01-17-2017 Special Council City of Clermont MINUTES SPECIAL COUNCIL MEETING January 17, 2017 The Clermont City Council met in a special meeting on Tuesday, January 17, 2017 in the Clermont City Council Chambers. Mayor Ash called the meeting to order at 6:30pm with the following Council Members present: Council Members Mullins, Bates, Goodgame, and Travis. Other City officials present were: City Manager Gray, City Attorney Mantzaris, and City Clerk Ackroyd Howe. INVOCATION AND PLEDGE OF ALLEGIANCE Pastor Marshall gave the invocation followed by the pledge of allegiance. PRESENTATIONS Economic Development Update Economic Development and Community Redevelopment Agency Director Schmidt provided an update on Economic Development and Tourism initiatives. Ms. Schmidt reviewed cultivating an environment where businesses can thrive, new businesses and expansions,unique partnerships,tourism, and workforce training and education. In the City of Clermont, the unemployment rate of 4.5 percent remains below the state average of 4.9 percent, the healthcare wages remain strong and competitive, the median household income is $56,603,and the median age is 38.8 years old. PUBLIC COMMENTS There were no public comments. REPORTS City Manager Gray reported approximately 200 people attended the State of the City address this morning. The City Council will hold a workshop on Thursday, January 19, 2017 at 6:30pm. The Collective Bargaining Agreement negotiations with the International Association of Firefighters and the Clermont Professional Firefighters Local 4350 have concluded and the contract will be on the January 24, 2017 agenda. City Attorney Mantzaris— No report. Council Member Bates— No report. Council Member Goodgame—No report. Council Member Mullins announced he was reappointed to the Lake Emergency Medical Services Board. Council Member Travis reported the South Lake Chamber of Commerce breakfast will be held on Friday, January 20, 2017 at 7:15am. Lake County Commissioner Parks will provide an update on Wellness Way. The South Lake Chamber of Commerce Business After Hours will be held at Bella Collina on January 25, 2017. Mayor Ash commented she attended the Dr. Martin Luther King, Jr. Day commemoration at Waterfront Park on January 16, 2017. 1 City of Clermont MINUTES SPECIAL COUNCIL MEETING January 17,2017 CONSENT AGENDA Mayor Ash advised the next item;on the Agenda for consideration was the Consent Agenda and requested anyone wishing to have any item pulled for discussion to please come forward at this time. Item No. 1 —Meeting Minutes Consider approval of the December 13, 2016 Regular Council Meeting minutes. Item No. 2—Surplus Request Consider approval to declare end of life inventory as surplus from the Purchasing Department, Parks and Recreation Department, Police Department, and Public Works Department and dispose of in accordance with the Purchasing Policy. Item No.3—Piggyback Contract Award Consider request to piggyback the Florida Sheriffs Association contract FSA-16VEH-14.0 with Orlando Freightliner, Inc. to purchase one sludge truck in the budgeted amount of$69,194. Item No.4—Piggyback Contract,Award Consider request to piggyback the Florida Sheriffs Association contract with Hub City Ford .to, purchase eight police vehicles in the budgeted amount of$210,448. UNFINISHED BUSINESS Item No. 5—Ordinance No. 2017-04 Final—The Addison;Rezoning City Clerk Ackroyd Howe read Ordinance 2017=04 aloud by title only. An Ordinance under the Code of Ordinances of the City of Clermont, Lake County, Florida amending the;Official Zoning Map of the.City of Clermont referred to in Chapter 122 of Ordinance No:289-C, Code of Ordinances; rezoning the real properties described herein as shown below; providing for severability, effective date,and publication. Senior Planner Kruse presented the rezoning request from C-2 General Commercial to Planned Unit Development foran apartment community called The Addison.The 19.17-acre property is located at the northwest cornersof Hooks Street'and Citrus`Tower Boulevard and extends west towards Oakley Seaver Drive. The applicant; B&S Engineering Consultants, desires to develop the site for a multi-family development with up to 12 units per acre for a total of up to 230 units. The project willconsist of 16 multi-story buildings with a clubhouse and other amenities, with no proposed commercial development. 2 City of Clermont MINUTES SPECIAL COUNCIL MEETING January 17, 2017 The applicant is requesting several waivers due to existing conditions. The waivers are to allow cut and fill up to 25 feet over the project area, 4 to 1 slope grades which include the landscape buffers, a maximum retaining wall height of 13 feet, a 3-foot terrace instead of a 5-foot terrace when 2 wall segments are required, a gated development with private streets, a driveway access and parking below the center line of adjoining roads, and a central compactor for solid waste collection. Staff acknowledges the site was previously disturbed and the original topography had been altered. Staff understands the site will be challenging to develop. The traffic report indicates the proposed development will not require additional improvements to the surrounding roadway systems. The impact of the Lake County School District is currently under evaluation and the applicant acknowledges they will be required to participate in any