subject to all the responsibilities of the Chairman.
C. Secretary.
(I) To keep the minutes of all meetings of the Planning and
Zoning Commission in an appropriate Minute Book.
(2) To give or serve all notices required by law or by these
By-Laws.
( 3) To prepare the agenda for all meetings of the Commission.
( 4) To be custodian of Commission records.
(5) To inform the Commission of correspondence relating to
business of the Commission and to attend to such correspondence.
(6) To handle funds allocated to the Commission in accordance
with its directives, the law, and City regulations.
SECTION II. Vacancies.
Should any vacancy occur among the members of this Planning and
Zoning Commission by reason of death, resignation, disability or other-
wise, the City Council shall appoint a new member to serve the unexpired
term. Should any vacancy occur among the officers of the Planning and
Zoning Commission, the vacant office shall be filled in accordance with

Section 9 of these By-Laws, such officer to serve the unexpired term of
the office in wh~ch such vacancy shall occur. Any member who accumulates
three (3) consecutive unexcused absences may, upon recommendation from
the Planning and Zoning Commission, be removed from the Commission by
a majority vote of the City Council.
SECTION 12.
All ordinances or parts of this Ordinances in conflict herewith are
hereby repealed.
SECTION 13.
Should any section or part of this section be declared invalid by
any Court of competent jurisdiction, such adjudications shall not apply
or affect any other provision of this Ordinance, except to the extent
that the entire section or part of the section may be inseparable in
meaning and effect from the section to which such holding shall apply.
SECTION 14.
This Ordinance shall be published as provided by law and it shall
become law and shall take effect upon