mitigation which may be warranted for school concurrency. The Planning and Zoning Commission voted 4 to 1 to recommend approval of the rezoning request. Staff recommended approval of the rezoning request. Major Stacey; Applicant, agreed with staff's recommendation for approval and was available to answer any questions. Mark Osier; 237 South Westmonte Drive, Altamonte Springs, Florida, commented on the need for apartments. The national average indicates between 30 and 35 percent of the population will rent apartments and in Clermont the rate is 22 percent. Third party market studies for Clermont show a demand of 459 units per year for rental units over$1,100 a month. Mr. Osier was available to answer any questions. Mayor Ash opened the public hearing. John Schmidt; 1655 East Highway 50, commented he was a contiguous business owner to the property and was in favor of the project. Ann Dewitt Severns; 14463 West Colonial Drive, Winter Garden, Florida, spoke in favor of the project on behalf of the Dewitt family, owner of property. Mayor Ash closed the public hearing. Council Member Goodgame questioned the construction materials and interior design of the buildings. Mr. Goodgame considered the application incomplete and was unable to support the project. Hooks Street and Citrus Tower Boulevard is not a good location for the proposed project and the project is more suited for the south side of Hooks Street. A project creating jobs would be more appropriate. Council Members Mullins and Bates were in agreement with Council Member Goodgame. Council Member Travis stated the Council recently voted for high density in the downtown area and the type of development proposed should be located in the downtown area. Mayor Ash noted the Council was holding a workshop for a project called The Vue; which contains apartments on the north side of Hooks Street. City Attorney Mantzaris cautioned discussing The Vue at the current meeting. 3 City of Clermont MINUTES SPECIAL COUNCIL MEETING January 17, 2017 City Manager Gray commented The Vue has an approved Conditional Use Permit for apartments and commercial uses, and the workshop was to discuss the requested amendments to their Conditional Use Permit. Mr. Osier addressed the comments and concerns stating the project would be a high-end luxury project using wood or metal materials, and some of the buildings would have elevators. The buildings would be designed around the topography, the density is appropriate for the location, and the rental rates will be affordable for the population. Commercial use of the site would create a higher volume of traffic and would not have the same curb appeal as the proposed project. Council Member Mullins stated the main issue was the location of the proposed project. Council Member Mullins asked of denying without prejudice. City Attorney Mantzaris stated a denial without prejudice was not an available option. The applicant withdrew the request. Item No. 6—Ordinance No.2017-05 Final—Jones Alley City Clerk Ackroyd Howe read Ordinance 2017-05 aloud by title only. An Ordinance of the City Council of the City of Clermont, Lake County, Florida, closing and permanently abandoning the 10-foot alley known as Jones Alley, lying south of Juniata Street and north of Broome Street as recorded in the plat of Lincoln Park Plat Book 8 Page 61 Public Records of Lake County, Florida; repealing all ordinances in conflict herewith, providing for severability, publication, recording, and for an effective date. Senior Planner Kruse presented the request to vacate a 10-foot-wide and 180 lineal foot long right-of-way known as Jones Alley. The alley was part of the Lincoln Park subdivision since January 1926 and runs from Broome Street to Juniata Street. The northern portion of the alley was previously vacated. Jones Alley has not been improved and the adjoining property owners have legal access through existing paved city streets. The applicant desires to develop the property with two single-family residences and the alley would prohibit construction of one of the homes. Staff recommended approval of vacating Jones Alley. Mayor Ash opened the public hearing. There were no public comments. Mayor Ash closed the public hearing. Council Member Goodgame moved for approval; seconded by Council Member Bates. The motion passed 5 to 0 on a roll call vote. 4 City of Clermont MINUTES SPECIAL COUNCIL MEETING January 17, 2017 NEW BUSINESS Item No. 7—Resolution No. 2017-01 Calvary Chapel Clermont City Clerk Ackroyd Howe read Resolution 2017-01 aloud by title only. A Resolution of the City Council of the City of Clermont, Lake County, Florida, granting a Conditional Use Permit to allow for a church in the C-2 General Commercial zoning district. Senior Planner Kruse presented the request for a Conditional Use Permit to establish a church in the existing Towerview office complex located at 194 US Highway 27. The church proposes to occupy the rear building and will have a sanctuary, several offices, classrooms, storage areas, and restrooms. The space was previously used by a media production company and interior renovations will be required to accommodate space needs. Calvary Chapel Clermont plans to have evening meetings Wednesday through Friday from 7pm to 9pm, and on Sundays. The church is not proposing an educational component or daycare. The parking provided for the overall project exceeds code with a ratio of 1 space for every 175 square feet; however, the applicant understands and agrees the City may require additional parking or rescind the conditional use permit should parking become an issue. The Planning and Zoning Commission recommended approval of the Conditional Use Permit. Staff recommended approval of the Conditional Use Permit. Carlos Aviles; Applicant, 13237 Long Pine Trail, was present and available to answer any questions. Mayor Ash opened the public hearing. There were no public comments. Mayor Ash closed the public hearing. Council Member Mullins inquired of the current church location. Mr. Aviles stated the church was presently located at 202 Hatteras Avenue next to Jumping Joeys. Council Member Mullins moved for approval of Resolution 2017-01; seconded by Council Member Goodgame. The motion passed with all members present voting aye. The next two items were heard concurrently and voted on separately. Item No. 8—Resolution No. 2017-02 790 West Minneola Avenue City Clerk Ackroyd Howe read Resolution 2017-02 aloud by title only. A Resolution of the City Council of the City of Clermont, Lake County, Florida, granting a Conditional Use Permit to allow for an onsite brewery, food service establishments, and other retail uses to occupy more than 3,000 square feet of floor space in the Central Business District. 5 City of Clermont MINUTES SPECIAL COUNCIL MEETING January 17, 2017 Item No. 9—Variance Request 790 West Minneola Avenue Planning Manager Henschel presented the Conditional Use Permit and variance request for a brewery to be located at 790 West Minneola Avenue in the Central Business District. The applicant desires to construct a new 7,200 square foot building for use as a restaurant and brewery. The proposed building will feature an interior overlook into the brewery's lower production area. The outside of the building will feature a large 80-foot by 20-foot outdoor patio adjacent to West Minneola Avenue. The applicant is requesting a variance to allow for a reduced parking lot landscape buffer. The applicant will be providing additional parking to the rear of the lot and can only provide a 5-foot landscape buffer along the eastern property line, and no buffer along the northern and western property lines. The northern and western property lines have an existing fence installed by the adjacent property owner. Staff recommended; should the adjacent fence be removed, the owner of 790 West Minneola Avenue would be required to install a replacement fence. Staff recommended approval of the conditional use permit and variance request. Paul Fallman; Applicant, 1932 Brantley Circle, stated he has owned property for two years and he would like to make a long term commitment to the property. Mr. Fallman will be removing the current structure and build a loft building with a brick facade, courtyard, and patio. The outdoor activities will be oriented to the front of the building to minimalize the impact on the residential area in the rear. The impact to the residential area will be the loading and unloading of pallets of hops; which typically would occur once a week. Mayor Ash opened the public hearing. Edward Apodaca; 836 West Montrose Street, representing Minneola Lakeside Villas townhomes, stated they were not opposed to the proposed project. Mr. Apodaca expressed concern of compensating for water run-off towards their property,noise,and fence maintenance. Mayor Ash closed the public hearing. Mr. Fallman stated the crushed asphalt parking surface should prevent water run-off in the direction of the townhomes and he will meet with a civil engineer to address the concern. City Manager Gray commented the location will be absorbed with the Victory Pointe project and much of the water run-off in the downtown area will be directed to Victory Pointe. Council Member Mullins asked how the pallets would be loaded into the brewery. Bill Downs; Suncreek Brewery, stated the raw material will be delivered in bulk. Suncreek does not intend to bottle in large amounts,only small amounts for carryout purposes. Council Member Mullins inquired of the waste product after fermentation. Mr. Downs commented grain would be the largest by-product, which will be hauled away using a dumpster. The brewery will develop relationships with local farmers to use the grain by-product as animal feed. The water by-product will go into the sewer system and discussions have taken place with the Environmental Services Department. 6 City of Clermont MINUTES SPECIAL COUNCIL MEETING January 17, 2017 Council Member Goodgame was in favor of the project. Council Member Bates asked of the businesses to the west of the building. City Manager Gray stated there was a hair salon and restaurant to the west of the building. Council Member Bates inquired of on-site parking. Mr. Fallman commented people are willing to walk from public parking areas and the street to visit similar establishments in other municipalities. Council Member Mullins asked of working with the city on the streetscape. City Manager Gray stated staff has discussed the streetscape project with Mr. Fallman and the City will coordinate the streetscape project with the proposed project construction. Council Member Bates moved for approval of Resolution 2017-02; seconded by Council Member Goodgame. The motion passed with all members present voting aye.
